ADMINISTRATIVE ORDER NO. 58-22-03-F
of the
City Manager of the City of Eugene
SETTING SHARED MICROMOBILITY SERVICE LICENSE FEES.
The City Manager of the City of Eugene finds as follows:
A. Sections 3.015 and 3.572 of the Eugene Code 1971 (“EC”) authorize the City
Manager to impose fees pursuant to EC 2.020 to implement the provisions of EC 3.570, 3.572 and
3.574.
B. In Ordinance No. 20634, the City Council granted the City Manager authority to
establish a pilot program by issuing no more than three shared micromobility device licenses
during the first year of the shared micromobility licensure program, after which time additional
licenses may be granted consistent with Chapter 3 of the Eugene Code, 1971, and the
administrative rules and fees adopted pursuant thereto.
C. Shared Micromobility Service License Administrative Rules have been established
implementing the provisions of EC 3.570, 3.572 and 3.574 regarding the one year Shared-Use
Electric Scooter Pilot Program. It is necessary to impose license fees to implement the Code
provisions and the Rules.
D. On February 24, 2022, I issued Administrative Order No. 58-22-03, ordering that
notice be given of the opportunity to submit written comments on my proposal to establish a Shared
Micromobility Service License Fee Schedule. The Notice specified that comments on the
proposed fees would be received for 15 days from the Notice publishing date of February 26, 2000,
and the Notice posting date of February 28, 2022. The written comments received during the
public comment period are addressed in the City Manager's Findings Supporting Proposed Fees
for Shared Micromobility Services attached as Exhibit B to this Order.
E. Based on my investigation pursuant to the provisions of Section 2.020 of the
Eugene Code, 1971, I find that the fees should be established as proposed. (See Exhibit B to this
Order)
On the basis of these findings, I order that the Shared Micromobility Service License
Fee Schedule attached as Exhibit A to this Order is the schedule of fees to be charged for the
described services as of the effective date of this Order.

Findings Supporting Proposed Fees for Shared Micromobility Services
Pursuant to Section 2.020(2) of the Eugene Code, 1971, the City Manager has considered the
following factors in determining the proposed fees for shared micromobility services.
(a) Applicable policies, enactments and directives of the Council.
- Sections 3.005 3.570, 3.572 and 3.574 of the Eugene Code (re: shared micromobility devices)
- Through an adopted ordinance and plan, the City Council has set aggressive targets for
reducing fossil fuel use and greenhouse gas emissions from transportation. The City Council
adopted the Climate Recovery Ordinance that set Climate Action Goals that include reducing
community-wide fossil fuel use by 50 percent compared to 2010 usage with a benchmark target
of a 25 percent reduction by 2020. The City Council adopted the Eugene 2035 Transportation
system Plan (TSP), including a goal of supporting the city’s target of a 50 percent reduction in
fossil fuel consumption and specifically calls for a tripling of the percentage of trips made on
foot, by bicycle and by transit.
(b) The amount charged by the City in the past.
No license for shared micromobility operations has been implemented in the city previously.
(c) The full costs of providing the service supported by the fee.
Full service and operation costs will be covered by the licensee. After considering comments on
the initial rule and fee proposals, City staff reconsidered the costs of providing the service and
the means for ensuring the costs would be covered by the fees. An estimated $20,000 of staff
time/year will be supported by the fees to pay for licensee management. Third-party data
management for compliance is estimated at an additional $10,000 - $16,000. Collected fees
beyond staff time costs will be applied to Transportation Options programs and projects.
(d) The amounts charged by other comparable providers.
