An Ordinance vacating the following described unimproved public right-of-
way , to wit
The unimproved pub1 i c right-of-way 40-feet wide
extending from the south margin of Royal Avenue 50 feet,
located south of Royal Avenue between Bertelsen Road to
the east and Ruskin Street to the west , Tax Lats 2500
and 2600, Assessor's Map 17-04-27-22; as more
parti cut arty described i n Exhi bi t A attached hereto.

Dn the 10th day of June, 1996, the City Council of the City of Eugene by
Motion duly passed, cal 1 ed a publ i c hearing to be het d at 7 :30 p, m. , Pacific Time
on the 22nd day of July, 1996, at the Council Chambers at City Hall, Eugene,
Gregon , at which time and place protests and remonstrances could be heard as to
the proposed vacation of the above-described unimproved public right-of-way.
Notice was duly and regularly given of the hearing and at said time and
place the Council heard all objections to the proposed vacation.
All persons owning property abutting the public right-of-way to be vacated
have consented to the vacation and applied for the same.
THE CITY of EUGENE DOES ORDAIN AS FOLLOWS;
Section 1. The City Council of the City of Eugene finds that due and
regular notice of the hearing was published and posted as by law required, and
no va 1 i d objections were made at the hearing or f i 1 ed . The consent of the owners
of the abutting property has been duly and regularly filed in the proceedings and

the public interest will not be prejudiced by the vacation of the unimproved
public right-of-way.
Section 2. The hearing was held on the 22nd day of July, 1996, at 7:30
p.m. , Pacific Time, at the Counci 1 Chambers, City Hall , Eugene, Lane County,
Oregon, and all matters necessary to be done i n the premises have been duly and
regularly completed.

hereby vacated, and the public right-of-way so vacated shall revert pursuant to
the statutes of the State of Oregon .
i n 4. The City Recorder i s hereby directed to fi 1 e a certi f i ed copy
of this Ordi Hance with the Recorder of bane County, Oregon , together wi th a map
or plat of said property, and a certified copy of this Ordinance shall be filed
with the Lane County Assessor and another certified copy sha11 be fi 1 ed with the
Lane County Surveyor .

CONFORMANCE STATEMENT
for
VACATION PUBLIC RIGHT-4F-WAY
The area requested in this vacation of public right-of-way
is not presently needed for public services, facilities or
utilities.
The proposed private street designed far the proposed
subdividing of Tax lot 2~4D will extend and provide adequate
access for public services facilities and utilities in the
future to properties to the south.
This vacation is cgnsistent with applicable transportation
plans.
