ADMINISTRATIVE ORDER NO. 58-22-24
of the
City Manager of the City of Eugene
EMERGENCY AMENDMENT OF SHARED MICROMOBILITY
SERVICE LICENSE ADMINISTRATIVE RULE R-3.570 ADOPTED BY
ADMINISTRATIVE ORDER NO. 58-22-02-F.
The City Manager of the City of Eugene finds that:
A. Section 2.019 of the Eugene Code, 1971 (EC), authorizes the City Manager or
designee to adopt rules for implementation of any provisions of that Code. EC 2.019(6) authorizes
the City Manager to adopt emergency rules without prior public notice or hearing.
B. On April 19, 2022, I issued Administrative Order No. 58-22-02-F adopting Shared
Micromobility Service License Administrative Rule R-3.570.
C. Since the adoption of Rule R-3.570, City staff have learned that the privacy policy
required of licensees by R-3.570-B(1)(h).1 would be prohibitively disruptive to a licensee’s
business, effectively rendering it too inefficient because it is substantially different from that of
the industry standard used in dozens or even hundreds of cities, and place an unreasonable burden
on City staff to review each case.
D. Establishment of an emergency rule to conform the City’s licensure program to
current industry standards without prior public notice pursuant to subsection (6) of Section 2.019
of the Eugene Code, 1971, is necessary so that a shared micromobility services license can be
issued by the City in advance of the World Athletics Championships, when an anticipated 200,000
visitors will need ways to travel to, from, and between hospitality and retail locations and Hayward
Field, to reduce reliance on car rentals and public passenger vehicles and, consequently, reduce
congestion on city roads and greenhouse gas emissions.
NOW, THEREFORE, based upon the above findings and pursuant to the authority in
subsection (6) of Section 2.019 of the Eugene Code, 1971, I order that the amendments to Shared
Micromobility Service Licenses Administrative Rule R-3.570 shown in legislative format below
are immediately effective, and remain in effect for 180 days unless replaced earlier by an
emergency rule, temporary rule, or permanent rule adopted in accordance with the provisions of
EC 2.019 of the Eugene Code, 1971.
SHARED MICROMOBILITY SERVICE LICENSE
ADMINISTRATIVE RULE R-3.570
1. Administrative Rule R-3.570, adopted by Administrative Order No. 58-22-02-F is
amended to incorporate the following revisions to Section R-3.570-B(1)h:

h. A privacy policy that safeguards users’ information, including personal, financial,
and travel information. The policy shall:
1. State that the applicant will safeguard a user’s personal data using
reasonable, industry standard security measures and will not disclose to
any third party a user’s name, address, financial information, travel origin,
travel destination, or travel route without providing notice to the user;
2. Provide users the opportunity to explicitly assent to any privacy policy
(users must have the ability to decline sharing any data not required to
process and complete the transaction); and
3. Include a provision stating that the user assents to the licensee providing
user’s shared micromobility device location data with the City and City-
designated third-parties.
