HomeMy WebLinkAboutOrdinance No. 20129ORDINANCE NO. 20129 AN ORDINANCE GF THE CITY GF EUGENE, LANE COUNTY, OREGON CALLING AN ELECTION TU BE CONDUCTED ON NOVEMBER 3,1995, TO SUBMIT TO THE VOTERS OF THE CITY A MEASURE AUTHORIZING A FOUR-YEAR SERIAL LEVY FUR LIBRARY OPERATIONS; AND DECLARING AN EMERGENCY. The City Council of the City of Eugene Ends that: A, Eugene Public Library's facilities and services have lagged behind service demand and need. Since the.current library's opening in 1959, the City's population has increased 2112 times and the City's area has doubled; in the same time, annual circulation has increased almost seven times. There are almost 80,000 registered borrowers, with 80% of the City's households reporting at least one library card. More than 535,000 patrons visited the library in FY98, or about four tunes the City's population, Eugene is the only city of its size on the west coast with no branch libraries. Per capita, expenditures for books and library materials place Eugene eighth of the twelve largest Oregon public libraries. Attendance at children's programs, Tnternet Center use and volunteer hours all have been increasing. B. Tn October of 1997 the City Council authorized creation of the Mayor's Library Tmprovement Committee ~"Mayor's Committee"}. The Mayor's Committee was charged with the development of a plan to address improved library services and facilities and to return a completed proposal for Council consideration. C. At its June 1,1998 meeting the Council approved use of the downtown urban renewal funds to build a new downtown library. Discussion of the operating costs for the new library and branch libraries was deferred until the Mayor's Committee submitted its report to the Council. D. The Mayor's Committee has submitted its report and recommended that the Council place an $8,760,000 ,four-year local option levy serial levy} on the November, 1998 ballot. The Mayor's Committee made several key recommendations that affect the local option levy. The recommendations are: 1. The optimal size for a new library would be approximately 100,000 square feet, if sufficient funding can be secured, The library should be located at the Rice `N' Spice lot an the half block south of 10~~ Avenue between Olive and Charnelton Streets; 2. Two branch libraries should be established on a phased basis in neighborhood shopping centers. The branches should be located in the Northwest and Northeast sectors of the City. The first branch should be opened as soon as feasible after approval of funding; Ordinance -1 3 . Services at the main library should be improved. Enhancements should include restoration of Sunday service, increase in the books and materials budget, encouragement of the use of volunteers, and enhancement of the staging and hours at the Internet Center. E. These recommendations formed the basis for development of the library local option levy, which is designed to provide the following services: 1. Main Libr One-Time and ~ eratin Costs: funding for fi~rnishings, fixtures and equipment OFF&E~ at the new main library, costs of moving and mothballing the current facility as needed, and expanded operating costs beginning when the new library opens; 2. Branch Libraries: set-up and operating costs for two branch libraries to be opened within the first two years of the levy and drop boxes far convenient return of library materials; 3. Service Enhancements: Sunday hours at the main library beginning as soon as possible; service enhancements beginning when the new library opens, including expanded materials collection, enhanced volunteer coordination, and an enhanced Internet Center. The levy will also include factors far uncollectible property tax payments, interest earnings, interest expense, and an Unappropriated Ending Fund Balance Ito provide for positive cash flow prior to receipt of property taxes}. F. The levy as proposed will be a total of $8,70,000 over four years, with $2,190,000 levied per year. The average tax rate is expected to be $0,29 per $1,040 of assessed value. Atypical Eugene taxpayer will pay an average of $37.50 per year over the four year period of the levy. Now, THEREFORE, THE CITY OF EUGENE DDES URDAIN AS FULLUWS: Section 1. A special election is called for the purpose of submitting to the qualified voters of the City the following Measure, which is hereby adopted by the City Council, subject to voter approval: MEASURE N0. FnUR-YEAR LIBRARY OPERATIONS SERIAL LEVY. Shall Eugene levy $2,190,000 per year commencing fiscal year 1999104 for library operating costs? This measure may cause property taxes to increase more than three percent. This levy would be imposed for four years. ordinance - 2 The funds provided by this levy will be used to meet one-time costs and operations of a new large main library and two branch libraries. Levy funds also can be used for service enhancements, including Sunday hours, enhanced collection, and enhanced Internet center. A budget for each year will be prepared, reviewed, and approved by the City. The $2,190,000 levy will remain the same in each year for the four-year period, for a total levy of $8,760,000. This levy is subject to the limitation of section 11b, Article XI of the Gregon Constitution. Section 2. The Measure shall be placed upon the official ballot by the City Recorder. Notwithstanding any provision of the Eugene Code,1971, the ballot title for the Measure set forth in Exhibit 1 to this ordinance is hereby adopted. The City Recorder shall furnish to the Caunty Clerk for Lane County, a certified copy of the ballot title for the Measure, as attached hereto as Exhibit 1, a1~d direct that the County Clerk far Lane County place the Measure upon the ballot to be used at the special city election to be voted upon by the electors of the City. Section 3. The election will be held in the City of Eugene, aregon on the 3~~ day of November, 1998, in accordance with the provisions of Chapter 254 of Oregon Revised Statutes, and the ballots shall be counted and tabulated and the results certified as provided bylaw. Section ~, The City Recorder is directed to give not less than ten X10} days' notice of the election by publication of one ~1~ notice thereof in the Register Guard, a newspaper of general circulation within the City of Eugene. A copy of the notice is attached hereto as Exhibit 2, and incorporated herein by reference. Section 5. Notwithstanding any requirements of Sections 2.993 to 2.997 of the Eugene Code,1971, the proponent's statement, and rebuttal to opposition in the voter's pamphlet shall be prepared by the Chair of the Mayor's Library improvement Committee, together with up to two other persons to be chosen by the Chair. Section 6. That the matters contained herein concern the public health, welfare and safety and therefore, an emergency is hereby declared to exist, and this Ordinance shall become effective immediately upon its passage by the City Council and approval by the Mayor, retention by the Mayor for more than ten days, or readoption over a mayoral veto bytwo-thirds of all members of the City Council.
