I ~ ~0~3 AN ORDINANCE PROVIDING FoR WITHDRAWAL FROM THE GLENWOOD WATER DISTRICT AND WILLAMALANE PARK AND RECREATION DISTRICT THAT PART of THE DISTRICTS ANNEXED To THE CITY OF EUGENE BY THE LANE COUNTY LOCAL GOVERNMENT BOUNDARY COMMISSION ON SEPTEMBER 27~ 1989 ~oREG4N FREIGHTWAYS, EC EU 89-2 6 y . The City Council of the City of Eugene by Resolution No. 4157 adopted January 22, 1990, proposed withdrawal from the Glenwood Water District and the Willamalane Park and Recreation District that part of the Districts annexed to the City on September 27, 1989 by the Lane County Local Government Boundary Commission, as hereinafter described. The Resolution set February 12, 199q, at 7:30 p.m., Pacific Time, in the Council Chambers, City Hall, in Eugene, Gregor, as the time and place for hearing objections to the withdrawal, and directed that notice of the time and place of the hearing be published once each week for two consecutive weeks prior to the hearing and be posted in four public places in the City for the same period. The Notice has been so published in the Register Guard and posted in four public places in the City of Eugene, Oregon.. The City is willing to assume the liabilities and indebtednesses previously contracted by the Districts proportionate to the part of the Districts that have been annexed to the City upon the effective date of the withdrawal . The withdrawal of the annexed territory from the Crdinance - l Districts is consistent with the fundamental principles and applicable policies of the Eugene-Springfield Metropolitan Area General Plan, and other adopted City policies, and it is in the best interest of the City that the territory be withdrawn. NoW, THEREFgRE, THE CITY of EUGENE DgES gRDAIN AS F~LLgWS: Section 1. The territory in Lane County, Oregon, annexed to the City of Eugene on September 27, 1989, as bounded and described as follows: A parcel of land located in the Glenwood area at the corner of Glenwood Boulevard and l7th Avenue, T17S, R3W, 534, Map 34, Parcel 440, as more particularly described qn Exhibit "A", attached hereto and incorporated herein by reference ~oregon Freightways, EC EU 89-2G~. is hereby withdrawn from the Glenwood Water District and Willamalane Park and Recreation District, effective July 1, 1990. Section 2. The City Recorder is requested to forward a copy of this ordinance to each of the above referred to Districts. Passed by the City Council this Approved by the Mayor this 12th day of February, 1990 12th day f February, 1990 ~~ City Rec der ayor Qrdinance - 2 r ,: t~ , EXHIBIT A That portion of the following described parcel of land that lies East of Glenwood Boulevard and South of 17th Avenue East: Beginning at a point 32x.7 feet North 82° 43' East of a point 2$.7 feet South of the Northeast corner of the Zara Sweet Donation Land~Claim No. 68 in Township 17 South of Range 3 west of the Willamette Meridian, and running thence South 1983.9 feet; thence North $Z° 4' East 12.5 feet; thence North 36° 51'East 275.5 feet; thence North $7° East 165 feet; thence North 1797 feet to the Pacific Highway, and thence South 32° 43' West 345.2 feet to the place of beginning, in Lane County, Oregon. EXCEPTING THEREFORM the follwing described land, to wit: Beginning at a point in the Southerly line of the Pacific Highway North 82° 43' East 415.4 feet from a point 28.7 feet South of the Northeast corner of the Zara Sweet Donation Land Claim No. 68 in Township 17 South of Range 3 West of the Willamette Meridian, and running thence South 161.6 feet; thence East 248 feet; thence North 193.2 feet to the Southerly line of the highway; - thence South 82° 43' West along the Southerly line of said highway 25o feet to the place of beginning, all in Lane County, Oregon.
