ADMINISTRATIVE ORDER NO. 57-22-02-F
of the
City Manager of the City of Eugene
SETTING LIBRARY FEES AND SUPERSEDING THE FEE SCHEDULE
ADOPTED BY ADMINISTRATIVE ORDER NO. 57-19-03-F.
The City Manager of the City of Eugene finds as follows:
A. Section 2.020 of the Eugene Code, 1971, authorizes the City Manager of the City
of Eugene to determine and set fees and charges to be imposed by the City for services, goods, use
of municipal property, and licenses and permits. Pursuant to that authority, on November 7, 2019,
I issued Administrative Order No. 57-19-03-F making the most recent changes to the Library fees
and adopting an updated Library Fee Schedule (“the Fee Schedule”).
B. On March 28, 2022, I issued Administrative Order No. 57-22-02, ordering that
notice be given of the opportunity to submit written comments on my proposal to amend the Fee
Schedule. The Notice specified that comments on the proposed amendments would be received
for 15 days from April 5, 2022, the posting date of the Notice. No comments were received within
the time or in the manner described in the Notice.
C. Based on my investigation pursuant to the provisions of Section 2.020 of the
Eugene Code, 1971, I find that the fees should be set as proposed. (See Exhibit B to this Order)
D. The unamended Library fees adopted by Administrative Order No. 57-19-03-F are
incorporated into the Fee Schedule attached as Exhibit A to this Order.
On the basis of these findings, I order that:
1. The Library Fee Schedule attached as Exhibit A to this Order is the schedule of fees
to be charged for the described services effective May 1, 2022.
2. The Fee Schedule attached to Administrative Order No. 57-19-03-F is superseded
by the Library Fee Schedule attached as Exhibit A to this Order, effective May 1, 2022.

5. Fee Exceptions
Replacement of lost library cards, and lost, incomplete and/or damaged materials’ replacement fees are
not charged in the circumstances listed below:
● Theft of library card and/or materials (Police report required)
● Materials destroyed in fire or severe weather event (Report required)
● Bankruptcy (Bankruptcy Petition or letter from the Court required)
● Medical hardship (e.g., death in the family, hospitalization of self or family member)
● “Educational” fee exception (Applies to library card replacement only)

City Manager’s Findings
Proposed Library Fee Schedule Amendments
Pursuant to Section 2.020(2) of the Eugene Code, 1971, the City Manager has considered the
following factors in determining the proposed Library fee schedule amendments:
(a) Applicable policies, enactments and directives of the Council.
Findings:
The mission of Eugene Public Library is to support an informed community, lifelong
learning, and the love of reading by promoting access to the universe of ideas and
information to all city residents. It is our goal to provide equitable information access to
our community; and going fine free would create more equitable information access.
We are committed to removing systemic barriers to access and inclusion in all our
services.
The removal of fines is supported by the American Library Association. In January, the
ALA passed a resolution which recognizes fines as a form of social inequality and calls on
libraries nationwide to find a way to eliminate them. Specifically, the resolution urged
libraries to eliminate monetary fines because they “present an economic barrier to access
of library materials and services” and “there is mounting evidence that indicates eliminating
fines increases library card adoption and library usage.” The resolution also urged
“governing bodies of libraries to strengthen funding support for libraries so they are not
dependent on monetary fines as a necessary source of revenue.”
We believe this aligns with our organizational mission, our commitment to equity, diversity
and inclusion, and supports a Council statement on racial equality, which in part
called for a “look at our city policies through an equity lens with the goal of
reforming city policies that continue a legacy of racism.”
(b) The amount charged by the City in the past.

(c) The full costs of providing the service supported by the fee.
Findings: We have found that approximately 6% of our Circulation Supervisory Team
time is dedicated to the charging and collecting of library fines/fees, which is an annual
cost of $30,422.88. Additionally, we have found that approximately 12% of our desk staff
time is spent charging and collecting library fines/fee for an annual cost of $122,655.60.
This means we end up spending $156,630.72 in staff time yearly to collect the $235,000
budgeted amount to library fines/fees.
(d) The amounts charged by other comparable providers.
Findings: The amounts that other libraries charge for fines and fees varies. Across the
nation, there are a significant number other library systems that do not charge fines for
overdue items to reduce access barriers. In Oregon, this includes many of our peers
such as Multnomah County Library, Washington County Cooperative Library System,
Jackson County Library Services, and Springfield Public Library has already committed
to that change and has not yet taken effect.
(e) The revenue needs of the City as determined by the adopted city budget.
Findings: The Eugene Public Library has reduced its General Fund budget by the
amount the amount budgeted to be collected via fines/fees, $235,000. This reduction of
budget allows the elimination of charging overdue fines while keeping the General Fund
impact neutral.
