AN ORDINANCE AUTHORIZING THE INSTITUTION of
PROCEEDINGS IN EMINENT DOMAIN FOR THE ACQUISI-
TION BY CONDEMNATION OF PROPERTY INTERESTS IN
OR ADJACENT To THE RIVERFRONT RESEARCH PARK
FOR THE PURPOSES OF CONSTRUCTION of STREET
IMPROVEMENTS, CONSTRUCTION of OTHER PUBLIC
FACILITIES, AND DEVELOPMENT OR REDEVELOPMENT;
AND DECLARING AN EMERGENCY.
The City Council of the City of Eugene finds that:
The City Council has authority under provisions of the City
Charter and applicable state law to institute proceedings in
eminent domain for the acquisition by condemnation of private
property for public purposes, including the improvement of city
streets and construction of curbs, gutters, sidewalks and other
features, and including acquisition for construction of other
public facilities and for development or redevelopment.
The development of the Riverfront Research Park is a
cooperative intergovernmental effort between the City of Eugene,
the Urban Renewal Agency of the City of Eugene, and the University
of Oregon.
In furtherance of the cooperative intergovenmental effort:
~a} The City of Eugene on September 11, 1955, and upon
the recommendation of the Urban Renewal Agency of the City of
Eugene, enacted Ordinance No. 19352 adopting the Urban Renewal
Plan for the Riverfront Research Park Plan} and further
implemented the Plan by enactment of ordinance No. 19470
establishing the Riverfront Park Special Development District;
and
fib} The University of Oregon developed a Master Plan and
Ordinance - 1
Design Guidelines for the Riverfront Research Park Master
Plank which was adopted by the President of the University of
Oregon on November 29, 1988.
The City of Eugene and the cooperating agencies are in the
process of developing the Riverfront Research Park Park} pursuant
to the Plan, which requires street improvements including access
to the Park consisting of paving, curbs, gutters, sidewalks and
street lights, sanitary and storm sewer improvements, and the
development and redevelopment of property within the Park in
conformance with the Plan and the Master Plan.
The proposed street improvements are to be in compliance with
plans and specifications prepared by the City Engineer in
accordance with provisions of Chapter 7 of the Eugene Code, 1971
and applicable policies of the City of Eugene. The development of
ether public facilities and other facilities shall conform to
building and land use regulations, and the Plan.
The costs of delaying some parts of the street improvement
project, the savings from efficient construction management
techniques, the need to facilitate the safe and efficient movement
of traffic, and the need for public facilities may require the City
to act promptly to acquire possession of the necessary property
interests far certain street improvements and other public
facilities. Now, therefore,

section 1. Based upon the above findings, which are
incorporated herein by reference and hereby adopted, the City
Council of the City of Eugene does hereby find, declare, and

determine it necessary to acquire certain ownership in fee
interests to the parcels of real property more articularl

described on Exhibit A attached hereto and incorporated herein b

reference in order to construct the street improvements, public
facilities, development and redevelopment contemplated in the Plan.
This may include but is not limited to the Cit transferrin

ownership of some parts of the property to be acquired to other
public or private entities to accomplish the public purposes of the
Plan.
Section 2. The City Council does hereby direct that the Cit

of Eugene shall institute proceedings in eminent domain for the
condemnation of the real property interests described in Section
1, and, at least 20 days prior to the filing of any action for
condemnation to make a written offer to the owners yr parties
having an interest therein of a stated amount as com ensation

therefor and for any compensable damages to remaining propert

Section 3. The City Council further directs that the Cit of
Y
Eugene shall obtain immediate possession of the real propert
Y
interests described in Section 1 if negotiations will dela the
Y
construction of the described improvements and facilities or Bela

the contemplated development or redevelopment.
Section 4. The City Council hereby declares that the
improvements above set forth are for a public ur ose are

necessary for the public welfare, and are authorized under the laws
of the State of oregvn and Charter and ordinances of the Cit of
Y
Eugene.
Section 5. The City Council further declares that the real
ordinance -- 3
property interests described in Section 1 shall be used by the City
of Eugene fvr public purposes at the earliest passible date and,
in any event, no later than ten years from the date this ordinance
is adapted by the Council and approved by the Mayor.
Section 6. The improvement of City streets and reduction of
traffic hazards thereon and the implementation of the Plan concern
the public welfare and safety and therefore, an emergency is hereb

declared to exist, and this ordinance shall become effective
immediately upon its passage by the City Council and a royal b
