HomeMy WebLinkAboutOrdinance No. 20051ORDINANCE No. 20051 AN ORDINANCE MODIFYING THE CITY'S PROCEDURES FDR APPGINTING AND EVALUATING A PRESIDING MUNICIPAL JUDGE AND/oR ASSOCIATE MUNICIPAL JUDGE, AND AMENDING SECTION 2.011 OF THE EUGENE CODE , 1971. THE CITY OF EUGENE DOES ORDAIN AS FOLLOWS Section 1. Subsections (9) and (10) of Section 2.011 of the Eugene Code. 1971, are amended to provide: 2. all Ci t Co nci 1 -- Ex uti ve ssi n , ~9} The presiding municipal judge and the associate municipal judge steal 1 be appointed i n the manner provided i n this section . t a } Prior to appointing the presiding muni ci pa1 judge, the counci 1 sha11 cause contract ~s } for the position to be prepared and advertised , and sot i ci t appl i cati ans far the position . The counci 1 steal 1 review the app1 i cati ons , and by majority vote determine which of the applicants steal 1 be referred to a screeni ng committee norm Hated by the mayor and appointed by the counci 1 for interview. The screening committee shall be composed of one person from each of the fol 1 owi ng : the University of aregon 1 aw school faculty; the Lane County public defender's office; the Lane County district attorney's affi ce; the city's department of public safety; the city's human rights commission ; the roster of 1 oval state or federal judges ; and the city's municipal court staff . At the time of referral , the counci 1 steal 1 indicate to the screening committee the number of fi na1 i sts to be referred for consi derati an by the caunci l . The screening committee shall interview the applicants and refer the fi na1 i sts to the council . The counci 1 steal 1 select the presiding mun i c i pa 1 judge from among those f i na 1 i sts . ~ b } Notwithstanding the pravi si ans of subparagraph ~ a } , the Counci 1 may re-appoint the incumbent presiding municipal court judge without first undertaking any of the actions specified i n subparagraph ~ a } . Cc } The associate municipal judge shall be nami Hated by the presiding municipal judge and appointed by the counci 1, ~ l0 } The performance of the presiding municipal judge and associate municipal judge steal 1 be evaluated: ~a } Through an informal self-evaluation submitted to the caunci 1 annually; t b } Through an informal eva1 uati on submitted to the counci 1 every two years; and aRD I NANC E - 1 ~ c } Through a forma 1 eva 1 uati on , conducted every four years by an evaluation committee. The informal evaluation shal 1 consist of a compl eted self-evaluation form, together with evaluation forms campl eted by representatives of the department of public safety, the city prosecutor's office, and the public defender's office. The formal evaluation process sha11 i ncl ude a publ i c hearing . Members of the evaluation committee sha11 be nominated by the mayor and appointed by the council . The committee shal 1 be composed of not 1 ess than five persons, including at 1 east one member of the human rights cammi ssi on , two attorneys farm 1 i ar with the municipal court, and two other persons generally farm 1 i ar with the judi ci a1 system. The eva1 uati on report shat 1 be submitted to and accepted by the council . Salaries of the presiding municipal judge and associate municipal judge sha11 be reviewed as part of the city's budget process, and a written recommendation of proposed rates sha 1 l be submitted to the counci 1. The City Recorder , at the request of , or with the concurrence of the City Attorney, is authorized to administratively correct any reference errors contained herein or in other provisions of the Eugene Code, 1971, to the provisions added, amended or repealed herein.
