AN ORDINANCE VACATING A PUBLIC EASEMENT FOR
BIKE PATH PURPOSES ON THE SOUTH SIDE OF RIVER
ISLAND ESTATES.
The City Council of the City of Eugene finds that:
Gn the 15th day of March, 1999, the City Council of the City of Eugene by Motion duly
passed, called a public hearing to be held at 7:30 p.m., Pacif c Time on the 26th day of April,1999
at the Council Chambers at City Hall, Eugene, Gregon, at which time and place protests and
remonstrances could be heard as to the proposed Council initiated vacation, with the consent of the
abutting property owners, of the following described public easement for bike path purposes:
The 15-foot wide public bike path easement located on the south side
of River Island Estates, a residential development, which is situated
between the Willamette River and Goodpasture Island Road, Tax
Lots 100 and 1 O 1, Assessor's Map 17-04-24-13, as more particularly
described in Exhibit A hereto. City of Eugene: River Island Estates,
EV 995}.
RETAINING herein the public emergency vehicle access easement
across the above described property.
THE CITY OF EUGENE DOES ORDAIN AS FOLLOWS:
Section 1. The City Council of the City of Eugene finds that due and regular notice of the
hearing was published and posted as by law required, and no valid objections were made at the
heaving or filed. The proposed vacation will not substantially affect the market value of the property
abutting the above-described easement and the public interest will not be prejudiced by the vacation
of the public easement for bike path purposes. The hearing was held on the 26th day of April,1999,
at 5:30 p.m., Pacific Time, at the Council Chambers, City Hall, Eugene, Lane County, Gregon, and
all matters necessary to be done in the premises have been duly and regularly completed.
Section 2. The herein above-described public easement for bike path purposes is hereby

vacated, and the easement so vacated sha11 revert to private ownership pursuant to Oregon Revised
Statutes, sub j ect to the retained public emergency vehicle access easement.
Section 3. The City Recorder is hereby requested to file a certified copy of this ordinance
with the Recorder of Lane Caunty, aregon, together with a map or plat of said property, and a
certified copy of this Ordinance shall be Bled with the Lane County Assessor and another certified
copy shall be filed with the Lane County Surveyor.

Vacation of a 15 foot wide Public Easement lying in the northeast quarter of Section ~4,
Township 17 South, Range 4 West of the'Willamette Meridian, all in Eugene, Lane County,
Oregon, said Public Easement being dedicated on the plat of River Island Estates Phase One, as
platted and recorded in File 73, Slide 508 and on the plat of River Island Estates Phase Two, as
platted and recorded in File 73, Slide 533 Lane County Plat Records, in Lane County Oregon,
said Public Easement being more generally described as running parallel to, and I S feet north
and west of the following described line:
Beginning at the most southwesterly corner of the afore mentioned River Island Estates Phase
One; thence in an easterly direction along the southerly boundary of said River Island Estates
Phase One to the boundary line common to said River Island Estates Phase One and River Island
Estates Phase Two; thence continuing in an easterly direction along the southerly boundary of
said River Island Estates Phase Two, to the most southeasterly corner of said River Island Estates
Phase Two; thence northerly along the easterly boundary of said River Island Phase Two, to the
northeast corner of said River Island Estates Phase Two.
Vacation area contains 9825 square feet, more or less.
EXHIBIT A
