HomeMy WebLinkAboutOrdinance No. 20036ORDINANCE NO. 000 ~G, AN ORDINANCE LEVYING ASSESSMENTS FOR ALLEY PAVING BETWEEN GARDEN AVENUE AND FRANKLIN BOULEVARD FROM WALNUT STREET TO VILLARD STREET; AND DECLARING AN EMERGENCY. CONTRACT 95-05}JOB #3187 The City Council of the City of Eugene finds that: Dn the 17th day of December, 1993, as authorized in Subsection 7.160 ~ 8 } , Eugene Code, 1971 SEC} the City Engineer initiated the proposed local improvement consisting of alley paving between Garden Avenue and Franklin Boulevard from Walnut Street Villard Street. After due notice and a public hearing thereon before the hearing official, and no remonstrances having been filed, on the 10th day of April, 1995, the City Council formed the local improve- ment district and authorized construction of the local improvement. The actual Cost of the local improvement is ascertained to be $69,270.94 and the amounts to be assessed to and borne by the specially benefitted property and to be borne by the City or others has been determined in accordance with applicable provisions of the Eugene Code, 1971 and as set forth in Exhibit A attached hereto and incorporated herein by reference. The City Council has established the method of calculating local improvement assessments in E.C. 7.170 and 7.175. A notice containing the information required by E.C. 7.185 has been posted on a bulletin board at City Hall and given by certified mail to the owners of the parcels of real property subject to the assessment more than ten days prior to the public hearing before the hearing official. At the time and place specified therein, a hearings official heard all evidence and argument presented, and no remonstrances having been filed, has fully considered the same, and has reported his or her adopted findings to the City Council. The Council has reviewed and considered the assessment report of the City Engineer and Finance officer and the hearings offi- cial's findings and summary of the hearing, and based thereon, THE CITY ~F EUGENE DOES ORDAIN AS FQLL4WS: action 1. The Summary of the hearing conducted by the hearings official are hereby made a part of the Council's record in these proceedings, and the hearings official's findings, including those regarding compliance with E.C. 7.160 to 7.190, attached hereto as Exhibit B and incorporated herein by reference, are hereby adopted. Section 2. The actual cost of the local improvement compris- ing of alley paving $74,766.78 of which $69,270.94 is hereby assessed against the parcels of property hereinafter described in the amounts set opposite, respectively. ORDINANCE ~ ~ Section 3. The City Council does hereby determine and assess each lot and part of lot being within the described local improve- meat district as set forth on the assessment roll attached as Exhibit C hereto and incorporated herein by reference. Section 4. The City Council does hereby determine that each parcel of land or lot hereinabove described is specially benefitted to the extent of the assessment set forth. The Finance officer shall give notice of the assessments to the owners of the assessed parcels advising them the assessment may be paid in full, without interest, within ten days of the effective date of this ordinance. Assessments that remain unpaid after the ten day period are declared to be liens upon the respective lots, parts of lats or parcels of land against which said several amounts are assessed, and may be paid, with interest on the unpaid principal amount commencing ten days after the effected date of this ordinance: 4.1 In up to twenty semi-annual installments, including principal and interest at the rate set by the City Manager as provided in E.C. 2.D22 through 2.024. 4.2 If the property owner sa elects, in 120 monthly install- meats, including principal and interest at the rate set by the City Manager as provided in E.C. 2.422 through 2.424 plus a service Charge to be determined by the City Manager as provided in E.C. CRD~NANCE - 3 ~.ozo. Section 5. The City Recorder is directed to enter in the docket of City Liens a statement in connection with each unpaid assessment Containing the following: 5.l A description of each lot, part of lot or acreage specially benefitted by the local improvement; 5.2 The name of the owner or reputed owner thereof, that the name of the owner is unknown; and 5.3 The sum assessed upon said property, the amount and date from which interest accrues, and the date of entering the same in the docket of City Liens. Section 6. Upon enactment of this ordinance, the City Finance officer shall send notice of the assessments by first class to the owners of the assessed parcels containing the information required by E.C. 7.190 and enclose therewith an application for paying the assessment in installments according to the terms set forth in Section 4 of this ordinance. Section 7. Any assessment remaining unpaid and for which no application for installment payments has been received may be foreclosed as provided by law. The proceeds from the payment or foreclosure of assessments levied by this ordinance shall be oRDINANCE W 4 deposited to the city funds which advanced the cost of construc- Lion, engineering and related expenses or which are used to retire any indebtedness incurred by the City for this improvement. Section 8. That the matters contained herein affect the public welfare and safety and therefore, an emergency is hereby declared to exist, and this ordinance shall become effective immediately upon its passage by the City Council and approval by the Mayor, retention by the Mayor for more than ten days, or readoption over a mayoral veto by two--thirds of all members of the Council. J ;v n ~m ~~ N ~ W N rn~ [n o ~~ ~y N ~7 -P m 0 ow W p011811°,~a EUGENE HEARINGS OFFICIAL FINDINGS AND RECOMMENDATIONS SUBJECT: ALLEY PAVING BETWEEN GARDEN AVENUE AND FRANKLIN BOULEVARD FROM WALNUT STREET TO VILLARD STREET (CONTRACT #95-05) (JOB #3187) BACKGROUND This project was initiated by a petition poll, letters} from property owners within the LID supporting the improvement who will bear 51 percent of the assessable cost. Based on the petition poll letters}, the City Engineer initiated the project, as provided for in the Eugene Code 7.1 bo~8}, on December 17,1993, and, following a March 13,1995 public hearing, the Hearings Official recommended that the local Improvement district be formed. The City Council formed the LID on April 10,1995. The praject has been completed and final assessment costs have been calculated. PROJECT The project included construction of a 14-foot wide concrete alley, transition paving and storm drainage facilities. ASSESSMENT Under City of Eugene assessment policy, 92.45 percent of the improvement costs will be distributed to the abutting property owners with the balance financed by the City. Below are the final unit assessable costs. Alley Paving Alley Paving Cost to city: $5,495.83 $24.52/front foot $ .21/sq. foot The assessable unit costs listed below are based on the low bids received prior to construction and were quoted to property owners at the LID hearing following the bid opening: Alley Paving $Z5.521front foot Alley Paving $ .211sq. foot Dne of the affected property owners has voiced concern regarding the transition paving costs ~2-3 foot wzdth} being included ~n the final assessment. These costs are not unique, however, as alley improvements within an existing setting require adjustment of the surrounding improvements generally parking lots and driveways} to match with the final grade of the alley improvement. The cost of the adjustment is included in the assessable unit cost per front foot and square foot which is then distributed to all the affected properties. A similar approach is used for driveway adjustments for roadway improvements in that the adjustment costs are included in the cost per front foot and are allocated to all the affected properties. In both designs, the grade of the improvement is set to match as close as practical with the surrounding ground and to assure appropriate drainage can be provided. Since the adjustments are an integral element of completing an alley improvement in an existing setting, the long standing practice has been to distribute these costs to all affected properties. This hearing was canceled because no one wished to offer testimony. The Hearings Official received a December 20,1995 memorandum from the City Engineer Exhibit A} outlining the above information. Cost estimates were based on the low bid and the final improvement costs are lower than those quoted at the local improvement hearing and are comparable to projects of similar size. Staff recommends approval of the assessment as calculated and that the Council levy the final assessment. Based upon the available information, it is the finding of the Hearings Df~cial that this project has been uutiated, bid and constructed in accordance with the provisions of the Eugene Code. It is the further finding of the Hearings Dfficial that the final improvement costs are lower or equal to those quoted at the local improvement hearing and are comparable to most projects of this type. Based on the petition pall letters}, the City Engineer initiated the project, as provided for in the Eugene Code 1.1608}, on December 17',1993 and the City Council formed the LID on April 10, 1995. The project has been completed, and final assessment costs have been calculated. P RoJ ECT The project included construction of a 14-foot wide concrete alley and storm drainage facilities. ASSESSMENT Under City of Eugene assessment policy, 92.55 percent of the improvement costs will be distributed to the abutting property owners with the balance f nanced by the City. Below are the final unit assessable costs. Typically, alley improvements within an existing setting require adjustment of the surrounding improvements ~generafly parking lots and driveways} to match with the final grade of the alley improvement. The cast of the adjustment is included in the assessable unit cost per front foot and square foot which is then distributed to all the affected properties. A similar approach is used for driveway adjustments for roadway improvements in that the adjustment costs are included in the cost per front foot and are allocated to all the affected properties. In both designs, the grade of the improvement is set to match as close as practical with the surrounding round and to assure appropriate drainage can be provided. Since the adjustments are an integral element of completing an alley improvement in an existing setting, the long standing practice has been to distribute these costs to all affected properties. REC~MMENDATI~N The final improvement costs are lower than quoted at the local improvement hearing and are comparable to pro}ects of similar size.
