AN ORDINANCE CONCERNING SIGNS; REQUIRING PERMITS, AND REGULATING
THE SIZE AND NUMBER OF SIGNS; ADDING SECTIONS 9.1O0o, 9.100,
9.1004, 9.1006, 9.1008, 9.1010, 9.1014, 9.1016, 9.1020, 9.1030,
9.1031, 9.1033, 9,1035, 9.1037, 9.1039, 9.1041, 9.1043, AND
9.1050 TO THE EUGENE CODE, 1911; AMENDING SECTIONS 9.015, 9.734,
9.136, 9.138, AND 9,140 OF THAT CODE; RENUMBERING SECTIONS
9,830 TO 9.990 OF THAT CODE; REPEALING SECTIONS 8.610 TO 8.855
OF TNAT CODE; AND DECLARING AN EMERGENCY.
THE CITY OF EUGENE DOES ORDAIN AS FOLLOI~S:
Section 1. Section 9.015 of the Eugene Code, 1971, is amended by amend-
ing the definitions of "Development site" and "Grade" contained therein, and
adding the following i n alphabetical order therein, to provide:
9.015 Definitions.
. Abandoned si n. A sign structure not containing a sign for
90 continuous days or a sign which is no longer being used.
Awning. For purposes of the Eugene sign code, a shelter com-
posed partially or. totally of non-rigid materials, which is
supported entirely from the exterior wal] of a building and which
was not apart of the original construction of the building.
Awning _sign. A sign painted or printed on, or attached flat
against, the surface of an awning.
Banner. A sign made of any non-rigid material which is nat
contained by an enclosing framework and i s allowed some freedom of
movement. Banner includes, but is not limited to, banners,
streamers, pennants and flags.
Bi 11 board . Any sign, however otherwise characterized, which
has a sign face of X00 square feet or greater in surface area.
Busness,,,,vccupant. Anon-residential use of a development
site by an owner or lessee. Each user shall be considered a separw
ate business occupant if the user has an independent or distinct
property right in the development site.
Clearance,,„sign. The distance between the lowest portion of a
sign and the finished surface of the ground, paving, or sidewalk
under the sign,
Development site. A tract of 1 and under common ownership or
control, either undivided or consisting of two or more contiguous
1 ots of record. For purposes of the Eugene sign code, a parcel
divided by a street or alley shall be considered two development
sites.
Electric sign. Any sign containing electrical wiring.
E~i ectron i s message ce_nter,. A s i gn, or portion of a s i gn,
which conveys information ~~through a periodic automatic change of
message on a 1 ampbank, through the use of fiber optics, or through

mechanical means. A sign on which any portion less than an entire
sign element rotates shall be considerd an electronic message
center.
Eu ene si n code. Sections 9.1000 to 9.1050 of the Eugene
Code, 1971, and any administrative regulations issued thereunder.
Flab. The official flag or banner of any governmental entity.
Flashing sign . A s i gn ar sign structure where some part of
the d i spy ay i s provided by 1 i ght emitting elements which abruptl y
change color or intensity of illumination, including intermittent
periods of illumination and non-illumination, or where the effect
of flashing is achieved through mechanical means, including rota-
tion.
Freestanding sign. A sign other than a billboard supported
by a structure that i s anchored i n the ground and that i s i ndepen-
dent from any ether structure.
Grade ad 'acent round elevation . The 1 awest paint of el eva-
tion of the finished surface of the ground, paving, or sidewalk
within an area between the bui 1 di ng and the property 1 i ne or, when
the property line is more than five feet from the building, between
the building and a line five feet from the building. See Figure 1.}
For purposes of the Eugene sign code, grade shall be measured
as i f a1 l port i an s of a s i gn were projected vertically onto the
ground and the grade was measured by using such pro jecti ans as a
building wall. Far all signs, grade shall be measured according
to the laver of the existing grade prior to construction ar the
newly established grade after construction, exclusive of any f i 11-
ing, berming, mounding ar excavating solely far the purpose of
locating the sign. See figure 13.E
Hand carried si n. A sign which is displayed and used while
being carried by a person and which i s not usually used by being
placed on the ground or on a structure.
Height, sign. The vertical distance from the "Grade" to the
highest point of ~a sign or sign structure. All sign heights, in-
cluding roof signs, shall be measured from the "Grade".
~ 11 a a1 s i n . Any sign constructed without compliance with
al 1 appl i cab1 e 1 aws and regulations.
Mar~guee. Any permanent roof-1 ike structure, other than an
awning , projecting beyond a bu i 1 d i ng and generally designed and
constructed to provide protection from the weather.
Marquee sign . A s i gn on or above a marquee and attached onl y
to a marquee. Marquee signs do not include under-marquee signs.
Mural. A painted decoration on a surface other than a sign
face which serves an exci us i eel y decarat i ve purpose and which does
not depict any product ar service provided on the level opment site
where the mural is located.
Nanconfarmin si n. Any sign 1 awful ly constructed and mai n-
ta i ned, but which i s no 1 onger i n compliance with the Eugene sign
code, and which i s not exempt from the permit requirements of the
Eugene sign code.
ari entati on s i n . The orientation of a s i gn shall be the
direction the sign faces from which the sign copy is designed to be
seen and i s most eas i 1 y visible . A s i gn face parallel to a street
and not oriented toward another direction of travel shall be con-

s i tiered to be oriented toward both directions of travel along the
street.
Perimeter wall . The exterior wall of a bui 1 di ng.
Portable sign. A sign placed in one location which is not
permanently connected to the ground or a structure, or carried or
moved during display. Portable signs inc1 ude, but are not 1 imi ted
to: signs designed to be transported by means of wheels, signs con-
verted to A- or T-frames, menu and sandwich board signs, and signs
attached to or painted on parked vehicles. Hand carried signs are
not portable signs.
Projecting sign. A sign other than a wall sign which projects
from and i s supported by a wall of a bui 1 di ng or structure.
Readerboard sign . A s i gn wi th a s i gn face of 1 ess than 2D0
square feet, or a part i an of any such sign on which characters,
1 etters or i 11 ustrati ons can be changed or rearranged manually wi th-
out otherwise altering the surface of the sign .
Roof s i n . A s i gn constructed upon or above a roof or parapet
of a structure.
Shopping center. As used in the Eugene sign code, a develop-
ment site with at least 5o,DD4 square feet of gross floor area and
with two or more business occupants engaged i n retai 1 trade.
Si n. Any device, fixture, placard, or structure which is not
entirely within an enclosed building, when its message is visible
from a public or private right-of-way or another development site,
and which uses any color, form, graphic, i 11 umi nati on, symbol , or
writing to advertise or to communicate information of any kind.
For purposes of the Eugene sign code, searchlights, beacons,
strings of lights, banners, flags, pennants, and inflated devices
shall be considered signs.
Sign construction. The act of building, erecting or otherwise
pl ac i ng a s i gn i n use, including any work done on an existing sign
other than sign maintenance.
Sign contrac,t,or. A person engaged in the business of sign con-
struction ar sign maintenance required to be registered by the
Oregon Construction Contractors Board.
Si n direction. The direction a sign or sign element faces
including all directions in which the display copy is visible.
Sign element. That portion of a sign wholly contained within
a separating sign trim or atherwi se present i ng a set f -defined unit.
Si n face. The functional surface of a sign including all
sign elements facing in the same direction.
Si n maintenance, Work to preserve and use a sign, including
manual changes in the display copy on signs designed and intended
for such changes. Sign maintenance includes repairs to damaged
signs unless the cost of the repair exceeds 5o percent of the value
of the sign during the mast recent period of use before repairs are
to be initiated.
Sign structure. Any materials used to support or contain a
sign, but not i nc1 ud i ng bui 1 d i ngs or other structures constructed
primarily for purposes other than sign support.
Sign surface area. The total area of each sign face.
Theater. A ~~bui 1 di ng used for public presentations of enter-
tainment or cultural events,

Traffic control device . Any sign, signal or other device con -
structed by a road authority, as defined by state 1 aw, for the pur-
pose of vehicular ar pedestrian traffic control .
Trim. The mot di ngs, batten, capping, nai 1 i ng strips, 1 atti c-
i ng and pl atfarms which are attached to a s i gn .
U.S.C, signs. The 1985 Edition of the Uniform Sign Code as
published and copyrighted in 1985 by the International Conference
of Building Officials,
Wall s i n . Any sign, except murals, painted upon or attached
to the wal 1 of a bui 1 di ng which does not project more than 12 inches
from the surface of the wall. Signs placed on or attached to a
mansard roof are considered wall signs provided they do not project
or extend above the roof 1 ine.
Under-mar uee s i n. A s i gn which i s attached and y to a mar-
quee and which i s suspended or projects downward from a marquee and
has no portion of the sign above the bottom surface of the marquee
structure.
Section 2. Sections 9.734, 9.136 and 9.135 of the Eugene Code, 1911,
are amended to provide:
9.134 Buildin Official Authorit .
~1} The building official may grant variances to the regulations
prescribed by this ordinance with respect to fences and walls, site area,
width, frontage, depth, coverage, distance between structures, and off-street
parking foci 1 i ti es i n accordance with the procedures prescribed i n sections
9.132 to 9.14fi.
~ 2 } The bui 1 di ng official may grant variances to the regulations
prescribed i n the Eugene sign code according to the procedures prescribed i n
sections 9.132 to 9.146, except that the bui 1 di ng official may not grant vari -
ances based on the canven i ence of the applicant, including any hardship of
regional or national businesses which wish to use a standard sign when those
do not conform to the provisions of the sign code.
9.736 Variance Application.
~ 1 } An application and related information shall be submitted by
the applicant i n the manner prescribed by the city, together with the fee
set by the city manager pursuant to section 2.020 of this code.
~2} A person may not apply for a variance to allow a sign for
which there has been an application for the same or a substantially similar
sign on the same development site which has been denied within the preceding
year.
9.738 Notice. Within ten days of receipt of a complete and accurate
application, and at 1 east ten days before the bui 1 di ng official
makes a deci si on, the city shall mai 1 notice of the request to abutting
property owners and occupants, including properties that would be abutting
were i t not for intervening streets or al 1 eys .

Section 3. Subsection ~1} of Section 9.740 of the Eugene Cade, 1911,
is hereby amended, and a new Subsection ~5} added thereto, to provide:
9.140 Building Official Decision.

bui 1 di ng off i c~ al shall approve, condo t~ anal ly approve, or deny a vary ance,
w~ th f ~ nd~ ngs and conclusions thereon, within 30 days of receipt of a com-
plete and accurate application. The building official's decision shall be
based vn the following criteria:
.~a} Strict or literal interpretation and enforcement of the
specs f ~ ed regul at ~ on would result i n practical difficulty or un-
necessary physical hardship inconsistent with the ab ject i ves of
the zone ng ordinance. A practi cal difficulty or unnecessary phy-
s~cal hardship may result from the size, shape, or dimensions of a
s ~ te, from geograph ~ c, ,topographic, ar other physical conditions
on the site or ~ n the ~mmedi ate vicinity, or from street locations
or traffic conditions in the immediate vicinity.
. fib} There are exceptional or extraordinary circumstances or
cond~t~ans applicable to the property involved or to the intended
use , of the property which do not apply genera1l y to other prop-
ert~es class~f~ed ~n the same zoning district.
~c} The granting of the variance wi 11 not be detrimental to
the public health, safety or welfare, or materially injurious to
. ,properties or improvements in the vicinity.
In add~t~on to the above cr~ter~a, the following three criteria apply to
variances from off-street parking and loading requirements:
~d } Neither present nor anticipated future traffic volumes
generated by the use of the site or uses of the sites i n the
vicinity reasonably require strict or 1 i teral interpretation and
enforcement of the specified regulation,
fie} The granting of the variance wi 11 nat result i n the
parking or 1 oad i ng of vehicles on public streets i n such a manner
as to interfere with the free flaw of traffic an the streets.
~ f } The granting of the variance will not create a safety
hazard or any other condition inconsistent with the objectives
of the zoning ordinance.
In addition to the criteria set forth in paragraphs ~a} through ~c} of this
subsection, the fol 1 owl ng criterion applies to variances from the provisions
of the Eugene sign code:

site or in the immediate vicinity.
Section 4. A caption, and Sections 9.1000, 9.1002, 9.1004, 9,1006,
9.1005, 9.1010, 9.1014, 9.1016, 9.1020, 9.1030, 9.1031, 9.1033, 9.1035,

9.1037, 9.1039, 9.1041, and 9.1050 are added to the Eugene Code, 1971, to
provide:
Eu ene Si n Code
9.1000 Si n Cade - Pur ose and 5ca e. The purpose of the Eugene sign code
i s to protect the health, safety, property and welfare of the
public by establishing standards for the design, quality of materials, con-
struct i an, size, number, 1 ocati on, e1 ectri f i cati on, i 11 umi nati on, instal 1 a-
t i on and maintenance of al 1 signs and sign structures not 1 orated within a
building. The provisions of the Eugene sign code shall apply to all signs
1 orated within the juri sdi cti vn of the city. The regulations are not i n-
tended to, and da not restrict the content of sign messages. The counci 1,
after due deliberation, and after a public hearing, hereby finds and declares
that:
~a} The people 1 iving within the jurisdiction of the city have
a primary interest i n control 1 i ng the construction, location and
maintenance of outdoor signs in a manner designed to protect the
public health and safety and to promote the pub1 i c welfare.
fib} Careful monitoring of the effectiveness of the sign code
i s necessary to ensure that the code accomplishes its purposes i n
the face of changing sign usage and public expectations .
~c} Private signs make use of a publ is resource by seeking
to communicate with persons using the public way. It is necessary
to regulate such signs to assure that they do not interfere with
other uses of the public way.
~d} It i s necessary to the public safety that official traff i c
regulation devices be easily visible and free from nearby visual
obstructions and distractions, such as flashing signs, an excessive
number of signs, ar signs in any way resembling Official signs,
fie} The construction and maintenance of outdoor signs must be
regulated tv assure that improper practices do not result i n hazard-
ous conditions far the public,
~ f } The Eugene/Springfield Metropolitan Area General Plan
identifies visual access to natural 1 and features and waterways
and the preservation of the distinctive qualities of 1 oral and
neighborhood areas as important objectives to be served in the
cvordi Hated development of the metropal i tan area. It i s necessary
to regulate the number, type and 1 ocati on of signs to accampl i sh
the purposes of the Metropolitan Plan.
fig} Proliferation of signs seriously detracts from the pl ea-
sure of observing the natural scenic beauty and the human envi ran-
ment of the city.
~h} It is necessary to protect residential neighborhoods from
the adverse impact that signs may have on the residential atmos-
phere.
~ i } It i s necessary to regulate the size, type and location
of signs to encourage the effective use of signs as a means of
communication and tv provide equality and equity among sign users
and those who wish to use signs .

.. ~j~ It is necessary to provide regulations which can be ad-
m~ n ~ stered to allow sign owners and sign users the opportunity to
realize the value of their investment and make as many of their own
choices as possible while protecting the needs of the public.
~ k~ The cumulative effect of numerous signs i n close proxi -
m~ ty has a detri mental impact which can not be addressed i n any
way other than by 1 i mi t i ng the number and size of all signs .
9.1002 Si n Cade - Recanci l i ati an. In any case where a part of the Eugene
sign cade is found to be in conflict with a provision of any zoning,
bu i 1 d i ng, fire, safety or health ordinance or code existing at the time of
adoption of the Eugene sign code, the provision which establishes a stricter
standard for the protection of the public health and safety shall prevail.
In any case where a provision of the Eugene sign code is found to be in con-
fl i ct wi th a pravi si on of any other city ordinance or state structural spe-
c~ a1 ty code wh ~ ch establ i shes a standard which i s 1 ess 1 i ke1 y to promote the
purposes of the, Eugene sign code, to the extent al 1 owed by 1 aw the pravi sions
of the Eugene sign cade shall be deemed to prevail.
9.1004 Si n Code - Exem tions. The following signs are exempted from the
requirements of the Eugene sign cade as specified in this section.
Except as otherwise provided therein, no sign shall be exempt from the provi-
s~ons of sections 9.1006, 9.1008 or 9.100 of the Eugene sign code.
~a~, The following signs shall be exempted from the need to ob-
ta~n a sign permit. These signs are permitted signs in all sign
d~str~cts. Use of these signs does not affect the amount or type
of s i gnage atherwi se al 1 owed by the Eugene sign cade.
Bus s i ns . Nan-illuminated signs attached to the exter-
i ors of buses operated by a mass transit district, so 1 ong as
the surface area of all such signs placed upon a bus does not
exceed 80 square feet, and the surface area of signs placed
upon any one side of a bus does not exceed 3o square feet.
Conference and convention banners . One banner may be i n -
stal 1 ed on the exterior wal i of a hotel , motel , convention
center or auditorium where an event is being held. The banner
may be instal 1 ed up to seven days before the event and may re-
main in place up to three days after the event. It shall be a
f 1 at wall mounted sign, and may be up to 12o square feet i n
surface area .
flays. Up to three flags may be flown ar displayed on
each development site.
Hand held,.,,,,,signs. Hand carried signs of six square feet
or 1 ess i n area, worn or carried by an individual wh i 1 e bei n

Parkin iot si ns. Signs up to three square feet in
area ,and up to five feet i n height constructed or placed
w~th~n a,park~ng lot for the purpose of directing traffic
and parking.
Public signs. Signs constructed ar placed in a public
r~ght•of-way by or with the approval of a governmental agency
having legal control or ownership over the right-of-way, signs
owned or constructed under the direction of the city, and
signs placed by a publ i c uti 1 i ty for the purpose of providing
~ nformat ~ on concern ~ ng a pol e, 1 i ne, pipe ar other foci l i ty
bel ong~ ng to the publ ~ c ut i 1 i ty.
Real estate s,i ~~ns . Signs of 12 square feet or 1 ess i n
area, 1 ocated on a level opment site wh i 1 e the ro ert i s for

sale or lease.
Si ns Burin elections. Signs 12 square feet or less in
area, 1 ocated on private property during the period from 60
days before to five days after any public election to be held
~n Oregon.
Si ns on historic ro ernes. Signs constructed or
maintained on historic property, as defined in chapter 2 of
the Eugene Code, 1971, which signs are otherwise subject to
regulation because of their location on historic property.
Stadium signs. Signs located within a sports stadium
which are intended for viewing primarily by persons wi thi n
such stadium, where the stadium i s enclosed by a si ght obscur-
ing fence ar wall at least six feet in height,
Traffic directin si ns. The owner ar lessor of private
property may construct one sign at each entrance to the prop-
erty and at each entrance to a bui 1 di ng on the property for
the purpose of providing direction to vehicular or pedestrian
traffic . Such signs may include, but are not 1 i mi ted to, signs
showing the street address or name of the bui i di ng. Except for
signs panted on paved surfaces, each sign shall not exceed
three square feet of surface area and shall be no more than
five feet in height. Such signs shall be constructed and
located so as to not interfere with vision clearances.
Vehicular s i ns . Any sign permanently or temporarily
placed on ar attached to a motor veh i c1 e, where the veh i c1 e i s
used in the regular course of business for purposes other than
the display of signs.
Vendin „machine signs, Any sign which forms an integral
part of a machine used~~ to dispense goods to consumers.
Warn i ng_,,,s i gn s,. Any pubs i c notice or warning required by
a valid and appl i cabi a federal , state ar 1 ocai 1 aw, regul a-
n on, ar ordinance, and emergency warning signs erected by a
governmental agency, utility company or a contractor doing
authorized or permitted work within a public right-of-way.
fib} Small ,non-~,l l umi,nated signs. Wall signs with a surface
area of six square feet or~~~~~~1ess andand which are eight feet ar less
above grade shall not require a permit but shall be counted in
determining the total sign surf ace area and number of signs al 1 owed
on each development site under the Eugene sign code .

~c} Message boards. One sign per street frontage for the
purpose of communicating to persons on the development site may be
constructed, when a valid sign permit has been issued, without
affecting the amount or type of si gnage otherwise allowed an each
development site, Such a sign may be visible but shall nat convey
a ,message , to persons not on the development site and may be up to
six feet ~n height and up to 40 square feet ~n area. A sign which
conveys a message where any portion of the message i s easily 1 egi b1 e
or d~ scern~ bl a to a person of ord~ nary vi s i an from any 1 ocati on off
the development site commonly visited by members of the publ i c
shall not qualify as a message board. Message boards may include,
but are not 1 i mi ted to, praperl y designed menu boards and building
directories.
~d} Searchl i hts . , Searchlights must be authorized by a s i gn
permit and may be used ~n any non-residential zone for one occur-
rence for up to a maximum of five days within any 180 day period.
The use of a searchl i ght wi th a s i gn permit shall not otherwise
affect the number of signs allowed on any development site.
fie} Si n maintenance. Maintenance of a sign or sign struc-
ture shall not require a sign permit.
9.1006 Si n Code -Prohibited Si ns. Except where qualified as a noncon-
forming sign, the following signs are unlawful and shall be consid-
ered nuisances:
~ a} Abandoned signs .
fib} Illegal signs.
~c} Any sign constructed ar maintained which, by reason of
its size, location, movement, coloring ar manner of illumination
may be confused with or construed as a traff i c control device ar
which hides from view any traffic control device.
~d } ,Any sign written ar placed upon ar wi th i n a parked motor
vehicle with the primary purpose of providing a sign not otherwise
al 1 owed by the Eugene sign code .
~ e} Any sign constructed, maintained or altered i n a manner
not i n compliance with the Eugene sign code .
~f } Bal i oons and banners pursuant to section 9.1004, flags,
conference and canventi on banners, and signs permitted as publ i c
signs are not included within this prohibition};
fig} Flashing signs, except electronic message centers;
~h} Inflatable signs other than balloons;
. ~ i } Portable signs, except warning signs as permitted by
section 9,1004; and
~j} Strings of,lights not perrnanent1y mounted to a rigid
background or otherw~ se qual ~ f ~ ed as holiday decarati ons.
9.1008 Sign Code - Nanconf,arming ,S,i,gns.
~1 Nonconformi n s~~~'
~ } g ~gns may be maintained subject to the following
conditions:
~a} No additions or enlargements may be made to a nonconform-
ing sign except additions or enlargements required by law.
fib} If any nonconforming sign i s moved, voluntarily or i Wool -

tartly, that sign shall thereafter conform to the requirements of
the Eugene sign code as a newl y constructed sign .
~c} Any sign which is constructed to replace a nonconforming
s~ gn shall be constructed ~ n compliance with all applicable provi -
s~ons of the Eugene sign code.
~2} Whenever a nonconforming sign is damaged or destroyed to the
extent of 50 percent or 1 ess of its value as of the 1 ast date of use, i t may
be restored and the use of the sign which existed at the time of the damage
or destruction may be continued, i f such restoration i s started within a
pert ad of 90 days of such damage or destruction and i s di 1 i gently pursued
thereafter.
~3} Except where only a change in display copy is made, any non-
conform~ ng s ~ gn wh ~ ch ~ s structural 1 y altered or has i 11 umi Hatt on instal 1 ed
shall be brought rota compliance with all applicable provisions of the Eugene
s ~ gn code wi th ~ n 90 days and shall thereafter be kept i n compliance with the
Eugene sign code.
~4} All nonconforming signs shat 1 be removed or brought into com-
pl~ance with the Eugene sign code as adapted on July 25, 1990, by June 31,
2000, except that signs with a surface area of 200 square feet or greater
shal 1 be removed or brought into compliance with the Eugene sign code as
adopted on July 25, 1990 by June 31, 1997.
~5} Nothing i n this section shall be deemed to prevent the mat nten-
ance of any sign, or regular manual changes of sign copy on a sign intended
for such purposes.
~fi} .The provisions of subsection ~4} of this section do not apply

1990 along Goodpasture Island Road from a point 300 feet north of the inter-
section with valley River Way to a paint 1400 feet north of the intersection.
The provisions of subsection ~2} of this section shall apply except that res-
toration of a damaged sign shall be allowed where a sign is damaged to the
extent of 1009 of its value. Al 1 other provisions of this section shat 1

any sign unless a sign permit for that sign has been issued by the city. A
sign permit for the construction and continued use of a sign shall be subject

~ 2 } Failure to abide by the terms of a s i gn permit or appl i cabl e
provisions of the Eugene sign code shall inval idate a sign permit. The city
manager may take such steps as are necessary to abate such a sign as a public
nuisance.
9.1014 S i n Code „- Permi t.,,,. Ap~i„cation .
~ 1 } An appl~i cat i on and ~ rel ated information shal 1 be submitted by
the applicant, i n a manner prescribed by the city, together wi th a fee estab-

person begins construction of a sign requiring a sign permit before such a

9. lOlfi Sign Code -Approval of ,,,P,ermi t Appl.,,~,cati on.
~1} The city shall approve a sign permit upon finding that the
applicant has met all requirements of the Eugene sign code.
~ 2 } No permit shall be approved for the construct i on of a s i gn
where the applicant or business occupant intending to use the proposed sign
presently owns or uses a nonconforming sign in conjunction with a business
located at the development site proposed as the l acct i on of the new sign .
~3} An approved sign permit shall expire 90 days after the appl i-
cant has been notified of the approval of the permit unless the applicant has
paid al 1 fees and the approved permit has been issued to the applicant.
~4} Unless the permit holder requests an extension of the permit
and demonstrates good cause for such an extension, a sign permit shall expire
if the sign construction or other work authorized by a sign permit is not
completed within 180 days after the date of issue.
45} .No sign construction shall be considered finally complete
unto 1 the perms t holder has note f ~ ed the c~ ty that work i s finished and the
city i s satisfied that the sign construction has been completed i n canformi ty
with the approved plans and otherwise complies with the Eugene sign code.

~7} A decision granting or denying a sign permit may be appealed
to a heari ngs official . The provisions of section 9.742 of this code apply
to such an appeal. The decision of the hearings official is final.
9.1020 Sign Code -General ,,,_,Proyi si ons. Ali signs shall comply with the

the uniform sign code, published by the International Conference of
Building Officials, is hereby adopted and made a part of the Eugene

able Display Surface; 211; 301 through 306 inclusive; Tables 4-B

fib} Limitation of si n t es. All signs not expressly per-
mi tted under the Eugene sign code ar exempt from regulation i n
accordance with section 9.1004 are prohibited within the jurisdic-
tion of the city.
~c} Cal cul atian standards. For the purposes of calculation of
all areas and distances under the Eugene sign code, the following

f ~1} Street fronta e. ,Except as otherwise provided, the

i s based on the development site having only one street front-
age. Development sites fronting on two or more streets are
allowed the number of signs permitted fvr each street front-
age. However, the total number of signs that are oriented
toward a particu]ar street may not exceed the portion of the
development site's total sign al 1 ocati on that i s derived from
the frontage on that street.
~2} Perimeter walls. The exterior wall of a building
shall be measured at the floor 1 evel of each floor, including
the ground fl oar. Al caves, entryways and extruding porti vns
shall be treated by measuring through such areas as though
al ang the flat wal 1 of a bu i 1 d i ng . The 1 ength of each peri -
meter wail shall be the average of the floor lengths on that
wall . See figure 14} .
~3} Back-to-back si n area. When two sign faces support-
ed by the same sign structure are placed back-to-back, the sign
surface area shall be the area of the 1 arger sign . As used
herein, back-to-back means signs which face in opposite direc-
tions and are parallel ar form an angle of no greater than 30
degrees,
~4} Si n area. The area of all sign elements which
together convey a si ngl e, complete message shall be combined
and considered as a s i ngl a sign . The area of a s i gn face
shall be the entire area of each sign element included within
a single, continuous perimeter which encloses the extreme
limits of a sign, except for trim or structural elements ly-
ing outside all portions of the sign devoted to display, and
i n no case passes through or between any adjacent elements of
the sign. Irregularly shaped signs or elements of a sign
shall be measured in increments of one foot. See Figure 15}
~fi} Rotating signs. For rotating signs, each side or
element cantyaining d~~~sp~ay copy shall be counted in the total
allowable sign area.
~d} Location standards.
~ 1 } Setbacks . Al 1 signs shat 1 comp1 y with the setback

~2} Obstruction rohibited. No sign shall be constructed
which substantially obstructs the view of another sign face
when the other sign i s viewed from a di stance of 200 feet along
the closest pubic right-of-way.

fie} Construction standards.
~ 1 } C1 earance. The minimum clearance of all signs pro-
~ect~ng over a pedestrian way shall be eight feet except that
where a marquee projects more than two-thirds of the distance
from the property line to the curb, the minimum clearance shall
be 12 feet.
~Z} Rotatin sins. No sign shall rotate or have a ro-

not rotate .
~3} Roof sins. Roof signs shall be mounted so that the
bottom of the roof sign is not more than one foot above the
surface of the roof or parapet wall at the sign location.
~4} Wall signs. Wa11 signs shall project a maximum of
12 inches when the wall sign is mare than eight feet above
grade and a maximum of four inches when the wall sign is less
than eight feet above grade.

lighting where such lighting i s directed at any portion of a
traveled street or will otherwise cause glare or impair the
vision of the driver of a motor vehicle or otherwise interfere
with the operation thereof.

Illumination resulting from all signs and lighting on any prop-
erty ~ n a non-res~dent~ al zone ng district shat 1 not exceed two
foot candles at a height of five feet when measured at any
point on property in a residential zoning district. External

ments are not directly visible from praperty in a residential
zoning district which i s adjacent to or across a street from

fig} Readerboard standards. Except as specified in section
9.1039 Central Commercial Sign District}, no sign within 15 feet
of a street property line shall have a proport i on greater than 40
percent of the sign face used as a readerboard sign.

cept wall signs panted on walls, shall be structurally designed or
shall conform to design standards established by the city manager.
This requirement includes design of the sign structure, i nci ud i ng

the state of Oregon and bearing the architect's or engineer's seal .

supports, braces, guys, anchors and electrical equipment, shal 1 be
kept fully operable, in good repair and maintained in safe condi-
tion, free from excessive rust, corrosion, peeling paint or other
surface deterioration.

centers operated as public signs by governmental agencies, no elec-
tronic message center, or portion of a sign used as an electronic

display a message containing more than five characters, or change
the displayed message at intervals of less than once every 15
seconds.
9.1030 Sign Code - Sign Districts; General.
~ 1 } The fol l~aw~ng si gn~~~~~d~~~stri cts are created and applied to the
designated land. No sign permit shall be issued for any sign unless specifi-
cal 1 y identified as an allowed sign use under the terms of the appl i cabi a sign
district or otherwise allowed a permi t under section 9.1008 or exempted under
section 9.1004 of the Eugene sign code.
~2} Except as otherwise specified, signs located on property zoned
"Mixed use" under sections 9.42fi to 9.482 of the toning ordinance, or "Special
Development District" under sections 9.484 to 9.487, shall be subject to the
provisions of section 9.1031 Residential Sign District} if the use thereon
is primarily characterized as residential, subject to the provisions of sec-
ti on 9.1043 ~ Industri al Sign District} i f i ndustri al , and otherwise subject
to the provisions of section 9.1035 tGeneral Commercial Sign District}.
~3} Property within an area subject to a change in zoning districts
shat 1 be governed by the provi si ans of the sign code applicable to the new
zoning district upon the effective date of the order amending the zoning map
or part of said map. Completed applications for sign permits made before
the effective date of the zone change will be considered under the provisions
of the Eugene sign code applicable to the zoning district existing at the time
the application was completed. Ali signs which are not in compliance with the
provisions of the Eugene sign code appl icab1e to the newly established zoning
district shall be considered nonconforming signs.
~4} Except as otherwise specified, signs located on property sub-
ject to anew zoning district created after January 1, 1990 shat 1 be included
in and subject to the provisions of section 9.1031 Residential Sign Dis-
trict}.
9.1031 Si n Code - Residential Si n District. The residential sign dis-
trict is hereby created and applied to all land zoned for residen-
tial uses as set forth below. Signage is 1 invited to preserve the residential
character of the districts by allowing signs only far residential purposes
and for non-residential uses such as small businesses and public institutions.

feet for one face and fi4 square feet for two or more faces.
~2} The sum of the area of all wall signs, marquee signs
and awning signs on any wall within this district shall be
limited to 0.5 square feet times the length of the perimeter
wall upon which the signs are 1 ocated .

9.1035 Si n Code - General Commercial Si n District. The general com-

traffic.

or roof sign on that development site .

notwithstanding the provisions of section 9.1020 ~3 } ~ a} , no
business occupant shall have more than three wall or awning
signs.

trict shall not be more than 20 feet in height.
9.1039 Si n Code -Central Commercial Si n District. The central commer-
cial sign district is hereby created and applied to all property
within the central commercial district as set forth below. Signs are res-
tricted in recognition Of the high density usage of these areas, where pedes-
tr~ an traff ~ c ~ s heavy and vehicular traffic i s commonly limited.
~a} Corres ondin zoni n district. The provisions of thi s

section apply to all property outside a highway commercial sign dis-
tr~ ct wh ~ ch ~ s zoned C-3, to property within the 5th Street Special
Deve1 opment District, and to those porn ans of the Ri verfront Spe-

Franklin Boulevard center 1 ine.
fib} Permitted s~~n types. Signs within the central commercial
sign district shal ~ be ~ invited to the following types:

~4} Marquee signs;

more than one freestanding, roof or projecting sign per development
site street frontage. The number of allowed wall, marquee, and
awning signs is not limited.

signs in the central commercial sign district shall be subject to
the following size limitations:
~I} Freestanding, roof, and projecting signs shall be no
more than I00 square feet for one face and 200 square feet for
two or more faces .
~ 2 } Awning, marquee, under-marquee and wall signs shat 1
be 1 ess than 200 square feet per face and 1 ess than 40o square
feet for two or more faces.
~3} The sum of the area of all signs, except under-
marquee signs, shall be 1 invited to 1,5 square feet times the

i ng's perimeter wal 1 s . The area of wall, marquee, awning and
projecting signs shall be calculated on the basis of the wall
upon which the signs are 1 ocated,

ing shall be allowed a maximum sign area of 50 square feet.

The "alley clearance area" is the area formed by a line
drawn from the intersecting point of a sidewalk or other
public way and an alley at an ang1 a of 30 degrees from
the progect~ on of ,the boundary of the alley into the
~ ntersect~ ng publ ~ c way. See figure 16} .
e. No sign projecting from a building located at a
street intersection may project into the right-of -way a
distance of more than one foot for every five feet of
distance from the property corner closest to the inter-
section. See figure 16}.
9.1041 Si n Code - Hi hwa Commercial Si n District. The highway commer-
cial sign district is hereby created and app1 ied to all land as set
forth below. Signs ~n this area are regulated to accommodate the mixed uses
of the areas and the presence of major streets with high traffic volumes .
~a} Corresponding zoning districts. The provisions of this
section apply to that property~~~wi thin the Ri verfront Special Devel -
opment District located within 200 feet of the Franklin Boulevard

than ZO percent of the total surface area of the billboard.
The additional sign element must be attached to the bi 1 l board
and refer to or relate t0 the sign copy displayed on the face
of the bi ] 1 board.

on property abutting a street designated for the location of
billboards.
~fi} Billboard distances. Notwithstanding any other pro-
v i s i on of the Eugene sign code, no bi 11 board may be located
within 350 feet of another bi 11 board where the bi 11 boards are
located an the same side of the street. Further, no bill -
board may be 1 ocated within 150 feet of another bi 11 board
when the bi 11 boards are 1 ocated across the street, These
distances between bi 11 boards shal 1 be measured along the
centerline of the street designated to be a 1 ocat i on for
bi 11 boards.
~l} Bi 11 board orientation ; All bi 11 boards must be placed
w~th~n 100 feet of a street designated for the location of
bi 11 boards and must be oriented toward one of the directions
of travel along the street designated for the location of bill-
boards.
~S} Bi ] 1 board maximums. Notwithstanding any other pro-
v~ s ~ on of the Eugene s~ gn code, the total area of all bi 11 board
sign faces oriented i n the same direction shat l not exceed
1300 square feet i n any one-hal f mi 1 e of street frontage de-
signated for the location of billboards.
~9} Bi 11 beard removal . The owner of a bi 11 board shal 1
provide the city written notice of the owner's intent to re-
move a bi 11 board not more than fi0 days nor less than 30 days
before the removal of the bi 11 board.
a. The owner of a bi 11 board who has notified the
city of the owner's intent to remove the bi 11 board may
submit an application for the construction of a replace-
ment bi 11 board. If the proposed replacement bi 11 board
i s to be at any 1 acati on within one hal f mi l e of the
1 ocati on of the removed bi 11 board, and i f the appl i cati an
is submitted within 30 days of the date of the removal of
the bi 11 board, such application shal 1 be given preference
over any sign permit application previously submitted but
not yet approved which would have an effect on the deter-
mi nati on of the application for a reel acement bi 11 board.
b. If no such application is submitted by the owner
of a billboard tv be removed within 30 days after the
bi 11 board i s removed, the city may grant a s i gn permit to
any applicant, even i f that permit precludes the repl ace-
ment of the billboard.
9.1043 Si n Code -Industrial Si n District. The industrial sign dis-
tri ct i s hereby created and applied to all property within the
industrial sign district as set forth below. Signs i n this district are regu-
1 ated to accommodate the minimal street frontage of most parcels i n the d i s -
trict and the general proximity to highways and arterial streets,

shat 1 remain i n effect unti 1 rescinded and replaced by rules adopted pursuant
to the provisions of the Eugene Sign Code.
Section 8. The City Recorder, at the request of, or with the concur-
