HomeMy WebLinkAboutOrdinance No. 19711ORDINANCE NO. 19111 AN ORDINANCE CONCERNING A DOWNTOWN TENANT MIX PLAN; AMENDING SECTION 2.153 OF THE EUGENE CODE, 1911; AND DECLARING AN EMERGENCY. The City Counci 1 of the City of Eugene finds that : A. The development and revitalization of the downtown business dis- tri ct has been and remains of high priority to the Caunci l . B, In recognition of that importance, many policies and programs appli- cable to the downtown area have been adopted or developed that provide i n- centives for property owners and the business community. C. As an additional incentive, a Downtown Tenant Mix P1 an Plan} should be developed for all or part of the Downtown Development District ~DDD} that will strengthen the mix of goods and services, increase customer visits to downtown, and increase the property values in the area. Compliance or compatibility with this Plan should be one of the criteria considered by the City in reviewing and approving grants, loans and other incentives offered to property owners and the business community within the DDD. D. It would be i n the public interest to authorize the City Manager, ar the Manager's designee to approve, adapt, and amend a Downtown Tenant Mix Plan for the downtown level apment district as defined i n Subsection Z .154 43 } of the Eugene Code, 1911. Now, therefore, based upon the above findings, THE CITY OF EUGENE DOES ORDAIN AS FOLLOWS: Section 1. Section x.153 of the Eugene Code, 1911, is amended to pro- vide: 2.153 Downtown Commission - Downtown Devel o meat District Activities . ~ 1 ~ The scope of actions to be undertaken by the commission to Ordinance - 1 finance i n the Downtown Development Di stri ct a program of economic promotion, downtown level apment, and public parking which may i nc1 ude the promotion of paratransit, transit, walking and bicycling, include but are not limited to the following: ~ a } Prepare and submit i n compliance with city budget proce - dure and schedule, a prel iminary budget for a program of economic promotion, downtown development and the Downtown Development Dis- trict parking program. The budget shall estimate income and expen- ditures for the immediately ensuing fiscal year and be in a format prescribed by the city manager. fib} Submit to the city manager or his/her designee in cam- p1 i once with the city budget schedul e, a wri tten proposal of the rates of ad valorem and busi Hess-and-accupati on taxation that the commission deems necessary to finance the downtown development and parking program during the next year. ~ c } All proceeds from ad vat orem and bus i nes s -and-occupation taxes specially levied in the Downtown Development District to finance the promotion, development, and parking program and al 1 other income generated by Downtown Development District funds or programs shat 1 be credited to a separate speci a1 revenue fund. The commission shall have power to expend the fund solely to imple- ment the program within the Downtown Development District. ~2} The city manager, or the manager's designee, after consultation with the commission, shall adopt a Downtown Tenant Mix Plan ~P1an} for all or part of the Downtown Development District. When not otherwise inconsistent with provisions of this code, or federal ar state 1 aw, the Plan shall be used as one criteria for approval of grants, loans or other assistance. Changes to the P1 an may be recommended to the manager by the commission. After notice and opportunity far comment, the manager shall consider the recommendation of the commission and may adapt changes ar amendments to the P1 an. Section 2. That the matters captained herein concern the public welfare and therefore, an emergency i s hereby declared to exist, and this Ordinance shat 1 become effective immediately upon its passage by the City Counci 1 and approval by the Mayor, retention by the Mayor for more than ten days, or readoption aver a mayoral veto by two-thirds of all members of the Council, Passed by the City Council this 25th day of July, 1990 G-..
