HomeMy WebLinkAboutOrdinance No. 20052ORD I NANO E No . ~005~ AN ORDINANCE CONCERNING THE CITY STORMWATER SYSTEM ~ AND AMENDING SECTIONS 6.406 AND 6.446 OF THE EUGENE CODE, 1971. THE CITY OF EUGENE DOES ORDAIN AS FOLLOWS: Section 1. The definition of "City stormwater system" set forth i n Section 6.406 of the Eugene Code, 1971, i s amended to provide: 6.406 Definitions . For purposes of sections 6.401 through 6.645, unless the context requires otherwise words and phrases shall have the meaning ascribed to them . In interpreting the meaning of words i n a def i ni ti on , ather defi ni ti ans of that word i n this Code may be considered City stor~water,,s~er~. Those stormwater facilities located on city-awned property, city right -of -way, city easements and any stormwater faci 1 i ty the city i s contractually or 1 egal ly obligated to operate and maintain , including but not 1 i mi ted to ~a 7 An apes drai nageway, headwater stream, creek, wetland, spring, or pond, including those not maintained by the city which drain onto city-owned property or into city maintained facilities; t b ~ A pi pe or sewer and its related appurtenances that carry stormwater and have been designed and constructed expressly for use by the general public and accepted by the city ; ~c7 Streets , curbs and gutters and other surfaces i n the public way which are designed to carry stormwater, roadside drainage ditches along unimproved city streets but not access drive culverts ; and Ordinance - 1 ~d} Flood control and stormwater quality faci 1 i ti es ~ 1 evees , dikes , overf 1 ow channels , swa 1 es , bi of i 1 trati on faci 1 i ti es , i nfi 1 trati on faci 1 i ti es , detenti an basins , retention basins , dams , pump stations , groundwater recharging basins , sediment traps , wetlands , etc . ~ that have been designed and constructed expressly for use by the general public and accepted by the city . Section 2. Subsection X37 of Section 6.446 of the Eugene Cade, 1971, i s amended to provide 6.446 Di schar e of Forei n Matter ~ Preventati ve Devices . ~3~ No person shal 1 discharge, or cause to be discharged, i nta the city stormwater system any substance other than stormwater, except discharges resulting from fire fighting activities , or discharges authorized by written approval of the city manager or the manager's designee. The city manager may deny approval to di scharge i nto the city stormwater system i f the discharge poses a threat to health, safety, public wet fare, or the environment, or i s otherwise prahi bi ted by 1 aw. The city manager may withdraw approval to discharge i f the manager determines that a di scharge poses a threat to health, safety, pub1 i c welfare, or the environment, ar i s otherwise prahi bi ted by 1 aw. Any person 1 awful 1y discharging pursuant to a Nati ona1 Pollutant Discharge Elimination System permit as of July 24, 1996 shall be deemed to have received written approval from the city manager. Such approval may be withdrawn i f the manager determines that the discharge poses a threat to health, safety, public wet fare, or the environment , or i s otherwise prahi bi ted by 1 aw. The city manager may adopt rut es pursuant to section 2.019 of this code to define spec? fi c ordinance - 2 circumstances or criteria for a determi nati on that a di scharge poses a threat to health, safety, public welfare, or the environment. Section 3 . The City Recorder , at the request of , or with the concurrence of the City Attorney, i s authorized to admi ni strati ve1y correct any reference errors contained herein or i n other provisions of the Eugene Cade, 1971 to the provisions added or amended herein.
