O/ AN ORDINANCE LEVYING ASSESSMENTS FOR SAlvITARY SEWER EXTENSION IN PRAIRIE ROAD FROM 650 FEET SOUTH OF PRAIRIE ROAD FROM BELTLINE ROAD TO KAISER AVENUE, AND DECLARING AN EMERGENCY. (CONTRACT 97-08)(JOB #3437) The City Council of the City of Eugene finds that: an the 6th day of March, 1997, as authorized in Subsection 7.1605}, Eugene Code,1971 SEC} the City Engineer initiated the proposed local improvement consisting of sanitary sewer extension in Prairie Road from 654 feet south of Beltline Road to Kaiser Avenue. After due notice and a public hearing thereon before the hearing off cial, and no remon- strances having been filed, on the 23rd day of June, 1997, the City Council formed the local improvement district and authorized construction of the local improvement. The actual cost of the local improvement is ascertained to be $ I,o99,093.13, and the amounts to be assessed to and .borne by the specially benefitted property, as that property is defined in Resolution No. 4526 forming the local improvement district, and to be borne by the City or others have been determined in accordance with applicable provisions of the Eugene Code, 1971 and asset forth in Exhibit A attached hereto and incorporated herein by reference. The City Council has established the method of calculating local improvement assessments in E.C. 7.170 and 7.175. A notice containing the information required by E.C. 7.1 SS was posted on a bulletin board at City Hall and given by certified mail to the owners of the parcels of real property subj ect to the assessment mare than ten days prior to the scheduled public hearing before the hearing official. At Ordinance -1 the time and place specified therein, and no persons appearing personally or in writing, nor any remonstrances having been filed, the hearings official considered the evidence and has reported his adopted findings to the City Council. The Council has reviewed and considered the assessment report of the City Engineer and Finance Officer and the hearings official's" findings and summary, and based thereon, THE CITY HF EUGENE DHSS HRDAIN AS FHLLH''~S: Section 1. The hearings official's summary is hereby made a part of the Council's record in these proceedings, and the hearings official's findings, including those regarding compliance with E.C. 7.160 to 7.190, attached hereto as Exhibit B and incorporated. herein by reference, are hereby adopted. Section 2. The actual cost of the local improvement consisting of sanitary sewer extension in Prairie Road from 650 feet south of Beltline Road to Kaiser Avenue is $1,099,093.13, of which $518,537.03 is hereby assessed against the parcels of property hereinafter described in the amounts set opposite, respectively. Section 3. The City Council does hereby determine and assess each lot and part of lot being within the described local improvement district as set forth on the assessment roll attached as Exhibit C hereto and incorporated herein by reference. Section 4. The City Council does hereby determine that each parcel of land or lot herein above described is specially benef~tted, as identif ed in Resolution No. 4526, to the extent of the assessment set fort. The Finance Officer shall give notice of the assessments to the owners of the assessed parcels advising them the assessment may be paid in full, without interest, within ten days of the effective date of this ordinance. Assessments that remain unpaid after the ten day period are Ordinance - 2 declared to be liens upon the respective lots, parts of lots or parcels of land against which said several amounts are assessed, and may be~ paid, with interest on the unpaid principal amount commencing ten days after the effective date of this ordinance: 4.1 In up to twenty semiannual installments, including principal and interest at the rate set by the City Manager as provided in E.C. 2.022 through 2.024. 4.2 If the property owner so elects, in 120 monthly installments, including principal and interest at the rate set by the City Manager as provided in E. C. 2.022 through 2.024 plus a service charge to be determined by the City Manager as provided in E.C. 2.020, Section 5. The City Recorder is directed to enter in the docket of City Liens a statement in connection with each unpaid assessment containing the following: 5.I A description of each lot, part of lot or acreage specially benefitted by the local improvement; 5.2 The name of the owner or reputed owner thereof, or that the name of the owner is unknown; and 5.3 The sum assessed upon said property, the amount and date from which interest accrues, and the date of entering the same in the docket of City Liens. Section G. Upon enactment of this ordinance, the City Finance Officer shall send notice of the assessments by first class to the owners of the assessed parcels containing the information required by E.C. 7.I90 and enclose therewith an application for paying the assessment in installments according to the terms set forth in Section 4 of this ordinance. Section 7. Any assessment remaining unpaid and for which no application for installment payments has been received may be foreclosed as provided by law. The proceeds from the payment Qrdinance - 3 or foreclosure of assessments levied by this ordinance shad be deposited to the city funds which advanced the cost of construction, engineering and related expenses or which are used to retire any indebtedness incurred by the City for this improvement. Section 8. That the matters contained herein affect the public welfare and safety and therefore, an emergency is hereby declared to exist, and this ordinance shall become effective immediately upon its passage by the City Council and approval by the Mayor, retention by the Mayor for more than ten days, or re-adoption over a mayoral veto bytwo-thirds of all members of the Council. The purpose of the agreement was to regulate annexations and make provision for urban services in the uni:~~:corporated portions of the highway 99 North industrial area. The Council approved the following .~tion: "To direct the City Manager to execute the Highway 99 North polity and annexation agreements; to seek ordinance changes by bane Cr~unty, ruse changes by DEQ, and statiutory changes by the Legislat~~re to implement these agreements; and to amend Section ~ of the Annexation and Urban Services Agreement to reflect a tax differential rate that will cover approximately half the cost of a refinement plan." This agreement stipulated that both developed and undeveloped properties outside the City limits and within the Urban Growth B~ourdary will have to submit a delay of effective date annexation agreement to the City of Eugene to connect to the wastewater system. Only properties requesting services would be included in the local improvement district. All properties requesting service from the sewer have submitted an annexation agreements. In April of 1991, the Industrial Corridor Community Grganization, a Oregon nonprofit corporation and formally recognized community organization ~"ICCD"} and the City of Eugene tCITY}, an Oregon Municipal corporation entered into an agreement to develop a plan to provide a wastewater collection system and implement an annexation program for properties within the Industrial Corridor. The Industrial Corridor is generally that triangular-shaped area located within the acknowledged Urban Growth B oundary of the City of Eugene bounded on the west by the Eugene-Springfield Metropolitan Area General Plant"Metro Plan"} Urban Growth Boundary, on the east by the Northwest Expressway, on the north by Awbrey Lane and on the south by the existing city limits. The Industrial Corridor has a unique urban geography as the result of the parallel northwest-southeast orientation of three highways and two railroads serving the area. There are several parcels of long and narrow dimension. Properties in the Industrial Corridor are currently served by individual on-site sewage disposal systems under permits from Lane County pursuant to rules and regulations of the Gregon Department of Environmental Quality. There is a mixture of land uses in the Industrial Corridor, SANITARY SEWER EXTENSION IN PRAIRIE ROAD FRAM BELTLINE ROAD TO KAISER AVENUE FINAL ASSESSMENT Page ~ although the primary use is industrial. Most of the property in the Industrial Corridor is designated for industrial uses in the Metro Plan. The City desires that all properties in the Industrial Corridor be annexed to the City by 2010 and serviced by the City local} and Metropolitan Wastewater Management Commission ~regional~ sewer system by 2000. Both parties recognized that new development in the Industrial Corridor area should be connected to any available City sewer system at the time of development and receipt of a building permit. The City Engineer initiated the project to construct a sewer collection system on March 6, 1997, as provided for in the Eugene Code 7. ~ 608} and tf~e City Council formed the LID on June 23,1997. The project has been completed, and final assessment costs have been calculated. PROJECT DESCRIPTION The project included construction of 4465-feet of gravity sewer pipe from 650 feet south of Beltline Road to Kaiser Avenue. ASSESSMENT Under City of Eugene assessment policy, 47 percent of the improvement costs will be distributed to the abutting property owners with the balance financed by the City. The final assessable costs have been calculated based on this sharing of the costs. Total Assessable Cost: $ 774,202.71 Total Assessable Area: 1,353,311 Square Feet Lateral Sewer Line Cost: $ 0.491per square foot of assessable area Service Cost: $ 3,484.201each These final costs reflect an approximately 420 feet extension of this project to the south, enabling two (2} additional lots to become part of the LID. The cost to resurface Prairie Road was distributed among the properties that receive services from this system. The costs were broken into two ~2~ components. Resurfacing cost associated with the main line sewer trench is part of the~lateral cost. The resurfacing cost of the service line trench is part of the service cost. In 1996, a portion of this sewer system was constructed as part of Lane County's improvement project along Irving Road. Properties along Irving Road from the Northwest Expressway west to 1900 feet west of Prairie Road are served by this portion of the system. These properties where not assessed for this construction. Properties along Irving Road, that did not request to be included in the LID, will pay an S-inch equivalent assessment as they connect to the sanitary sewer. No person indicated an interest in attending the hearing and no written testimony was submitted, therefore no hearing was held. The City Engineer submitted a report to the Hearings officer Exhibit A}. FINDINGS AND RECONIlVIENDATION Nature of the Assessment The Hearings Officer finds that the project is one for which the assessments are for local improvements as set forth in SRS 310.4I0 because 1. The assessments do not exceed actual costs; 2. The assessments are imposed far a capital construction project which .provides a specific benefit for a specific property or rectifies a problem caused by a specific property 3. The assessments are imposed in a single assessment upon completion of the project; and 4. The assessments allow the property owners to elect to pay the assessment with interest over at least ten ~ 10} years. The Hearings official agrees with the recommendation of the City Engineer. The Hearings ~f~cial recommends approval of the assessment distribution. The Hearings official also recommends that the City Council adopt an ordinance for assessment as set forth by the City Engineer.
