On the 9th day of September , 1996 , the City Counci 1 of the City of Eugene
by Motion duly passed , ca11 ed a publ i c hearing to be held at 7 : 3~ p . m. , Paci fi c
Time on the 14th day of October, 1996, at the Counci 1 Chambers at City Hal 1,
Eugene, Oregon , at which time and place protests and remonstrances cool d be heard
as to the proposed vacation of the above-described al 1 ey and portions of the
rights-af-way.
Notice was duly and regularly given of the hearing and at said time and
place the Counci 1 heard all objections to the proposed vacation ,
Al 1 persons owning property abutting the al 1 ey and the portions of the
rights-of-way to be vacated have consented to the vacation and applied for the
same.
THE CITY ~F EUGENE DOES ORDAIN AS FoLL4WS
Section 1. The City Council of the City of Eugene finds that due and
regular notice of the hearing was published and posted as by law required, and
no valid objections were made at the hearing or fi 1 ed . The consent of the owners
of the abutting property has been duly and regularly fi 1 ed i n the proceedings and

the publ i`c interest wi 11 not be prejudiced by the vacation of the a1`1 ey and
portions ofi the r7 ghts -of way .
Section 2. The hearing was held on the 14th day of october , X996, at 7:30
p . m . , Pacific Time, at the Counci 1 Chambers , City Ha11, Eugene, Lane County ,
oregon, and all matters necessary to be done i n the premises have been duly and
regul a r1y completed .
Section 3. The herei nabove-described alley and portions of the rights -of-
way are hereby vacated, and the alley and portions of the rights-of-way so
vacated sha11 revert pursuant to the statutes of the State of oregon.
Section 4. The City Recorder is hereby directed to fi le a certi fled copy
of this ordinance with the Recorder of Lane County , oregon , together wi th a map
or p1 at of said property, and a certi fi ed copy of this ordinance sha11 be fi 1 ed

CITY'-4wNED BRGADwAY AND CHARNELTGN DEVELOPMENT SITE
The City of Eugene is seeking to vacate portions of the north-southalleyright-of way and a
three-foot, east-west streetright-of-way along Broadway at the proposed 'Lest End development
site located at Broadway and Charnelton Street. As indicated on the attached map Attachment
A}, the locations of the proposed alley and right-of-way vacations are:
1. The southern portion of the north-south alley located between Lincoln and Charnelton
Streets that extends south from the east-west alley intersection located between 8th
Avenue and Broadway.
~. The northern portion of the north-south alley located between Lincoln and Charnelton
Streets that extends north from the east west alley intersection located between 10th
Avenue and Broadway.
3. A three-foot streetright-of way along the north and south sides of Broadway between
Lincoln and Charnelton Streets.
The purpose of the requested alley and right-of-way vacations is to implement the Eugene City
Council-approved west End development project. This proposed project includes a proposed
700+ stall underground parking garage,150+housing units, and approximately 25,000+ square
feet of commercial development. See Attachment B--A computer simulation of the design
concept.}
The Cifiy of Eugene is the petitioner for the requested vacations. As provided in GRS 271.130,
the City of Eugene may make such vacations without a petition or consent of abutting and
affected property owners. Therefore, this vacation request does not have attached consents.

C}; and 2} A schematic plan of the north side of Broadway detailing the residential podium level

1} If subject area is not presently or is the future needed for public services,
facilities, or utilities?
This alley vacation request was preliminarily discussed with Duane Bischoff of the Engineering
Division in February 1996. As per that discussion, attached are copies of the 1992 Storm Sewer
Master Plan Map and the 1992 Sanitary Sewer Master Plan Map Attachments A & B} indicating
the locations of lines in the vicinity of this request.
As shown on the storm sewer map, there is an 1 S" storm sewer line located in the alley of the
requested vacation. ~t is anticipated that this storm sewer line will be rerouted. Also shown is a
10" sanitary sewer line located in the east-west alley located south of the City-owned property. It
is anticipated that this sanitary sewer line may need to be rerouted.
2} If such public services, facilities, or utilities can be extended is as orderly and
efficient manner.
As indicated above, necessary base infrastructure upgrades consisting of relocation of the storm
sewer in the alley and replacement of the sanitary sewer in the alley will be performed and paid
for by the City of Eugene.
3} If the vacation is consistent with applicable transportation plans.
As stated in the Central Area Transportation Study's SCATS}, Policies and Suggested Strategies
section, Proposed Policy 3.0:
Encourage owners of undeveloped property, especially surface parking Tots, to
develop and use parcels more intensively.
The proposed development at this site complies with this CATS section because it seeks to
convert the existing surface parking lot into a more intensive use by developing it into a multi-
usesite ofhousing, parking, and commercial uses.
Also in the Central ,Area Transportation Study, in Section v, Parking and Proposed Policies,
more specifically, under the Su ested Strate ie to ~m lement the Pro osed Polic section
states:
10.1 Encourage surface lots to be converted to development sites and replace existing
surface parking supplies with multi-level parking structures when and where

The proposed development is in compliance with this transportation goal because of the multi-
level parking structure that is proposed to be constructed at the site.
Also, on the attached Central Area Transportation Study, Appendix B, Map 10 Attachment
C}, the proposed VLTest End site is noted as a site that is currently used as surface parking that
could be developed into a potential parking facilities site.
