ADMINISTRATIVE ORDER NO. 44-94-03
of the
City Manager of the City of Eugene
Approving and Adopting
The United States Conference of Mayors (USCM)
Deferred Compensation Program
The City Manager of the City of Eugene finds that:
A. The City Council of the City of Eugene has previously determined that the
establishment of a Deferred Compensation Plan for its employees was beneficial for the
City, and authorized the City Manager to enter into such contracts or agreements as
necessary to implement such a program.
B. The United States Conference of Mayors (USCM) has established a master
prototype deferred compensation program for cities and political subdivisions that permits
its member cities and their employees to enjoy the advantages of this program, at no cost
to the City. It would be in the best interests of the City's employees to add this additional
deferred compensation carrier to the City's two currently established deferred compensation
carriers.
C. The USCM, as Plan Administrator, agrees to hold harmless and indemnify the
City, its appointed and elected officers and participating employees from any loss resulting
from the USCM's or its agent's failure to perform its duties and services pursuant to the
USCM program.
Now, therefore, based upon the above findings,
The City Manager of the City of Eugene orders that:
1. The U. S. Conference of Mayors Deferred Compensation Program and its
attendant investment options are hereby adopted, and added as an additional Deferred
Compensation Plan for the voluntary participation of all eligible City of Eugene employees.
2. Except as such authority is delegated in writing, the City Manager shall execute
for the City, individual participation agreements with each employee requesting the same,
act as Administrator of the Plan representing the City, and execute such agreements and
contracts as are necessary to implement the Program.
3. Except for incidental expenses of collecting and disbursing the employee's
deferrals, and other minor administrative matters, the City shall incur no other costs for
implementation of this Program.
