HomeMy WebLinkAboutOrdinance No. 19683 ORDINANCE N0. -~ ~b g AN ORDINANCE LEVYING ASSESSMENTS FUR PAVING, STORM AND SANITARY SEWERS IN CRENSHAw STREET FRUM DEBRICk ROAD TO 1900-FEET TO APPROxIMATELY THE TOP OF GILEESPIE BUTTE The City Council of the City of Eugene finds that: On the 1st day of March, 1989, as authorized in the Eugene Code ?.160~8~ the City Engineer initiated the proposed local improvement consisting of paving, storm and sanitary sewers in Crenshaw Street from Debrick Road to I9o0-feet to approximately the top of Gillespie Butte. After due notice and a public hearing the~ean before the hearing official, and na remonstrances having been filed, on the 14th day of August, I989, the City Council farmed the local improvement district and authorized construction of the local improvement. The actual cost of the local improvement is ascertained to be $219,102.41 and the amounts to be assessed to be borne by the City ar others has been determined in accordance with applicable provisions of the Eugene Code, 1911 and as set forth in. Items 1 to 13 from Page 1 an Exhibit A attached hereto and incorporated herein by reference. The City Council has established the method of calculating local im- provement assessments in Sections 1.110 and 1.115 of the Eugene Code, 1911. A notice containing the information reguired by Section 7.185 of the Eugene Code, 1971 has been posted on a bulletin board at City Hall and given by certified mail to the owners of the parcels of real property subject to the assessment more than ten days prior to the public hearing before the hearing ORDINANCE - ] official. ~t the time and place specified therein, a hearings official heard all evidence and argument presented, has fully considered the same, and no remonstrances having been filed, has reported his or her adopted findings to the City Council, . The Council has reviewed and considered the assessment report of the City Engineer and Finance officer and the hearings official's findings and summary of the hearing, and based thereon, THE CITY OF EUGENE DOES aRDAIN AS FOLLQwS: Section 1. The Summary of the hearing conducted by the hearings official are hereby made a part of the Council's record in these proceedings, and the hearings official's findings, including those regarding compliance with Sections 1.160 to 1.190 of the Eugene Code, 1971, attached hereto as Exhibit Band incorporated herein by reference, are hereby adopted. Section 2. The actual cost of the local improvement comprising paving, storm and sanitary sewers in Crenshaw Street from Debrick Road to 1900-feet to approximately the top of Gillespie Butte is $219,10.41 which is hereby assessed against the parcels of property hereinafter described in the amounts set apposite, respectively. Section 3. The City Council does hereby determine and assess each lot and part of lot being within the described 1oca1 improvement district as set forth on the assessment roll attached as Exhibit C hereto and incorporated herein by reference. Section 4. The City Council does hereby determine that each parcel of land or lot herei nabove described i s specially benef i tted to the extent of the assessment set forth. The Finance Officer shall give notice of the assess meets to the owners of the assessed parcels advising them the assessment may ORDINANCE ~ ~~~ be paid in fu11, without interest, within ten days of the date of adoption of this ordinance. Assessments that remain unpaid after the ten day period are declared to be 1 i ens upon the respective 1 ats, parts of lots or parcels of 1 and against which said several amounts are assessed, and may be paid i n up to twenty semi-installments, including principal and interest at the rate set by the City Manager as provided in Section 2.022 thru 2.024 of the Eugene Code. The City Retarder is directed to enter in the docket of City Liens a statement in connection with each unpaid assessment Containing the following: 4.1 A description of each lot, part of lot or acreage specially . benefitted by the local improvement; ~.2 The name of the owner or reputed owner thereof, that the name of the owner is unknown; and 4.3 The sum assessed upon said property, the amount and date from which interest accrues, and the date of entering the same in the docket of City Liens. Section 5. Upon enactment of this ordinance, the City Finance Officer shall send notice of the assessments by first class to the owners of the assessed parcels containing the information required by Section 7.I94 of the Eugene Code, 191I, and enclose therewith an application for paying the assessment in installments according to the terms set forth in Section 4 of this ordinance. FINDINGS AND RECOMMENDATI4N5 .SUBJECT: PAVING, STQRM AND SANITARY SEWERS IN CRENSHAw RUAD FRAM DEBRICK RQAD, 194 FEET TQ APPRQXIMATELY THE TQP QF GILLESPIE BUTTE ~CUNTRACT 59.29} BACKGRGUND This project was initiated by a petition received January 5, 1989, from property owners along Crenshaw Road from Debrick Road,19DD feet to approximately the top of Gillespie Butte. Based on the petition, the City Engineer initiated the project, as provided far in the Eugene Cade 7.1~0~8}, on March 1,1989. Property owners were ,notified of the pending award hearing l0 days prior to the award hearing. The project was authorized for construction by the City Council on August 14, 1989. The law bid was submitted by Wildish Corvallis Construction Co., for an amount of $159,798.00. 4n March 21, 1990, the Engineering Department received a phone call from Audrey Thorne. Ms. Thorne stated she no longer owned the parcel of land being assessed on the corner of Debrick and Crenshaw tax lot #17-D3-19-42-42900 parcel 1}. City staff has reviewed the records and the new property owners ~K & D investment Group, inc.} have been notified and have stated they will not attend the hearing. PROJECT The project improvements includes 24 and 28-foot paving, curbs, gutters, storm and sanitary sewers. ASSESSMENT Under City of Eugene assessment policy, much of the costs are assessed to the abutting property owners. Staff recommends appropriation of the assessment distribution. - A hearing was scheduled for the above matter for March 26,1g9~, at 7;~~ p.m. Since no persons indicated an interest in attending the hearing it was cancelled. The Hearings Official received a Memorandum from the City Engineer, outlining the above information. The Hearings Official recommends that the City Council adopt an ordinance approving the assessment distribution as set forth above. ~ r: ~~~ Jack A.
