Home My WebLink AboutOrdinance No. 20069ORDINANCE NO. ~;Z j~ AN ORDINANCE AUTHORIZING THE INSTITUTION OF PROCEEDINGS IN EMINENT DOMAIN FOR THE ACQUISITION OF PROPERTY INTERESTS FOR THE FERRY STREET BRIDGE CORRIDOR PRESERVATION - ENHANCEMENT PROJECT (JOB #905; AND DECLARING AN EMERGENCY. The City Council of the City of Eugene finds that: A. The City Council has authority under provisions of the City Charter and applicable state law to institute proceedings in eminent domain for the acquisition by condemnation of private property for public purposes, including the construction of a bikelpedestrian bridge, paths and undercrossings; improvements to streets and vehicular structures; installation of traffic signals, sidewalks, landscaping and other public improvement features; and the realignment of traffic flow. B. The Council approved the design concept far the Ferry Street Bridge Preservation- Enhancement Project on August 9, 1995 and reaffirmed the project on September 30, 1996. A federal grant will pay for So per cent of the project costs, and City of Eugene and Lane County finds have been budgeted to provide local matching funds. C. The proposed improvements are incompliance with and in furtherance of the plans and specifications prepared by the City Engineer in accordance with provisions of Chapter 7 of the Eugene Code, 1971 and applicable policies of the City of Eugene. D. The project is necessary in order to preserve and improve existing structures and roadways in the Ferry Sheet Corridor, to enhance safety and access for all modes of travel in the corridor, and to construct and improve facilities for bicycles, pedestrians, transit, and motor vehicles using this major transportation facility. The planned improvements address these public needs in a manner that is the most compatible with the greatest public good and least private .. ~n~ury. E. The requirements of federal and state officials relating to obligation of federal grant funds for these corridor improvements, and the need to facilitate the safe and efficient movement of traffic, transit, bicyclists, and pedestrians requires the Ci to act rom tl to ac wire the tY p P y q necessary property interests for this project. Based upon the above findings, which are incorporated herein by reference and hereby adopted, the City Council of the City of Eugene does hereby find, declare, and determine that it is necessary to acquire all real property interests, including but not linuted to fee sun le P title and easements, in the real property, or portions thereof, more particularly described on Exhibit A attached hereto and incorporated herein by reference, necessary in order to construct the Ferry Street Bridge Corridor Preservation-Enhancement Project. ection 2. The City Council hereby declares that the improvements above set forth are for a public purpose, are necessary for the public welfare, are the most compatible with the greatest public good and the least private injury, and are authorized under the laws of the State of Oregon and Charter and ordinances of the City of Eugene. eeti n 5.
