A RESOLUTION ESTABLISHING HAZARDOUS
SUBST ANCE USER FEES FOR THE FISCAL YEAR
COMMENCING JULY 1, 2000.
The City Council of the City of Eugene finds that:
A. Pursuant to Article VII of Amendment IV to the Eugene Charter of 1976 (the
"Amendment"), the City Council has previously adopted Resolution No. 4587 establishing fees to
be paid by hazardous substance users within the City for the 1999 fiscal year.
B. In accordance with other requirements of the Amendment, Ordinance No. 20188
adopting the 2000 Hazardous Substance Tracking Instructions was adopted by the Council and
approved by the Mayor on February 28, 2000.
C. As a result of decisions of the Court of Appeals and Circuit Court in litigation
involving the Amendment, the City revised the method of calculating the hazardous substance user
fees. Section 3.694 of the Eugene Code, 1971 which was adopted on February 28, 2000 by
Ordinance No. 20189, imposes a fee upon hazardous substance users in an amount per FTE to be
established by resolution of the Council and paid annually, no later than May I of each year. That
section further provides that the first fee due under that section was to be paid by May I, 2000, or
within 30 days of the date the City mails an invoice setting forth the amount due, whichever is later.
D. The Toxics Board has recommended a fee of $14.31 per FTE be imposed for the
fiscal year commencing July 1, 2000 in order to cover the expenses of the program for that fiscal
year. Issues surrounding a shortage or surplus of funds at the end of the fiscal year will be addressed
equitably for all participating hazardous substance users, in accordance with generally accepted
accounting procedures.
NOW, THEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF EUGENE, a
Municipal Corporation of the State of Oregon, as follows:
Section 1. A fee of $14.31 per FTE is hereby imposed as the fee to be paid by hazardous
substance users within the City of Eugene for the fiscal year commencing July I, 2000. The fee shall
be due and payable within 30 days of the date the City mails an invoice to a hazardous substance
user setting forth the amount due.

Section 2. As used in this Resolution, the terms "FTE," and "hazardous substance users"
have the meanings ascribed to them in Section 3.692 of the Eugene Code, 1971.
Section 3. The fees collected pursuant to this Resolution shall be used solely for the purpose
of operating the Toxics Right-to-Know Program created by Amendment IV to the Eugene Charter
of 1976 and implemented by subsequent ordinances of the City, commencing with the July 1,2000
fiscal year.
The foregoing Resolution adopted the 12th day of June, 2000.
