An Ordinance vacating the following described street and
alley, to-wit:
Those portions of the street and alley in and adjacent
to Block 5 of the ORIGINAL PLAT GF EUGENE CITY, as
recorded on Page 2 of Docket A, Lane County Oregon Plat
Records, described as follows:
PARCEL 1: All that portion of East 4th Avenue lying
Southerly and contiguous to Lot 4 and Easterly from the
Easterly right-of-way line of Ferry Street extended.
PARCEL 2: The entire East-West alley lying between Lvts
2 and 3.
RESERVING HEREIN an easement for public access to the
"River Edge Public Playa" upon and across the above
described parcels, and the right to install, maintain and
repair any and all public utilities thereon. ~EWEB SV 59-

4n the 12th day of February, 1990, the City Council of the
City of Eugene by Motion duly passed, called a public hearin to

be held at 7:30 p.m., Pacific Time on the 12th day of March, 1990
at the Council Chambers at City Hall, Eugene, Oregon, at which time
and place protests and remonstrances could be heard as to the
proposed vacation of the above described street and alley. At the
time of the regularly scheduled hearing on March 12 1990 the

Council postponed the hearing to July 9, 1990.
Notice was duly and regularly given of the postponed hearin

and at said time and place the Council heard all objections to the
prapased vacation.
All persons owning property abutting the street and alle to

be vacated have consented to the vacation and applied for the same .
THE CITY of EUGENE DDES ORDAIN A5 FCLLO'~S:
Section i. The City Council of the City of Eugene finds that
ordinance - 1
due and regular notice of the hearing was published and posted as
by law required and no valid objections have been made at the
hearing or filed. The consent of the owners of the abuttin

property has been duly and regularly filed in the proceedings and
the public interest will not be prejudiced by the vacation of the
street and alley.
Section 2. The hearing was held on the 9th day of July, 1990
at 7:30 p.m., Pacific Time, at the Council Chambers, City Hall,
Eugene, Lane County, Oregon, and all matters necessary to be done
in the premises have been duly and regularly completed,
Section 3. The hereinabove described street and alley are
hereby vacated, and the street and alley so vacated shall revert
pursuant to the statutes of the State of Oregan.
Section 4. The City Recorder is hereby directed to file a
certified copy of this Ordinance with the Recorder of Lane Count ,
Y
Oregon, together with a map or plat of said property, and a
certified copy of this Ordinance shall be filed with the Lane
County Assessor and another certified copy shall be filed with the
Lane County Surveyor.
