AN ORDINANCE CONCERNING INTERFERING WITH A PEACE OFFICER
AND AMENDING SECTION 4.907 OF THE EUGENE CODE, 1971.
THE CITY OF EUGENE DOES ORDAIN AS FOLLOWS:
Section 1. Section 4.907 of the Eugene Code , 1971, is amended to provide as follows :
EC 4.907 Interfering With a Peace Officer .
(1) A person commits the crime of interfering with a peace officer if the person, knowing that
another person is a peace officer, intentionally or knowingly acts in a manner that prevents, or
attempts to prevent, the peace officer from perform i ng the lawful duties of the officer with
regards to another person, or a criminal investigation .
(2) This section does not apply in situations in which the person is engaging in passive
resistance .
(3) A person may not be arrested or charged under this section if the person is arrested or
charged for another offense based on the same conduct.
Section 2. The City Recorder, at the request of, or with the consent of the City Attorney,
is authorized to administratively correct any reference errors contained herein, or in other
provisions of the Eugene Code , 1971, to the provisions added , amended or repealed herein .
