BACKGROUND The City Council adopted a priority issue to facilitate the development of a hospital in Eugene's central core. Last week, McKenzie- Willamette Medical Center announced it had selected its preferred site which it has agreed to purchase. The site is currently a golf course off Delta Highway north of Ayres Road. The letter announcing the site from Roy Orr, Chief Executive Officer ofMcKenzie-Willamette is attached. Staff has done some very preliminary work on the proposed site, based on the information known to date. That information is attached in correspondence from the City to Roy Orr. Staff would also like to note that as potential sites move forward in local processes, there is additional information City decision-makers should be aware of related to ex parte contacts and bias. Ex parte contacts are communications, information or contacts relating to the matter to be heard by the City Council that occur after an application is filed with the City. This includes verbal and written contacts from anyone, site visits, or media information. Communication with City staff is not considered ex parte contact. If there is an ex parte communication, the councilor (or Mayor) must publicly announce the contact and context and state whether it has impaired the person's ability to be impartial. Parties to the quasi-judicial proceeding then need to be provided a chance to rebut the ex parte contact either at the hearing, or if the hearing has already occurred, at a re-opened hearing. Bias means having certain preconceived thoughts about an issue of policy, the law, the facts or the parties that will keep a decision-maker from being persuaded to consider any other perspective on the matter. A biased elected official may not participate in a quasi-judicial decision. Parties in a quasi- judicial proceeding may challenge a decision-maker's participation based on bias, particularly where the decision-maker has made statements that demonstrate that he or she has made up his or her mind about a proposal even before the decision-maker has listened to the testimony. LICMOl200S Council AgendaslMOSl128lS0S1128C.doc RELATED CITY POLICIES There are many City policies that will be discussed if and when this proposed hospital site moves forward through any type of land use or City action. Potential impacts on related policies will need to be discussed and addressed when more information is available about the proposed site and any future development. COUNCIL OPTIONS The City Council has many options to consider as part of this discussion. Some of the options to consider: 1. Council can take no action. 2. Council can direct the City Manager to begin work on a Memorandum of Understanding (MOU) with McKenzie- Willamette Medical Center related to the proposed hospital site. 3. Other. CITY MANAGER'S RECOMMENDATION The City Manager recommends Option 2 - direct the City Manager to begin work on a MOU with McKenzie- Willamette Medical Center to identify issues, roles and responsibilities related to this proposed site moving forward as the Eugene hospital site. SUGGESTED MOTION I move to direct the City Manager to begin work with McKenzie- Willamette Medical Center on a MOU for the proposed site off Delta Highway north of Ayers Road. ATTACHMENTS A. McKenzie- Willamette Medical Center seeks to build a 148-bed state-of-the-art acute care hospital on the property. We anticipate adjacent development of one or more medical office or surgery center building(s) totaling as much as 100,000 square feet each. We now seek information from the City of Eugene about the following questions/issues: 1. Zoning and Regulatory Reviews McKenzie- Willamette desires to assure itself that the property is or can be properly zoned for hospital development, and appropriate regulatory reviews can be completed quickly, to facilitate start of construction. Please describe the steps and estimated time lines (critical path) for all applicable land use review and building pennit processes in order for us to gain access to site for construction a. Annexation b. Zoning c. Land use plan amendments (Would the City initiate any Plan amendments?) 2. Site Issues Over the next thirty days, please ensure there are no unreasonable limitations for redevelopment of the property--which may be contained either in existing l'egulations or held by the City on its own behalf or on behalf of the County or any other source. Please address any unique regulatory requirements for construction on the property, such as (but not limited to) 'a. setbacks, b. height restrictions, c. stann water, d. waste water, e. floodplain, f. parking, and g. public safety requirements, 1460 G Street · SPRINGFIELD, OR 97477-4197 . Are there other non- regulatory expectations held by the City? 3. Utilities Ensure (water, gas, sewer) can be delivered to the site. McKenzie-WilIamette Medical Center seeks fiber optic, telecommunications, electrical and cable TV (all buried) at the site. 4. Transportation Improvements Ensure transportation improvements necessary to support our proposed development. We understand the property to be served by a county road. McKenzie-WiIlamette Medical Center seeks a minimum of three curb cuts or access points to the property from Delta Highway, improvement of the existing roadway to four lanes including turn lanes, and addition of traffic signals to facilitate emergency vehicle traffic. We also seek installation of appropriate street lights, covered bus stops, landscaping and irrigation. 5. Fees and Charges Facilitate filing and processing of all applicable land use, building pennit, and systems development charges. Please identify any of these reviews, fees or timelines the City is prepared to absorb or expedite to facilitate its goal of hospital development. We would like to receive this information from you no later than Monday, November 21st. Our goal is to clarify roles, responsibilities and expectations. Orr Chief Executive Officer McKenzie- Willamette Medical Center 1460 G Street Springfield, OR 97477-4197 Dear Roy: We are in receipt of your letter dated November 15,2005 regarding a potential Eugene hospital site.' In your letter you ask for information related to zoning and regulatory issues, site issues, utilities, transportation improvemelltsand fees related to a potential hospital at a site located off Delta Highway north of Ayers Road. Although it is always difficult to give definitive answers without an exact site plan and specific development proposals so potential impacts can be determined, we will take this opportunity to give you the information we have at this point baSed on what you have given us. The City has done some initial investigation into the potential site, and has produced the attached table to address many planning/zoning issues, fee issues and annexation issues. In addition, we have some information related to tt:ansportation and the process a project such as this might go through. Under the State's Transportation Planning Rule (TPR), amendments to the Metro Plan or to a refinement plan require determinations of whether the amendments would "significantly effect" an existing or planned transportation facility. The TPR defines the term "significantly effect" for purposes of this analysis, and that definition and related provisions were recently amended by the State. Until the City has more information about the proposed development, we cannot state with any certainty whether we think that the proposed development will "significantly effect" Beltline Highway, the Beltline HighwaylDelta Highway interchange, or other existing or planned transportation facilities. In the event that the proposed hospital and medical office buildings will "significantly effect" the Beltline Highway and the Beltline HighwaylDelta Highway interchange, the TPR provides several options for addressing that significant effect, including: 1. Funding of capital improvement projects to the state highway system approved by the Oregon Department of Transportation, or to other effected transportation facilities. 2. Implementation of on~site transportation demand management measures such as .alternative work schedules, bicycle parking, transit passes, etc. approved by the City of Eugene. 3. Changes to the perfonnance standards of the affected state highway system by the Oregon Transportation Commission, or to local standards by the Metro partners. 4. A combination of the above three options. Some of the questions not answered here will require additional time or additional infonnation to answer. The City Council is tentatively scheduled to have a work session on this potential Eugene hospital site on November 28,2005, starting at 5:30 p.m. in the McNutt Room of City Hall. There will be no opportunity for testimony at that meeting. Potential Site and Utility Issues for Hospital Siting Potential City of Eugene Permitting Proeess & Issues for Hospital Siting November 21, 2005 The following information represents a synopsis of existing land use information for property located on the west side of Delta Highway, on tax lots 304, 305 and 306 of Assessor's Map 17-03..Q7-00, also known as River Ridge Golf Course, owned by River Ridge LLC and Eric and Deborah Jeffries. The information listed below is only applicable to those portions of the property within the current Urban Growth Boundary (DGB). The remaining portions are zoned E-30 Exclusive Farm Use 30- acre minimum and are under Lane County Jurisdiction. UGB EXistini! Conditions No portion is currently within the city limits. Tax lot 305, eastern portion of Tax lot 304 and portion of 306 north of Ayres Road are within UGB. Western portion of Tax lot 304 and portion of 306 south of Ayres Road are outside UGB. Potential Site and Utility Issues for Hospital Siting November 21,2005 The following information is a summary of some of the site issues and utility issues for property located on the west side of Delta Highway, on tax lots 304, 305, and 306 of Assessor's Map 17-03-07-00, also known as River Ridge Golf Course, owned by River Ridge LLC and Eric and Deborah Jeffries. The information below is only applicable to those portions of the property with the current Urban Growth Boundary. Floodplain - The two parcels north of Ayres Road are outside of the tOO-year floodplain. The floodplain boundary generally follows the Urban Growth Boundary. The parcel south of Ayres Road is within the l00-year floodplain. Any development on this parcel would require the elevation of the first finished floor of any structures to be one foot above the loo...year floodplain. Street Improvements - The local transportation improvements to serve the proposed hospital include the extension of Delta Highway as a three-lane facility north of Ayres Road the full length of the parce4 approximately 1,700 feet. In addition, a traffic signal would likely be warranted at the intersection of Delta Highway and Ayres Road. The estimated cost of the improvements is $2.6 million and includes design, construction and right of way. Stormwater - The parcels north of Ayres Road can drain to the south to Dodson Slough which flows westerly across the parcel south of Ayres Road. It is anticipated that tbe City will have stormwater quality development standards codified by June 2006. The standards will require stormwater quality facilities for all new development. Wastewater - All of the parcels can be served by tbe extension of an existing to-inch wastewater line approximately 800 feet from the intersection ofMeadowview Drive and Waterbrook Drive. The estimated cost of the extension is $115,000. An easement across The Nines golf course would be required with the extension of a wastewater pipeline. Water - The Eugene Water Electric Board (EWEB) is the water provider within the City of Eugene. There is a 12-inch ductile iron water main that extends to tbe intersection of Ayres Road and Delta Highway. Although tbe capacity of this water main has not been analyzed and field tested, it should be capable of meeting a minimum of 3500 gallons per minute at 20 pounds per square inch, whicb is the typical fire flow required for an industrial type complex. Water mains would need to be extended north along Delta . Highway, to and through the proposed hospital site. Electric - The EWEB is the electric providecwithin the City of Eugene. There is no extra electric feeder capacity at the intersection of Delta Highway and Ayres Road. A new feeder will likely needto be installed from the Cal Young Substation. There is capacity at the Cal Young Substation, including an extra feeder position. A new feeder can serve up to 5MV A ofload, which should be sufficient for the proposed hospital. Fiber Qpticffeleeommunieations - Qwest and EWEB both provide fiber optic services within the City of Eugene. Qwest's fiber optic network ends several hundred feet south of the intersection of Ayres Road and Delta Highway. EWEB's fiber network extends to the intersection of Delta Highway and Ayres Road. Natural Gas - Northwest Natural is the gas provider within the City of Eugene. There is an existing 4-inch natural gas pipeline at the intersection of Ayres Road and Delta Highway.
