AN ORDINANCE VACATING THE CUL-DE-SAC LOCATED
UN THE EAST SIDE OF PORTLAND STREET AND
PROVIDING AN EFFECTIVE DATE AND A POTENTIAL
REPEAL DATE AS OF JUNE 7,1999.
The City Council of the City of Eugene finds that:
Qn the 9th day of November,1998, the City Council of the City of Eugene by Motion duly
passed, called a public hearing to be held at 7:3 ~ p.m., Pacific Time on the 7th day of December,
1998, at the Council Chambers at City Hall, Eugene, Qregon, at which time and place protests and
remonstrances could be heard as to the proposed Council initiated vacation, with the consent of the
abutting property owners, of the following described portions of street right-of way.
The cul-de-sac located on the east side of Portland Street, south of
31St Avenue, Tax Lots 12204 and 12205, Assessor's Map 18-43-07-
11,more particularly described in Exhibit A attached hereto. City of
Eugene, SV 98-5}.
Reserving herein a public utility easement as more particularly set
forth in Exhibit B attached hereto.
THE CITY OF EUGENE DUES ORDAIN AS FOLLOWS:
Section 1. The City Council of the City of Eugene f nds that due and regular notice of the
hearing was published and pasted as by law required, and no valid objections were made at the
hearing or filed. The proposed vacation will not substantially affect the market value of the property
abutting the above-described portions of street right-af way and the public interest will not be
prejudiced by the vacation of the portions of street right-of way. The hearing was held on the 7th
day of December, 1998, at 7:30 p.m., Pacific Time, at the Council Chambers, City Hall, Eugene,
Lane County, Qregan, and all matters necessary to be done in the premises have been duly and
regularly completed.
ORDINANCE -1
Section 2. The herein above-described portions of streetright-of way are hereby vacated,
subj ect to the retained public utility easement, andthe pardons ofstreetright-of way so vacated shall
revert pursuant to the statutes of the State of Oregon.
Section 3. Notwithstandingthe provisions of the Eugene Charter of 1976 as to the effective
date of ordinances, this Ordinance shall not become effective until 34 days from the date this
Ordinance is adopted by the Council and approved by the Mayor or a lot line adjustment between
Tax Lots 12204 and 12245, Assessor's Map 18-03-47-11is approved, whichever is later. This
Ordinance shall be automatically repealed if the lot line adjustment is not approved within 180 days
from the date of adoption of this ordinance.
Sectian 4. Upon the effective date as provided in Section 3 above, the City Recorder is
hereby directed to file a certified copy of this Ordinance with the Recorder of Lane County, Oregon,
together with a map or plat of said property, and a certified copy of this Ordinance shall be f led with
the Lane County Assessor and another certified copy shall be filed with the Lane County Surveyor.

A parcel of land lying in the northwest I14 of Section 7, Township 18 South, Range 3 west of
the Willamette Meridian, all in Eugene, Lane County, Oregon, said parcel being more
particularly described as follows:
Beginning at a found 518" iron pin marking the southwest corner of Lot 2, Block 1, of Portland
Park, as platted and recorded in Book 47, Page ~ 6, Lane County Oregon Plat Records, in Lane
County Oregon, said paint also being on the right-af-way line of that certain cul-de-sac
dedicated ~. the above mentioned Portland Park; thence continuing along said right-of-wa line
