HomeMy WebLinkAboutOrdinance No. 19732ORDINANCE N0. 19132 AN ORDINANCE CONCERNING THE HUMAN RIGHTS COMMISSION; ESTABLISHING A NEW COMMISSION AND STANDING COMMITTEES OF THE COMMISSION; AMENDING SECTIONS 2.013, 2.109, 2.260, 2.265, 2.270, 2.215 AND 2.280 OF THE EUGENE CODE, 1971; REPEALING SECTION 2.285 OF THAT CODE; AND DECLARING AN EMERGENCY. THE CITY OF EUGENE DOES ORDAIN AS FOLLOWS: Section 1. Section 2. Subsections (1)(i) and (1)(j) of Section 2.109 of the Eugene Code, 1911, are combined and amended tv provide: 2.109 Communit Devela meat Committee - Membershi . ~1} The committee shall consist of: ~i} Two members of the Human Rights Commission, or two citi- zens, one of whom has actively demonstrated interest and expertise in minority cultural diversity and anti-discrimination causes and the other who has the same qualifications in fields related to the special needs and concerns of people with disabilities. Ordinance - 2 Section 3. Sections 2.260, 2.265, 2.210, 2.275, and 2.280 of the Eugene Code, 1971, are amended, and Section 2.285 repealed, to provide: 2.260 Human Ri hts Cammissian. There is hereby created a human rights commission, referred to i n secti ans 2.260 to 2.280 of this code as ""the commission". 2.265 Human Ri hts Cammissian -Duties and Powers. ~1} The commission shall cooperate with the city officials to insure that the city continues to be a leader in extending equality of oppor- tunity to its citizens, including but not limited to; ~a} Employment opportunities in city government; fib} Training for city jobs; ~c} Equality of services provided; ~d} Equality of all before the law; and fie} Equal treatment to all from holders of city licenses, contracts and privileges. ~2} The commission shall cooperate with the State Bureau of Labor and ether governmental agencies in receiving, referring and investigating specific acts of discrimination against individuals in the community. ~3} The commission shall endeavor to ascertain the status of civil and human rights in the community. The commission may investigate, research and hold hearings to effectuate this provision. ~4} The commission shall make periodic recommendations to the mayor and cauncil concerning the status and treatment of persons in the com- mission's areas of concern. ~5} The commission shall affirm, encourage and initiate programs and services designed to effectuate the spirit and intent of federal, state and municipal legislation prohibiting discrimination and to improve human relations within the city. In these efforts, the commission may enlist the support of community groups and public agencies. 2.270 Human Ri ht~s Commi„ss,i on -Membership. ~1} The commiss~vn shall consist of: ~a} One member of the city cauncil or the mayor; fib} Fourteen citizens with a demonstrated interest in or knowledge of the human rights concerns of the community, chosen to ensure a balance between men and warren on the commission as well as representation from the racial, ethnic, religious, dis- abled and other groups in the community. Members shall be appointed by the council except that the initial members shall be nominated by the mayor and appointed by the council. ~2} Vacancies on the commission shall be filled in the same manner as original appointments. Except where the vacancy occurs because the member from the council or the mayor ceases to serve on the commission, if a vacancy occurs prior to the expiration of an incumbent's term, the mayor shall select nominees and the council shall appoint within 30 days of the position becom- ing vacant a person to complete the unexpired term from the membership of the commission's standing committees. A position becomes vacant upon: Ordinance - 3 ~a} The death or resignation of the incumbent; fib} Removal of an incumbent for nonperformance of duty or upon recommendation by the cammission after the commission has determined that the incumbent has failed to properly represent the commission ar otherwise damaged the work of the cammission, and the caunci 1 has concurred with that determination; ~c} Failure of the council to reappoint an incumbent at the expiration of his or her term; or ,~d} The incumbent ceasing to be qualified far initial appointment. ~3} Except as provided in subsection ~4} below, the initial terms for citizen members shall be staggered, with four members serving a one year term, five members serving a two year term, and five members serving a three year term, with assignment of these original terms determined by the council. Thereafter each c~t~zen member shall serve a three year term. No member of the commissian shall serve mare than six consecutive years as a member of the cammission. . ~4} The city~s current,Commission an the Rights of Aging Citizens, Comm~ss~on on the Rights of the Disabled, Commission on the Rights of Minori- ties, and Commission on the Rights of Women shall each recommend to the mayor one of its members for nomination to serve an initial two year term on the Human Rights Commmission. The current Youth Commission shall recommend tv the mayor one of its members for nomination to serve an initial one year term on the Human Rights Commission. ~5} Members of the commissian shall be persons who have actively demonstrated interest and expertise in efforts to eliminate injustices re- lated to discrimination in such areas as the following; ~a} The rights of women; fib} The rights of people with disabilities; ~c} The rights of African-Americans; ~d} The rights of Asian-Americans and Pacific Islanders; fie} The rights of Latinos and Hispanics; ~f} The rights of Native Americans; fig} The rights of the aging; ~h} The rights of youth; ~i} The rights of religious minorities; ~j} The rights of gays and lesbians; and ~k} The rights of low-income and homeless people. ~.Z15 Human Ri hts Commission - Officers, Meetin s Rules and Procedures. ~ 1 } The officers of the commission shal 1 be a chaff rperson and a vice-chair elected by the commission from among the citizen members of the commission. The chairperson shall preside over meetings of the commission and shall have the right to vote. The vice-chair shal 1 perform the duties of the chairperson in the absence or disability of the chairperson. The officers shall serve for terms of one year. ~2} The commission shall meet at least six times a year, with such additional meetings as it deems necessary to properly perform its duties. ~3} The commission may make and after rules for its conduct and procedure, providing they are consistent with state law and applicable pro- visions of the city charter, ordinances and policies. Ordinance - 4 ~4} Fifty percent plus one of the current membership shall con- stitute a quorum. .~5} The city manager may, within his or her discretion, furnish staff assistance to the commission or to the commission's committees. Z.Z80 Human Rights Commission - Committees. 1 The A~ ~~enda Comm~ttee~ of t~.,,,. ~- ~ } g ~ ~~~he Human Rights Commission is hereby created. ~a} The members of the agenda committee shall be the elected chairpersons from the commission and from the committee on discrimination and harassment, the committee on community education and outreach and the committee on accessibility. . fib} The commission may select three of its members, in add~t~on to the chairperson, to serve as interim members of the agenda committee until such time as the other members of the agenda committee have been selected by the committees. ~c} The agenda committee shall be responsible for the pre- paration of the agenda and for planning the meetings of the com- mission. The agenda committee shall also provide membership ser- v~ces by the or~entat~on of new members of the commission and the commission's committees, by assisting all members and the council concerning member's attendance and responsibilities, and by provid- ~ng a 1~nk among the comm~ss~on and the committees when these are not meeting. The agenda committee may, at the request of the com- mission, prepare recommendations on commission bylaws and other adm~n~strat~ve matters. ~Z} The Committee on Discrimination and Harassment, Committee on Community Education and Outreach and Committee on Accessibility, hereinafter referred to as the "standing committees" are hereby created. ~a} Each committee shall have ten members who shall serve three year terms. The commission shall nominate five members of the commission and five citizens to be appointed by the council to each committee. No member of the commission may serve on more than one standing committee, fib} The commission shall, within six months of being estab- lished, submit initial nominations for members of each standing committee. Three initial members of each standing committee who are appointed to serve as citizen members of the committee shall be appointed to serve two year terms, and two shall be appointed to serve a three year term. ~c} , vacant positions on a standi ng committee shal 1 be f i 11 ed by council appointment of a person nominated by the commission. A position shall be considered vacant under the same conditions as set forth for a vacancy on the commission. ~d} The off i cers of each standing committee shall be a chaff r- person and a vice-chair elected by the cammi ttee. The chaff rpersan shall preside over meetings of the committee and shall have the right to vote. The vice-chair shall perform the duties of the chairperson in the absence or disability of the chairperson. The off ~ cers shall serve for terms of one year. fie} Each standing committee shall meet at least nine times a year, with such additional meetings as i t deems necessary to Ordinance - 5 properly perform its duties. ~f} Each standing committee may make and alter rules for its conduct and procedure, providing they are consistent with state law and applicable provisions of the city charter, ordinances and policies. sag} Fifty percent plus one of the current membership of a committee shall canst~tute a quorum. ~3} The committee on discrimination and harassment shal 1 serve as an advocate for and shal 1 assist individuals and .classes of people who exper- ience hate crimes and incidents of discrimination. The committee shall also monitor and bear witness to cammunity incidents of discrimination and shall work to develop mechanisms and policies to challenge discrimination. ~4} The committee on community education and outreach shall plan, conduct and co-sponsor forums, coordinate a speakers bureau, act as a publ i - city arm for programs, and assist cammunity organizations in raising aware- ness and staging events relating to the human rights issue. The committee shall have the primary responsibility to recruit, train and coordinate volun- teers to assist in human rights program activities, and shall work to keep the program and the city open to members of the protected classes served by the program. The committee shall also assist the city in employment outreach and shall actively solicit protected class participation on all citizen advisory boards. ~5} The committee on accessibility shall monitor accessibility and recommend policies and actions to improve accessibility in such areas as transportation, public meetings and events, employment opportunities and to overcome such barriers as cultural and linguistic differences and physical barriers, including sidewalks and curbs. The committee shall develop an accessibility guidebook and act as a resource on accessibility issues, The committee shall establish and maintain working relationships with the city staff most closely involved with physical accessibility questions and citi- zen access to city services and programs. ~6} The commission may recommend the council establish any addi- ti anal committee or task farce which the cammi ssi an feels will assist the commission and the city in meeting the goals of the human rights program. . ~1} , Nathi ng i n this section shall preclude the commission or any standing comma ttee from farms ng ,such temporary warki ng groups from among ex~st~ng members as the comm~ss~on or committee may feel is necessary to accomplish its duties. Section 4. The current Commission on the Rights of Women, Commission on the Rights of Minorities, Commission on the Rights of Aging, Commission an the Rights of Disabled, and Youth Commission may continue in effect for the purpose of making any nominations or designations provided for herein, developing recommendations far the transfer of their respective activities to the new Human Rights Commission, or preparing reports on their accom- plishments and remaining work. Any authorization granted under this section Ordinance - 6 shall terminate at such time as the members of the Human Rights Commission created herein are appointed. Section 5. The City Recorder, at the request of, or with the concurrence of the City Attorney, is authorized to administratively correct any reference errors contained herein ar in other provisions of the Eugene Code, 1971 to the provisions added, amended or repealed herein. Section 6. That the matters contained herein concern the public welfare and safety, and in order to facilitate the recruitment and appointment of members for the Human Rights Commission, an emergency is hereby declared to exist, and this Ordinance shall become effective immediately upon its passage by the City Council and approval by the Mayor, retention by the Mayor for mare than ten days, or readoption over a mayoral veto by two- thirds of all members of the Council.
