AN GRDINANCE CONCERNING CITY RECORDER AND
FINANCE OFFICER REFERENCES IN THE EUGENE CURE,
1971; REPEALING SECTION 2.025 OF THAT CURE; AND
AMENDING SECTIONS 2.030 AND 2.500 OF THAT CURE.
THE CITY OF EUGENE DUES ORDAIN AS FOLLOWS:
Section 1. The following sections of the Eugene Code, 1971, shall reference the "city
recorder" and not the "f Hance officer":
2.020; 2.393; 2.399; 2.430; 2.510; 2.520; 2.888; 2.964; 2.970-2.988; 2.990; 2.992; 2.996;
2.1000; 2.1025; 2.1035; 5.045; 5.510; 6.825; 5.010.
Section 2. The following sections of the Eugene Code, 1971, shall reference the "finance
off cer" and not the "city recorder":
2.505; 2.515; 2.525; 2.527; 2.530; 2.540; 2.542; 2.543; 2.544; 2.545; 2.546; 2.547; 2.555;
2.625; 2.925; 3.770-3.804; 4.933; 6.090; 6.100; 6.476; 6.835; 6.840; 7.154; 7.160; 7.166; 7.185;
7.187; 7.190; 7.195; 7.200; 7.215; 7.220; 7.225; 7.230; 7.235; 7.250; 7.270; ~~7.340; 7.407;
7.500; 7.520; 7.530; 7.535; 7.540; 7.595; ~ 7.605; 9.033; 9.040.
Section 3. The following sections of the Eugene Code, 1971, shall reference the "city" and
not the "f Hance office":
2.625; 6.215; 6.220.
Section 4. The following sections of the Eugene Code, 1971, shall reference the "city
engineer" an not t e "finance officer":
7.465; 7.470; 7.475; 7.490; 7.495.
Section 5. Section 2.025 of the Eugene Code,1971, is hereby repealed.
Section 6. Section 2.030 of the Eugene Code,1971, is amended to provide:

2.43 o Labor Contract Conditions. All contracts executed by the city wherein labor is
required, except contracts for the purchase of materials and supplies, shall contain the
following provisions:
~a} A statement that the contract will comply with all provisions required
by the statutes of the state, of contractors on a "public contract," as defined in ORS
279.3141}.
fib} A statement that the contractor will comply with all of the
requirements of sections 4.615 to 4.655.
~c} A statement that the contractor shall, in the event helshe willfully
violates the provisions of this section, or knowingly files false affidavits of
compliance, waive for a period of One year any right to bid upon any public works
prof ect let by the city.
(d} if a contractor or subcontractor violates the provisions of this section,
the city manager may at his~her option, terminate said contract or subcontract and
said contractor or subcontractor in such event shall forfeit all rights under hislher
contract except to payment for actual labor and materials furnished to the city. The
city manager may waive in whale ar in part any forfeitures or sanctions provided in
subsection ~c} above.
Section 7. Section 2.500 of the Eugene Code, 1971, is amended to provide:
2.540 Finance Dfficer and Ci Recorder - Def ned. As used in this code "finance
officer" and "city recorder" shall mean the persons} appointed by the city manager
to perform the functions and duties of .city recorder and city treasurer.
Section S. The City Recorder, at the request of, or with the concurrence of the City Attorney,
is authorized to administratively correct any reference errors contained herein or in other provisions
of the Eugene Code,1971, to the provisions added, amended or repealed herein.
Section 9. The City Recorder shall amend the sections of the Eugene Code, 1971, as
noted above, and with the concurrence of the City Attorney, is further authorized to make changes
to provisions of the Eugene Code, 1971 to make the Code language gender neutral.
