HomeMy WebLinkAboutOrdinance No. 19717ORDINANCE N0. ~,°~1 l AN ORDINANCE REQUESTING THAT JURISDICTION OVER PORTIONS OF COUNTY ROADS BE TRANSFERRED TO THE CITY OF EUGENE; AND DECLARING AN EMERGENCY The City Council of the City of Eugene finds that: The City Counci ~ deems ~ t necessary and expedient and i n the best interests of the City to acquire jurisdiction aver the county roads more particularly described i n Exhi bi t A attached hereto and incorporated herein by reference, al 1 of which lie within the corporate limits of the City, to the same extent as it has over public streets and alleys of the City. The Board of County Commissioners of Lane County, Oregon has authority under the provisions of ORS 313.210 to release jurisdiction over county roads within the limits of the City of Eugene, and should be requested to da so. NOW, THEREFORE, THE CITY OF EUGENE DOES ORDAIN AS FOLLOWS: Section I. Based upon the above findings, which are incorporated herein by reference, the City Council of the City of Eugene finds it necessary and expedient and i n the best interests of the City to acquire jurisdiction over the County Roads more particularly described on Exhibit A attached hereto and incorporated herein by reference, to the same extent as i t has over other publ i c streets and alleys of the City. Section 2. The City Council directs that a cagy of this Ordinance be forwarded to the Board of County Commissioners of Lane County, Oregon, which Board is requested to release jurisdiction of the above described County Roads to the City of Eugene in accordance with the provisions of ORS 373.270. Ordinance - 1 Section 3 . Upon receipt by the City Manager, within 15o days from the date hereof, of a certified copy of an order of the Board of County Commissioners of Lane County, Oregon ref eas i ng j uri sdi ct i vn of the above described portions of County Roads to the City of Eugene, the City sha11 have the same control, power and jurisdiction over the streets as it has over all other streets and alleys within the City of Eugene, Section 4. ~n the event the Board of County Commissioners of Lane County fails to enter the order referred to in Section 3 above within ~5o days from the date this Ordinance is adopted by the Council and approved by the Mayor, the request and authorization contained herein sha11 terminate as though this Ordinance had not been adopted. Section 5. That the matters contained herein affect the public welfare and safety and therefore, an emergency is hereby declared to exist, and this Ordinance shall become effective immediately upon its passage by the City Council and approval by the Mayor.
