AN ORDINANCE qF THE CITY OF EUGENE, LANE
CUUNTY, OREGON CALLING A SPECIAL ELECTION TO
SUBMIT TO THE VOTERS OF THE CITY A MEASURE
AUTHORIZING ATHREE-YEAR SERIAL LEVY OUTSIDE
CONSTITUTIONAL LIMITATION COMMENCING ~'VITH
THE 1997-98 FISCAL YEAR; PROVIDING AN EXCEPTION
TO THE TIlV1E LINE REQUIREMENTS FOR THE VOTER'S
PAMPHLET IN THE EUGENE CODE, 1971; AND
DECLARING AN EMERGENCY.
The City Council of the City of Eugene finds that:
A. Due to the passage of State Measure 47, the City will experience a loss of funding
estimated to be approximately $ i 0, 000, 000, $12, 000, 000, and $ ~ 4, 000, 000 for the next three
fiscal years respectively.
B. In order to mitigate this loss of funding for City services, a three year serial levy
of $10,900,000 per year commencing in fiscal year 1997195, for a total levy of $32,700,000,
which is outside the d% limitation of section 11, Article Xr of the Oregon Constitution should be
referred to the City electors.
C. The purpose of the serial levy is to partially replace funding Iost due to Measure
47. Of the $10,900,000 proposed to be levied for fiscal year 1997195, $2,000,000 will be held
in reserve to meet the anticipated loss in fiscal year 1999100. 1n the event the actual funding loss
is less than projected, the City Council will not Ievy more than the amount of the loss. In the
event Measure 47 is voided, no levy will be made by the City Council.
NOW, THEREFgRE,
THE CITY OF EUGENE ORDAINS AS FOLLOWS:
Section 1. A special election is called for the purpose of submitting to the qualified voters
of the City the following Measure, which is hereby adopted by the City Council, subject to voter
approval:

Shall Eugene levy $10, 900, 000 for three years outside tax base and Article ~1,
section 11 g, for operations, starting 1997-95?
Prior to Measure 47's passage, Eugene had authority to levy $48,500,000 in
property taxes for fiscal year beginning July 1, 1997 ~FY98}. The State estimates that
Measure 47 causes Eugene to lose approximately $10, 000, 000 in FY98 . For FY99 and
FY2000, estimated loss grows to $12,000,000 and $14,000,000, far total loss over three
years of $36,000,000.
Voter approval of this $32,700,000 levy will partially restore the $36,000,000 in
taxes lost from Measure 47. During April and May, the Council will complete its revenue
reduction strategies which will identify what services will not be funded if the levy fails,
and how the Council will address the smaller reduction which will occur even if the levy
passes.
The actual loss due to Measure 47 is uncertain. 1f the loss is less than current
estimates, the Council will not levy more than is necessary to replace the loss for the next
3 years. If Measure 47 is voided, the Council will not levy any portion.
This levy is subject to the other governmental purposes limits of section 11b,
Article ~I of the Oregon Constitution, but is not subject to the limits of Article ~I, section
11g.
Section 2. The Measure shall be placed upon the official ballot by the City Recorder.
Notwithstanding any provision of the Eugene Code,1971, the ballot title for the Measure set forth
in Section 1 of this Ordinance is hereby adopted. The City Recorder shall furnish to the County
Clerk for Lane County, a copy of the ballot title for the Measure, as attached hereto as Exhibit
1, and direct that the County Clerk for Lane County place the Measure upon the ballot to be used
at the special city election to be voted upon by the electors of the City.
Section 3. The City Council orders this special election to be held in the City of Eugene,
Oregon on the 20th day of May, 1997, in accordance with the provisions of Chapter 254 of
Oregon Revised Statutes, and the ballots shall be counted. and tabulated and the results certified
as provided by law.
Section 4. The City Recorder is directed to give not less than ten X10} days notice of the
special election by publication of one ~1} notice thereof in the Register Guard, a newspaper of
general circulation within the City of Eugene. A copy of the notice is attached hereto as Exhibit
2, and incorporated herein by reference.
ection 5. Notwithstanding any time line requirements of Sections 2.993 to 2.997 of the
Eugene Cade, 1971, the proponent and opponent committees for preparation of the voter's
pamphlet shall be appointed by March 31, 1997. The proponent and opponent committees shall
thereafter have one week to draft arguments and one week to draft rebuttals. Citizens wishing to

submit arguments in support or opposition to the measure shall have until April 7, X997 to do so.
Section 6. The matters contained herein concern the public welfare and safety, and in
order to ensure the timely certification of this measure to the Lane County Clerk, an emergency
is hereby declared to exist, and this Ordinance shall become effective immediately upon its
passage by the City Council and approval by the Mayor, retention by the Mayor for more than
ten days, or readoption over a Mayoral veto by two-thirds of all members of the Council.

NOTICE is hereby given that a City election will be held in the City of Eugene, Oregon, on
Tuesday, the ~Oth day of May,1997, to be conducted by the Lane County Election Department in
accordance with the provisions of ORS Chapter X54 of Oregon Revised Statutes. This election is
called for the purpose of voting on the following Measure of the City of Eugene:
