AN ORDINANCE CONCERNING CITY COUNCIL AND
PLANNING COMMISSION PROCEDURES; AMENDING
SECTIONS 2.005, 2.047, 2.011, AND 2.345, AND
REPEALING SECTION 2.01 ? OF THE EUGENE CODE,1911.
THE CITY OF EUGENE DOES ORDAIN AS FOLLOWS:
Section 1. Section 2.005 of the Eugene Cade, 1911, is amended to provide:

be established by the city manager.
Section 2. Section 2.007 of the Eugene Code, 1971, is amended to provide:
2.007 City Council - Meetings.
~1} Council meetings shall be held on the dates and at the times
established by the council groundrules. The first evening meeting each month is the
regular meeting, to be adjourned at the conclusion thereof to the next scheduled meeting.
~2} The mayor may, or at the request of three councilors, shall, call a
special meeting of the council.
~3} The council groundrules shall provide for the manner of public notice
to be given of the time and place for holding meetings of the council and of the boards,
committees, commissions and subcommittees of the city, which shall be in compliance with
the Oregon public meeting law.
~4} Except upon unanimous consent of the council, the council shall hold
a# least one public hearing prior to taking final action on any ordinance.
~5} Priarto invoking the forfeiture provision of section 23 of the Eugene
Charter of 1916 for a councilor's unexcused absence from two consecutive regular
meetings, the council shall cause written notice of its intent to act to be served upon the
affected councilor,

~l} The council groundrules shall provide far the taking of written minutes
of all its meetings in accordance with the public meeting law.
~8} No council meeting shall be held at any place where discrimination on
the basis of race, creed, color, sex, age or national origin is practiced. However, the fact
that organizations with restricted membership hold meetings at the place shat! not restrict
its use by the council if use of the place by a restricted membership organization is not the
primary purpose ofthe place or its predominate use. Meetings do not include any an-site
inspection of any project or program, or the attendance of councilors at any national,
regional yr state association to which the city or the councilors belong.
~9} Meetings of city boards, committees, commissions or subcommittees
shall be governed by the foregoing provisions.
Section 3. Section 2.U11 of the Eugene Code, 1971, is amended to provide:

~1 } The presiding municipal judge and the associate municipal judge shall
be appointed in the manner provided in this section.
~a} Prior to appointing the presiding municipal judge, the cauncil
shall cause contracts}for the position to be prepared and advertised, and
solicit applications for the position. The council shall review the
applications, and by majority vote determine which of the applicants shall be
referred to a screening committee nominated by the mayor and appointed by
the council far interview. The screening committee shall be composed of
one person from each of the fallowing: the University of Oregon law school
faculty; the Lane County public defender's office; the Lane County district
attorney's office; the city's department of public safety; the city's human
rights commission; the roster of local state or federal judges; and the city's
municipal court staff. At the time of referral, the cauncil shall indicate to the
screening committee the number offinalists to be referred for consideration
by the cauncil. The screening committee shall interview the applicants and
refer the finalists to the council. The council shall select the presiding
municipal judge from among those finalists.
fib} Notwithstanding the previsions of subparagraph ~a}, the council
may re-appoint the incumbent presiding municipal court judge without first
undertaking any of the actions specified in subparagraph ~a}.
~c} The associate municipal judge shall be nominated by the
presiding municipal judge and appointed by the council.
~2} The performance of the presiding municipal judge and associate
municipal judge shall be evaluated:
~a} Through an informal self-evaluation submitted to the council
annually;
fib} Through an informal evaluation submitted to the council every
two years; and

~c} Through a formal evaluation, conducted every four years by an
evaluation committee.
The informal evaluation shall consist of a completed self-evaluation form, together with
evaluation forms completed by representatives of the department of public safety, the city
prosecutor's office, and the public defender's office. The formal evaluation process shall
include a public hearing: Members of the evaluation committee shall be nominated by the
mayor and appointed by the council. The committee shall be composed of not less than
five persons, including at least one member of the human rights commission, two attorneys
familiar with the municipal court, and two other persons generally familiar with the judicial
system. The evaluation report shall be submitted to and accepted by the council. Salaries
ofthe presiding municipal judge and associate municipal judge shall be reviewed as part
of the city's budget process, and a written recommendation of proposed rates shall be
submitted to the council.
Section 4. Section 2.017 of the Eugene Code, 1911, is hereby repealed.
Section 5. Section 2.345 of the Eugene Code, 1911, is amended to provide:
2.345 Plannin Commission - Meetin s.
~1} The commission may make and alter rules and regulations for its
government and procedure, including the dates, times and places of its meetings,
consistent with the laws of the state, the city Charter and ordinances.
~2} Five members of the commission shall constitute a quorum.
Section 6. The City Recorder, at the request of, or with the concurrence of the City
Attorney, is authorized to administratively correct any reference errors contained herein
or in other provisions of the Eugene Code, 1971, to the provisions added, amended or
repealed herein.
