HomeMy WebLinkAboutOrdinance No. 19718v ~RDiNANCE N0. 1~,7 L ~ AN ORDINANCE LEVYING ASSESSMENTS FOR PAVING, STORM AND SANITARY SEWERS TN CRENSHAW STREET FROM DEBRTCK, 1900-FEET TO APPROXIMATELY To TOP OF GILLESPTE BUTTE; AMENDING THE ASSESSMENT ROLL ATTACHED TO ORDINANCE N0. 19683; AND DECLARING AN EMERGENCY. The City Council of the City of Eugene finds that: On April 9, 1990, Ordinance No. 19683 was enacted levying an assessment against the properties listed on the Assessment Rol 1 attached thereto for paving, storm and sanitary sewers in Crenshaw Street from DeBrick Road, 1900-feet to approximately to top of Gillespie Butte. Included in th-e Assessment Roll attached to Ordinance No. 19683 was an assessment in the amount of $14,391.80 designated as account number 890029- 0040, 0050 and 0060. Notice thereof was provided the presumed owners of retard, Bedacht, Manfred. Subsequent to the adoption of Ordinance No. 19683, the finance officer has been advised that the subject property was assessed as three ~3} lots which included a flag Iot} as was indicated on an approved but unrecorded land partition file with Lane County. Because of this faulty legal description of the property assessed under account $90029-0040, 0050 and 0060, an amendment to the original assessment is necessary. Notice of the new proposed assessments specified in this ordinance and an opportunity to be heard thereon has been provided the owner of the amended tax lot as required by Sections 7.185 and 1.187 of the Eugene Code, 1971. The allocation of the new proposed assessment for this tax Iot will not affect the amounts levied against other properties included on the Assessment roll attached to Ordinance No. 19683. Section 7.230 of the Eugene Code, 1911 allows to the Council to amend assessments when there is an error in the calculation of an assessment. Now, therefore, THE CITY OF EUGENE DOES ORDAIN AS FOLLOWS: Section 1. Based upon the above findings, which are hereby adopted, and the recommendation of the hearings official, the Assessment Roll attached to Ordinance No. 19683, enacted on April 9, 1990, is amended by deleting therefrom the assessment in the amount $1,839.89 as represented by account number 891029w 0010, tax lot 17-03-19 42-02403, Bedeacht, Manfred and substituting therefor: Account No. Name Amount 891029W0010 Bedeacht, Manfred $12,551.91 891029-0020 City of Eugene $ 1,839.89 Section 2. The finance officer is directed to make the above corrections to the Assessment Rol 1 attached to Ordinance No. 19683 and to the docket of city liens, and to send a notice of the assessment to the property owner set forth in Section 1 above. Section 3. Except as herein specifically amended, all other pravisions~af Ordinance No. 19683 and the assessments provided for therein remain in full force and effect. Section 4. That the matters contained herein concern the public welfare and safety, and it is necessary that the above corrections be made as soon as possible, and therefore, an emergency is hereby declared to exist, and this Ordinance shat 1 become effective immediately upon its passage by the City Counci 1 and approval by the Mayor. This revision will be presented to the City Council far approval at their regularly-scheduled hearing July 23, 1990}. I am in agreement with the new assessment amount of $2,551.91 and therefore waive my rights to a public hearing in regard to this reassessment of Tax Lot I1-03-~9-42-02403.
