HomeMy WebLinkAboutOrdinance No. 20128GRDINANCE NG. 201ZS AN GRDINANCE CALLING A CITY ELECTIGN GN NGVEMBER 3,1995, FGR THE PURFGSE OF REFERRING TG THE LEGAL ELECTURS OF THE CITY OF EUGENE AN GRDINANCE CGNCERNING INSTALLATIGN GF AN AMERICAN FLAG GN SKINNER'S BUTTE; AND DECLARING AN EMERGENCY. The City Council of the City of Eugene finds as follows: A. It would be in the public interest to submit to the legal electors of the City an Ordinance dedicating the property commonly known as the "Butte Propert~r," the boundaries of which are described in a charter amendment adopted by the voters of the City on April 5,19I5, as a memorial to the veterans of all wars in which the United States has participated. B. The Ordinance would further provide that the City maintain an aluminum flag pole on the southeast edge of the crest of Skinner's Butte and prescribe its dimensions, the dimensions of flags to be affixed, and the manner in which flags would be displayed. NGW, THEREFGRE, based upon the above findings, THE CITY GF EUGENE DGES aRDAIN AS FGLLOwS: Section 1. The property commonly known as the "Butte Property," with boundaries as described in a charter amendment adopted by the voters of the City April 5, 1915, is hereby dedicated as a memorial to the veterans of all wars in which the United States has participated. Section 2. On the southeast edge of the crest of Skinner's Butte, the City shall maintain in perpetuity an aluminum. flag polewith anabove-ground height of at least ninety X90} feet on which shall continuously be flown an American flag of not less than 1 o by 19 feet and a larger flag of appropriate dimensions on special holidays and occasions, ~a} The flag shall be appropriately illuminated during all periods of darkness and may be lowered on occasians of high winds or other extreme weather conditions. fib} The required flag pole shall be first erected and placed in service not later than five and one half months after this section becomes effective. Section 3. The City Council orders a city election to be held in the City of Eugene, Oregon, concurrently with the general election on the 3rd day of November,199S, in accordance with the provisions of Chapter 254 of the Oregon Revised Statutes, for the purpose of referring to the qualified electors the question of whether Sections 1 and 2 of this Ordinance shall become effective, and the ballots shall be counted and tabulated and the results certified as provided by law. Ordinance -1 Section 4. The Measure shall be placed upon the official ballot by the City Recorder. Notwithstanding any provision of the Eugene Code,1971, the ballot title for the Measure set forth in Exhibit 1 to this Ordinance is hereby adopted. The City Recorder shall furnish to the County Clerk far Lane County, a certified copy of the ballot title for the Measure, as attached hereto as Exhibit 1, and direct that the County Clerk for Lane County place the Measure upon the ballot to be used at the special City election to be voted upon by the electors of the City. Section 5. ~ The City Recorder is directed to give not less than ten X10}days' notice of the city election by publication of one ~1}notice in the Register Guard, a newspaper published in the City and of general circulation within the City, a copy of which is attached hereto as Exhibit 2. Section 6. Notwithstanding any requirements of Sections 2.993 to 2.997 of the Eugene Code,1971, the proponent's statement, and rebuttal to apposition in the voter's pamphlet shall be prepared by the chief petitioners from the lt's a Butte Committee. Section 7. Sections 1 and 2 of this Ordinance shall become effective only upon approval of the electors of the City at the election on November 3,1998. Section S. That the matters contained herein concern the public health, welfare and safety and therefore, an emergency is hereby declared to exist, and this Ordinance shall become effective immediately upon its passage by the City Council and approval by the Mayor, retention by the Mayor for more than ten days, or readoption over a mayoral veto bytwo-thirds of all members of the City Council. The ordinance also would require the city to construct and maintain an aluminum flagpole with an abaveMground height of 9~ feet or more. The ordinance would require the flagpole to be located on the southeast edge of Skinner's Butte, The City must continuously fly an American flag of not less than 1 a by 19 feet, except that a larger flag of appropriate dimensions must be flown on special holidays and occasions. The flag must be flown day and night, and must be illuminated during all periods of darkness. It can be lowered only an occasions of high winds or other extreme weather conditions. Exhibit I NOTICE OF CITY ELECTION CITY OF EUGENE NOTICE is hereby given that a City election will be held in the City of Eugene, Oregon on Tuesday, November 3,1998, to be conducted by the Lane County Election Department in accordance with the provisions of Chapter 254 of aregan Revised Statutes. This election is called for the purpose of voting on the following Measure of the City of Eugene; Measure (~~ : .TITLE: "AMERICAN FLAG UN SKINNER'S BUTTE." ~uestzon: Shall City erect 9o foot aluminum flagpole on crest of Skinner's Butte to fly American flag? The ordinance would require the flagpole to be located on the southeast edge of Skinner's Butte. The City must continuously fly an American flag of not less than 10 by 19 feet, except that a larger flag of appropriate dimensions must be flown on special holidays and occasions.
