HomeMy WebLinkAboutAdmin Order 44-96-03-F ADMINISTRATIVE ORDER NO. 44-96-03-F of the City Manager Pro T em of the City of Eugene ESTABLISHING A FEE FOR LATE PAYMENTS ON SYSTEMS DEVELOPMENT CHARGE ACCOUNTS The City Manager Pro Tem of the City of Eugene finds as follows: A. Section 2.020 of the Eugene Code 1971, authorizes the City Manager to determine and set fees and charges to be imposed by the City for services, goods, use of municipal property, and licenses and permits. B. In accordance with the procedures set forth therein, on Apri I 1, 1996 I issued Administrative Order No. 44-96-03, and on April5, 1996 I notified the Mayor and City Councilors that I intended to establish a late fee of $5 or five percent (5%), whichever is greater, on monthly or semi-annual installments for Systems Development Charge accounts which are paid 10 days or more after the due date, as set forth in the Notice of Intended Fee attached as Exhibit A thereto and incorporated therein by reference. C. The Notice was also posted at two locations at City Hall, and made available for inspection by interested persons at the offices of the City's Administrative Services Director, Aster Building, 860 West Park Street, Suite 300, Eugene, Oregon 97401. The Notice provided that written comments would be received thereon for a period of 15 days from the first date of posting. No comments were received within the time or in the manner required by the Notice. D. I find that the fee set forth herein is consistent with applicable policies and directives of the City Council, the amount charged by other comparable businesses for such services, and is necessary in order to recover the costs incurred by the City in processing and maintaining Systems Development Charge accounts paid in monthly or semi-annual installments. On the basis of these findings, I order that: A late fee of $5.00 or five percent (5%), whichever is greater, is hereby established for monthly or semi-annual installments for Systems Development Charge accounts which are paid ten days or more after the due date.
