HomeMy WebLinkAboutOrdinance No. 19712ORDINANCE NO. ~ ~I "I ~,~,~ AN ORDINANCE AMENDING THE EUGENE- SPRINGFIELD METROPOLITAN AREA GENERAL PLAN DIAGRAM TO CONFORM KITH THE GLEN'WOOD REFINEMENT PLAN, AND ADOPTING A SEVERABILITY CLADSE. The City Council of the City of Eugene finds as follows: i. The City of Eugene has initiated amendments to the Eugene-Springfield Metropolitan Area General Plan Metro Plan pertaining to the plan designation for five areas in Glenwood. 2. Adoption of these proposed amendments has been recommended by the Eugene, Springfield and Lane County Planning Commissions. Notice of the public hearings before the Planning 'Commission and City Council have been given as required by Eugene Code, 1971, Section 9.134. 3. The proposed amendments tv the Metro Plan diagram are necessary as an implementation of the Glenwood Refinement Plan diagram. 4. The proposed plan amendments are consistent with applicable Statewide Planning Goals, the fundamental principles and applicable policies of the Metro Plan as shown in the findings attached as Exhibit A and incorporated herein by reference. NoW, THEREFgRE, THE CITY OF EUGENE DOES ORDAIN AS FOLLOWS: Seotion i. The findings set forth above and the findings contained in Exhibit A attached hereto are adapted. Section 2. The Metro Plan diagram on page II-~E-17 is amended in the Glenwood area to provide as follows and shown graphically in Exhibit B attached hereto: i. Change in plan designation from Light-Medium Industrial to Low-Density Residential for a 13 acre site located on the east side of Henderson Avenue between 15th and 19th Avenues. Z. Add a Mixed-Use asterisk to the Franklin Boulevard Commercial-Industrial Strip as described in the Glenwood Refinement Plan. 3. Change the plan designations from Commercial, Light- Medium Industrial, and Low-Density Residential tv a Ordinance - 1 mix of Commercial, Light-Medium Industrial, and Medium-Density Residential and add a Mixed-Use asterisk to the River opportunity Area as described in the Glenwood Refinement Plan. 4. Change the plan designations from Commercial and Low-Density Residential to a mix of Commercial, Light-Medium Industrial, and Medium-Density Residential and add a Mixed-Use asterisk to the McVay Mixed-Use Area as described in the Glenwood Refinement Plan. 5. Add a Mixed-Use asterisk to a seven acre site on the south side of Franklin Boulevard at the western entrance to Glenwood and 18 acres located at the northwest, southwest, and southeast corners of 17th Avenue and Glenwood Boulevard. Section 3. The above Plan Diagram amendments control over any other inconsistent textual provisions of the Metropolitan Area General Plan. Section 4. These Metro Plan amendments shall become effective when identical amendments have been adopted by Lane County and the City of Springfield. Section 5.~ If any section, subsection, sentence, clause, phrase or portion of this ordinance is for any reason held invalid or unconstitutional by a court of competent jurisdiction, such portion shall be deemed a separate, distinct, and independent provision and such holding shall not affect the validity of the remaining portions hereof. The plan amendment is consistent with applicable Statewide Planning Goals. Goal i ~- Citizen Involvement. Goal 1 is intended to ensure that citizens are involved in all stages of the planning process. Citizens have been involved in all stages of the development of the refinement plan which resulted in these proposed amendments. The following summarizes the major citizen involvement opportunities in the development of the draft Glenwood Refinement Plan. 1. In October, 1986, the Glenwood Planning Team Phase II}, composed of area residents, property owners, and business owners was formed to develop the second phase of the Glenwood Refinement Plan. All of the proposed amendments are in the Phase II area. Z. In November, 1986, the planning team held a community issues forum to receive input on planning issues in Glenwood. Notice of this meeting was sent to all residents and property owners in Glenwood. Almost 40 people attended the meeting, and 38 postcard responses were received. 3. Notice of all planning team meetings was published in the Eugene Regime r,,,Guard and the S rin field News and sent to a list of interested parties. 4. In April, 1989, the planning team held a meeting in Glenwood to receive comments on the draft plan. A copy of the draft plan, as well as notice of the meeting, was sent to all residents and property owners in Glenwood. 5. In May, 1989, the Eugene and Lane County Planning Commissions held a public hearing on the draft plan. Notice of this meeting was published in the Resister Guard and sent to all interested parties. 6. In October, 1989, the Eugene City Council and Lane County Board of Commissioners held a public hearing on the draft plan. Notice of this meeting was published in the Re ister Guard and sent to all interested parties. 7. In May, 1990, notice of the joint planning commission public hearing on the proposed amendments to the Metro Exhibit A - 1 Plan for Glenwood was published in the Re ister Guard and sent to all interested parties. Goal 2 .. ^Land ~se,,,,_Plannin~. Goal 2 mandates the establishment of a land use planning process and policy framework to be used as a basis for all land use decisions. As part of the development of the refinement plan, inventories of land use, public facilities, transportation facilities, and natural resources were taken. From this information, land use designations and policies were determined. The net effect of the proposed amendments an the Metro Plan land use allocations are shown in the tables in Attachment B. In the cases where the low-density residential designation is changed to a mixed-use asterisk which includes either commercial, industrial, or medium-density residential uses, the low-density residential allocation was assumed to be evenly distributed among the three uses in the future. Using this approach, the net effect of the proposed Metro Plan amendments would be the addition of two acres to the light- medium industrial designation, 15 acres to the commercial designation, 10 acres to the medium-density residential designation, and the loss of ~7 acres in the low-density residential designation. These amendments, when looked at as a whale, have a minimal impact on overall Metro Plan allocations. The designation with the largest change is the low-density residential designation, and in this case the refinement plan ensures that existing residential uses, in particular the mobile home parks, can retain their RA zoning. In most cases, the amendments reflect what already exists. Amendment 1 provides for a low-density residential designation for an existing mobile home park. Amendment 2 recognizes the existing mixture of commercial and industrial uses along Franklin; Amendments 3 and 4 provide flexibility and opportunities for a mixture of uses to coexist. Amendment 5 retains the underlying light-~ medium industrial designation while allowing for limited commercial uses under certain circumstances. In summary, the refinement plan and related amendments retain the most suitable and logical sites in Glenwood for light- medium industrial use as directed by the Metro Plan. The refinement plan and amendments also recognize the importance of retention of the existing residential uses for low and moderate income households. Goal 5 -~ 0 en S aces Scenic and Historic Areas and Natural Resources. Exhibit A - 2 Goal 5 is intended to "conserve open space and protect natural and scenic resources." Amendment areas 3 and 4 front along the Willamette River. Guidelines within the refinement plan provide for the conservation of river resources such as riparian vegetation and river views. There are two wetland sloughs in the Amendment 5 area. Discussion within the refinement plan addresses considerations which need to be taken into account when development occurs in these areas. There are not inventoried historic areas within the amendment areas. Goal 7 -~ Areas Sub'eCt to Natural Disasters__~nd Hazards. Goa 1 7 i s intended to "protect life and property from natura 1 disasters and hazards," Amendment areas 3 and 4 are within the flood hazard area of the Willamette River. The refinement plan addresses the impacts of flood hazards on proposed and existing development in these two areas, Goal 8 - Recreational Needs. Goal 8 directs local governments to satisfy the recreational needs of its citizens and provide far siting of necessary recreational facilities. The refinement plan proposes possible recreational facilities for Amendment areas and 4 to take advantage of the Willamette River frontage and to provide pedestrian and bicycle access along the river. Goal ~ - E„c,onomy_,,,,,,,,of the State. ilnn4nii Pwnl~w~ Goal 9 addresses the need to diversify and improve the variety, type, scale, and location of business and commercial activities. The mixed-use areas in the four amendment areas will allow maximum flexibility for types of businesses to locate or remain in Glenwood. Goal_14 - Housina. This goal provides for "the housing needs of the citizens of the state." It allows for flexibility in location, type, and diversity of housing. Amendment 1 will protect an existing well-established mobile home park in Glenwood. Amendments 3 and 4 also allow existing mobile home parks to retain their existing residential zoning as well as to provide for medium- density residential development in the future, Goal i3 - Ever Conservation. Goal l3 intends that land uses be managed to maximize energy conservation. This goal encourages land use patterns which allow people to live, work, shop, and recreate in the same geographic area, The mixed-use designations accaxaamodate Exhibit A ~- 3 industrial, commercial, and residential uses in the same area. The location of Amendments 2, 3, 4, and 5 along transit lines promotes energy conservation through the potential use of transa.t services. Goal 15 - Willamette River Greenwa . Goal 15 is intended to protect and enhance the quality of the Willamette River by creating the Willamette River Greenway. Amendment areas 3 and 4 both have extensive frontage along the Willamette River. The refinement plan provides guidelines for development within the Willamette River Greenway. It also provides for bicycle and pedestrian access along the riverbank. Z. The plan amendment is consistent with the fundamental principles an applicable policies of the Metro Plan. The draft Glenwood Refinement Plan is consistent with and based on the premises within the Metro Plan's fundamental principles. The Diagram amendments are well supported by specific policies within the Metro Plan. Fundamental Principle 2 of the Metro Plan "requires cooperation by all general purpose, special district, and special function agencies in the community" page II-1} . Although the work on the refinement plan was coordinated by Eugene, it did involve the cooperation of Lane County, Springfield, the Glenwood Water District, the Eugene Water & Electric Board, the Springfield Utility Board and Willamalane Park and Recreation District. Fundamental Principle 3 "requires that urban development occur in a compact configuration within a prescribed urban service area" page II-1}. The draft Glenwood Refinement Plan supports this premise by recognizing Glenwood's unique position in the central part of the Metropolitan area and allowing for its future urbanization when sanitary sewers are available. Fundamental Principle 6 is based on the premise that "Eugene and Springf field ~ the two existing cities ~ are the logical providers of services accommodating urban levels of development within the urban growth boundary" page II-1} . The draft Glenwood Refinement Plan is also based on this premise and makes provision for the future extension of urban services into Glenwood upon annexation. This is consistent with the earlier adoption by the three jurisdictions of the Glenwood Jurisdictional Study. The following policies within the Residential Element of the Metro Plan support the change to low-density residential in Amendment 1 and the flexibility provided by higher-density housing allowed in the mixed-use areas of Amendments 3 and 4: Exhibit A - 4 Pol,i,gy~: Investigate and, when advisable, implement mixed use zoning, particularly in established neighborhoods where compatible and functional mixes already exist VIII-A-6y. Policy zi: Encourage a mixture of dwelling unit types in appropriate areas VIII-A-6~. ,,,Policy 34: Encourage higher-density residential development near industrial and commercial centers throughout the metropolitan area VIII-A-7}. The mixed-use areas recognized by the proposed amendment will allow for mixed-use zoning to be considered in portions of the Glenwood area. Preservation of the existing mobile home park in the Amendment 1 area as well as support for the other mobile home parks in Amendment areas 3 and 4 further support Policy 2l. Finally, Glenwood is an industrial center which will be growing in additional job opportunities in the future. The medium- density residential uses allowed in the mixed-use area will help provide additional housing opportunities close to these employment area , The following policies in the Economic Element of the Metro Plan support Amendments 3, 4, and 5: Polio 7: Encourage industrial park development, including areas for warehousing and distributive industries and research and development activities VIII-B-S~. P liC,,y 14: Utilize processes and local controls which encourage retention of large parcels or consolidation of small parcels of industrially or commercially zoned land to facilitate their use or reuse in a comprehensive rather than piecemeal fashion VIII-B-5}. Both mixed use Amendment areas 3 and 4 encourage the creation of industrial and business parks. Implementation strategies within the text for the Amendment 5 area protect these sites from being divided into smaller parcels. The Willamette River Greenway Element of the Metro Plan has several policies pertinent to Amendment areas 3 and 4~ Polio ~: New industrial development that locates along the Willamette and McKenzie Rivers shall enhance natural, scenic, and environmental qualities VIII-D-4~. Folic 8: Within the framework of mandatory statewide Exhibit A - 5 planning goals, local Willamette River Greenway plans shall allow a variety of means for public enjoyment of the river, including public acquisition areas, residential areas, and commercial areas VIII-D-5}. ,,Po~y,~,io: Local and State governments shall continue to provide adequate public access to the Willamette River Greenway ~III~-D-5} . In response to Policy d, the draft Glenwood Refinement Plan provides the Willamette River site development guidelines to ensure that new industrial development will be compatible with the river. The mixed use areas address Policy 8 by allowing for a variety of ways to enjoy the river, including possible park sites, medium- densa.ty residential development, and limited commercial uses. The refinement plan provides for a bike-pedestrian corridor along the river's edge in response to Metro Plan Policy 10. Finally, Policy 9 of the Environmental Design Element states that "Refinement plans shall be developed to address compatibility of land uses, safety, crime prevention, and visual impact along arterial and collector streets, within mixed use area . ." ~III- E-4} . The Amendment 2 area encompasses the type ~of mixed-use described in Policy 9 and the refinement plan proposes for using the site review process to address issues of compatibility, safety, and visual impacts of mixed-use development. 3. The plan amendment is found to address one or more of the following: i. An error in the publication of the plan; or Z. Circumstances have changed in a substantial manner that was not anticipated in the plan; or 3. Incorporation into the plan, following acknowledgment of newly inventoried material which relates to a Statewide Goal; ar 4. A change in public policy. The amendments proposed by the draft Glenwood Refinement Plan reflect a change in public policy and are based on a more detailed look at the Glenwood area through the Glenwood Refinement Plan process. The draft Glenwood Refinement Plan has gone through extensive comment and review by the public, the Eugene and Lane County Planning Commissions, and elected officials as evidenced by Exhibit A ~- 6 the information in the goal discussion under Goal 1, Citizen Involvement. The five areas being considered far Metro Plan amendments are called for in the draft plan as needing a Metro Plan amendment and were reviewed as such. The refinement plan has provided a way to look in much more detail at the appropriate future land use designations for Glenwood. The preceding analysis confirms the existence of the refinement plan and the five amendments with the Metro Plan, its parent document. Attachments: A. Metro Plan Amendment Map B.
