ADMINISTRATIVE ORDER NO. 44-96-06-F
of the
City Manager Pro Tern of the City of Eugene
ESTABLISHING FEES FOR SEGREGATION OF
ASSESSMENTS AND SYSTEMS DEVELOPMENT CHARGES
The City Manager Pro Tern of the City of Eugene finds as follows:
A. Section 2.020 of the Eugene Code, 1971 authorizes the City Manager to determine
and set fees and charges to be imposed by the City for services, goods, use of municipal property,
and licenses and permits.
B. In accordance with the provisions set forth therein, on June 17, 1996 I issued
Administrative Order No. 44-96-06 proposing to increase the currently established $25.00 fee for
processing applications for segregation of assessments and systems development charges to
$65.00, as set forth in the Notice of Intended Fees attached as Exhibit A thereto and incorporated
therein by reference.
C. Copies of the Notice were provided to the Mayor and City Council, posted at two
locations at City Hall on June 20, 1996, and made available for inspection by interested persons
at the offices of the City's Administrative Services Director, Aster Building, 860 West Park, Suite
300, Eugene, Oregon 97401 during normal business hours (8:00 a.m. to 5 :00 p.m., Monday
through Friday, exclusive of holidays). The notice provided that written comments could be
submitted thereon for a period of 15 days from the date of posting. No comments were received
within the time or in the manner required by the notice.
D. I find that the fee increase as proposed in Administrative Order No. 44-96-06 is
consistent with applicable policies and directives of the City Council, including policies developed
through the Eugene Decisions process, is comparable to the fee established in other jurisdictions
for processing such applications, and is necessary in order to recover the City's costs incurred in
processing such applications from the beneficiaries thereof.
On the basis of these findings, I order that:
1. As of the effective date of this Order, the fee for processing applications for
segregation of assessments and systems development charges shall be $65.00.
2. Any order in conflict herewith is hereby repealed.
