Z0151 AN URDINANCE LEVYING ASSESSMENTS FUR PAVING, CURBS, GUTTERS, STREET LIGHTS, PEDESTRIAN SIGNAL, STREET TREES, FURCE MAIN, AND STURM DRAINAGE SYSTEMS qN BARGER DRIVE FRUM TERRY STREET TU GREENHILL RUAD; PAVING, CURBS, GUTTERS, STREET LIGHTS, STREET TREES, WASTEWATER AND STURM DRAINAGE SYSTEMS IN LEGACY STREET AND THE WASTEWATER SYSTEM ALUNG THE SUUTH, EAST, AND NURTH BOUNDARIES OF THE BETHEL #52 SCHUUL DISTRICT PROPERTY TAX LUT #17-04-ZO-00-01400; AND DECLARING AN EMERGENCY. CONTRACT 98-02~~JUB #3503} The City Council of the City of Eugene f nds that: On the 27th day of July,1997 the City Council, by motion duly passed, initiated the proposed local improvements consisting of paving, curbs, gutters, street trees, force main, and storm drainage systems on Barger Drive from Terry Street to Greenhill Road, and the paving, curbs, gutters, street lights, street trees, wastewater and storm drainage systems in Legacy Street and the wastewater system along the south, east, and north boundaries of the Bethel #52 Schaol District property Tax Lot # 17-04-20-00-01440. After due notice and a public hearing on March 31,1998 before the hearing official, and no remonstrances having been Bled, on the 6th day of Apri1,1995, the City Council farmed the local improvement district and authorized construction of the local improvement. The actual cost of the local improvement is ascertained to be $3,55~,399.0~, and the amounts to be assessed to and borne by the specially benefitted property and to be borne by the City or others have been determined in accordance with applicable provisions of the Eugene Code, 1971 and as set forth in Exhibit A attached hereto and incorporated herein by reference. The City Council has established the method of calculating local improvement assessments Ordinance -1 in E.C. 7.170 and 7.175. A notice containing the information required by E.C. 7.1$ 5 was po sted on a bulletin board at City Hall and given by certified mail to the owners of the parcels of real property sub j ect to the assessment more than ten days prior to the scheduled public hearing before the hearing official. At the time and place specified therein, and no persons appearing personally or in writing, nor any remonstrances having been f led, the hearings off cial considered the evidence and has reported his adopted findings to the City Council. The Council has reviewed and considered the assessment report of the City Engineer and Finance Officer and the hearings official's f ndings and summary, and based thereon, THE CITY 4F EUGENE DGES GRDAIN AS FULLOWS: Section 1. The hearings off cial's summary is hereby made a part of the Council's record in these proceedings, and the hearings official's findings, including those regarding compliance with E.C. 7.160 to 7.190, attached hereto as Exhibit B and incorporated herein by reference, are hereby adopted. Section 2. The actual cost of the .local improvement consisting of paving, curbs, gutters, street lights, pedestrian signal, street trees, force main, and storm drainage systems on Barger Drive from Terry Street to Greenhill Road, and the paving, curbs, gutters, street lights, street trees, wastewater and storm drainage systems in Legacy Street and the wastewater system along the south, east, and north boundaries of the Bethel #52 School District property Tax Lot # 17-04-2000-01400 is $3,SS6,399.06, of which $812,045.34 is hereby assessed against the parcels of property hereinafter described in the amounts set opposite, respectively. Section 3. The City Council does hereby determine and assess each lot and part of lot within ordinance - 2 the described local improvement district as set forth on the assessment roll attached as Exhibit C hereto and incorporated herein by reference. Section 4. The City Council does hereby determine that each parcel of land or lot herein above described is specially benefitted to the extent of the assessment set forth, The Finance Cff cer shall give notice of the assessments to the owners of the assessed parcels advising them the assessment may be paid in full, without interest, within ten days of the effective date of this ordinance. Assessments that remain unpaid after the ten day period are declared to be liens upon the respective lots, parts of lots or parcels of land against which said several amounts are assessed, and may be paid, with interest on the unpaid principal amount commencing ten days after the effective date of this ordinance: 4.1 In up to twenty semi-annual installments, including principal and interest at the rate set by the City Manager as provided in E.C. 2.022 through 2.024. 4.2 If the property owner so elects, in I20 monthly installments, including principal and interest at the rate set by the City Manager as provided in E.C. 2.022 through 2.024 plus a service charge determined by the City Manager as provided in E. C. 2.020. Section 5. The City Recorder is directed to enter in the docket of City Liens a statement in connection with each unpaid assessment containing the following: 5.I A description of each lot, part of lot or acreage specially benefitted by the local improvement; 5.2 The name of the owner or reputed owner thereof, or that the name of the owner is unknown; and 5.3 The sum assessed upon said property, the amount and date from which interest accrues, ordinance - 3 and the date of entering the same in the docket of City Liens, Section 6. Upan enactment of this ordinance, the City Finance Officer shall send notice of the assessments by first class mail to the owners of the assessed parcels containing the information required by E.C. 7.190 and enclose therewith an application for paying the assessment in installments according to the terms set forth in Section 4 of this ordinance, Section 7, Any assessment remaining unpaid and for which no application for installment payments has been received maybe foreclosed as provided by law. The proceeds from the payment or foreclosure of assessments levied by this ordinance shall be deposited to the city funds which advanced the cost of construction, engineering and .related expenses or which are used to retire any indebtedness incurred by the City far this improvement, Section S. That the matters contained herein affect the public welfare and safety and therefore, an emergency is hereby declared to exist, and this ordinance shall become effective immediately upon its passage by the City Council and approval by the Mayor, retention by the Mayor for more than ten days, or re-adoption over a mayoral veto bytwo-thirds of all members of the Council. JOB #3503} CONTRACT 98-02} BACKGROUND This project was included in the City Council's adopted Fiscal Year 1998 Capital Budget, as well as in Lane County's adopted 1998/2002 Capital Improvement Program ~CIP}. The funding identified in Lane County's CIP was intended to offset the new Bethel School street and other road related assessment costs. City Council passed a motion on July ZS, 1997, initiating design, right of way acquisition and bidding per Section 7.1605} and 7.160(7} of the Municipal Code. The Eugene City Council formed the local improvement district SLID} on April 6,1998. The project construction has been completed and final assessment costs have been calculated per Eugene Code provisions. Property owners were notified of the pending assessment hearing ten (10} days prior to the hearing as required by Municipal Code CORRESPONDENCE No written correspondence has been received in response to the Notice of Proposed Assessments. Five property awners have called with questions about the computation of the assessments. In general the questions have been about the unit prices and what area's the costs were distributed against, and whether a deferral program is available. Staff responded to the questions and na adjustments were necessary. Steve Lee, owner of Harvest Ridge Subdivision and multiple properties adj acent to Legacy and a portion of B anger Drive, requested a meeting to review the proposed assessments calculations. Staff met with Mr. Lee and his representatives on February 24,1999 and responded to questions. Findings and Recommendations for FinadAssessment -.Iob 3503 page ,~ PROJECT For the Barger Drive portion of the project, the improvements included completing the south half of the roadway from Terry Street to the just west of Ghio Street and then a full 46-foot width ~ ~ 2-foot travel lanes, a 12-foot center lane and two 5-foot bike lanes} with curbs and gutters, from that point to Greenhill Road. In addition, wastewater and storm drain systems, street lights, street trees, a signalized pedestrian crossing, and continuous sidewalk on the south side of Barger Drive were included in this portion of the project. Properties adjacent to the previously fully improved north half of Barger Drive from Terry Street to just west of Dhio street are not being assessed. Properties outside the City boundaries were not assessed at this time .for storm or wastewater improvements, however, the cost per square foot calculation for each system included an assessable area for those properties. When these properties wish to connect to these systems they will be charged an "equivalent assessment". Additionally, at the time of the LID was formed Lane County had approved in concept the idea of providing funds to defer road assessments for large lots outside the City limits. At this time no funding is available so all these lots are fully assessed for road improvements. The construction of Legacy Street south of Barger Drive includes a 46-foot improvement width ~ ~ ~-foot travel lanes, a 12-foot center lane and two 5-foot bike lanes} with curbs and gutters, sidewalks, street lights, street trees, wastewater and storm drainage systems. In addition, a wastewater pressure main was constructed extending from a new pump station at the southwest corner of the Bethel School site sunder a separate contract}, north along Legacy Street to Barger Drive, east along Barger Drive to Terry Street, and then north along Terry Street to an existing force main near the A-2 Channel. Since the farce main is not be available far direct connection, this portion of the pro ject was not assessable. Finally, a wastewater collection system was extended along the south, east and north boundaries of the Bethel Schools site and ad jacent properties that will be served by that system are included in the wastewater assessment calculation. ASSESSMENT The final project costs are lower than the costs used to calculate the estimated assessment units cost per foot, cost per square foot} at the time of the formation of the LID. Estimated costs provided at the local improvement district formation included lo% contingency and engineering, inspection and administration fees based on a percentage of the construction costs. After the formation of the LID some changes were made to the design to lower construction costs. Actual engineering and inspection fees were included in the final assessment and were substantially lower than the estimated values. The assessable cast listed at the time of the formation of the LID did not include the stormwater and wastewater charges that will be collected later as an "equivalent assessment". Those costs were included in the city costs. The final assessable costs listed below do include the "equivalent assessment" costs. Costs are distributed per City Code 7.175, and as outlined in the Council adopted hearings official minutes, findings and recommendations and resolution forming the LID. Under City of Eugene assessment policy, 29.4°Io percent of the total project improvement costs will be distributed to the abutting property owners with the balance financed by the City. A public hearing regarding the proposed assessment was held an March 1,1999. The minutes of this hearing are attached to these Findings and Recommendations as Exhibit "A." Dne member of the Findings and Recommendations for Final Assessment -~ Job 3543 Page 3 public, Mr. Mel Lemxnon, testified at the hearing. Mr. Lemmon was concerned that the construction had adversely impacted the drainage on his property. Staff have subsequently reviewed the situation and are making the necessary minor adjustments to address this issue. Based upon the information provided by the City Engineer's office and testimony offered at the March 1,1999 public hearing, the Hearings Official finds that the final improvement costs proposed to be assessed are lower than those quoted at the local improvement hearing and are comparable to or lower than projects of similar size. The Hearings Official further finds that the proposed assessments are calculated in accordance with the Eugene Code and that the pro ject is one for which the assessments are for a local improvement asset forth in ORS 310.140 because: ~ 1 } The assessments do not exceed actual costs; ~2} The assessments are imposed for a Capital Improvement Construction Project which provides a specific benefit to a specific property or rectifies the problem caused by a specific property; ~3} The assessments are imposed in a single assessment upon completion of the project; and ~4} The assessments allow the property owners to elect to pay off with interest over at least ten (10}years. Therefore, the Hearings Official recommends that the City Council approve the assessment as calculated and that the Council levy the final assessment. Respectfully submitted, Gar . Broadway, Eugene, Gregon. Hearings official Gary Darnielle presided. A staff presentation was made by Les Lyle, City Engineer. He was assisted by Michelle Cahill, Project Team Manager, and Bud DeSantis, Project Manager. Les Lyle explained that on April 6,1998, the City Council approved the formation of a local improvement district that identified the properties that would be in the final assessment. Mr. Lyle also noted that the City had received previous approval from Lane County to include properties outside of the City limits in the local improvement district. He stated that construction of the project has been completed and that all costs have been included in the calculation of the final assessment. The purpose of the hearing was to consider whether final assessments for project had been correctly calculated. Mr. Lyle explained that the Hearings Official had been provided with a staff memo and a copy of the cost distribution maps that show the project costs, the distribution of assessments to all of the properties as well as how the staff approached the stormwater and wastewater assessments. Mr. Lyle noted that actual final costs and actual engineering costs were used, which produced a net reduction to all properties. Based upon all of the final cost information, the 20 foot equivalent paving width was calculated to be $45.75 per front foot; the sanitary sewer was calculated at $0.1 S per square foot; the storm drainage improvements were calculated at $ 4.36 per square foot and the sidewalk and driveway improvements were calculated at $14.57 per front foot. Mr. Lyle also noted that the staff memo also identified the total assessable cost, the total cost to the city and the total project cost. Mr. Lyle noted that a wastewater force main was incorporated into the project but the pump station was a separate contract. This component extended from the pump station at the southwest corner of the school site up Legacy Street, down B arger Drive and then up Terry Street. Mr. Lyle explained that the same area approach, measuring 160 feet from the line that was constructed, was used in the distribution of costs for the stormwater and wastewater improvements. The shaded areas on the assessable area map represented the assessable area for stormwater improvements and the dotted line represented the assessable area for the wastewater improvements. Mr. Lyle explained that the lot line configuration of the properties at the time of the formation of the local improvement district was also considered. There had been some partitioning March 1,1999 PublicNearingMinutes -Job #3503 Page2o~f2 and subdividing in intervening months and for those properties that were predominantly vacant, the assessable area went back the full 16o feet in depth verses using the new lot line. Thus, incase of the Harvest Ridge Subdivision, the assessable area goes beyond the lot lines because the plat came in after the .local improvement district was formed. Mr. Lyle stated that paving, wastewater, storm drainage and sidewalkldrivewaycnsts were estimated at the time the district was formed. He pointed out that the final assessable costs were less than these estimates. Mr. Lyle also explained that at the time of the formation, the total estimated assessable costs were less than that calculated for the final assessment because the former did not include the properties' non-assessable share of wastewater and stormwater costs for properties located outside of the City. Mr. Lyle noted that all properties qualified for to-year financing and that property owners could choose either semi-annual or monthly installment payments. Additional information regarding this program would be made available after the Council takes final action on the assessments. The Cauncil is slated to take action on March 15,1999. Mr. Lyle noted that at the time of formation, it was suggested that Lane County might fund a deferral program for the street-related improvements for properties located outside of the City. The County Commissioners, however, have chosen not to make this program available at this time. The City has no mechanism to support a deferral program for these properties. Mr. Darnielle opened the hearing to the testimony from the public. Mr. Mel Lemmon, owner of tax lots 70o and 840, testified that his major concern was regarding farm deferral for a portion of his property. He noted that this property had been farmed since before the turn of the century. Mr. Lemon also explained that there is a problem with standing water on his property since the construction of the improvements had been completed. It was unclear whether a drainage outlet had been plugged but there had never been a drainage problem of this magnitude before, even during times of heavy rains. Staff indicated that they would go out and see what could be dfone to eleviate the problem. There being no other testimony, Mr. Darnielle closed the public hearing at 6:25 p.m ar . During the LID formation, it was mentioned that Lane County Commissioners had conceptually approved a deferral program for properties outside the City far the street assessment elements of the proposed assessments. It s®em3s that everything had been decided ahead of time, so why have hearings? Therefor®, I've decided to writ® instead of att®nding the scheduled March I.S, 1999 hearing, knowing that what is said would gv in one ear and out the other. Since this fs a fenced and gated community of manufactured homes, the assessment should have gene to Sumrnerfield Estates and not to a eel®ct few who happen to five closer to Barger Dr.. Dur address is not Barg®r. you assess®d same of Barger, a piece an each end of the eight residental pieces, to 5ummerfield, sa why nat all of it? It makes no sense whatever, Haw unfair can it be to haue to pay far something that one can't see, use or have. access ta? There's no benefit tv us ~~~ what®ver.
