AN ORDINANCE REQUESTING THAT JURISDICTION OVER CHAMBERS
STREET CONNECTOR A COUNTY ROAD BE TRANSFERRED TO THE CITY
OF EUGENE; AND DECLARING AN EMERGENCY
The City Council of the City of Eugene finds that:
The City Cvunci 1 deems i t necessary and expedient and i n the best interests
of the City to acquire jurisdiction over the county roads mere particularly
described in Exhibit A and B attached hereto and incorporated herein by
reference, all of which lie with the corporate limits of the City, to the same
extent as it has aver public streets and alleys of the City.
NOW, THEREFORE,
THE CITY OF EUGENE DOES ORDAIN AS FOLLOWS:
Section 1. Based upon the above findings, which are incorporated herein
by reference, the City Council of the City of Eugene finds it necessary and
expedient and in the best interests of the City to acquire jurisdiction over the
County Roads mare particularly described on Exhibit A and B attached hereto and
incorporated herein by reference, to the same extent as i t has over other publ i c
streets and alleys of the City.
Section ~. The City Council directs that a copy of this Ordinance be
forwarded to the Board of County Commissioners of Lane County, Oregon, which
Board is requested to release jurisdiction of the above described County Roads
to the City of Eugene in accordance with the provisions of ORS 373.270.
Section 3. Upon receipt by the City Manager, within 150 days from the date
hereof, of a certified copy of an order of the Board of County Commissioners of
Lane County, Oregon releasing jurisdiction of the above described portions of
the County Roads to the City of Eugene, the City shall have the same control,
power and jurisdiction over the streets as i t has over al 1 other streets and
alleys within the City of Eugene.
Section 4. 1n the event the Board of County Commissioners of Lane County
fails tv enter the order referred to in Section 3 above within X50 days from the
date this Ordinance is adopted by the Council and approved by the Mayor, the
request and authorization contained herein shall terminate as though this
Ordinance had nat bee adopted,
5ecti on 5. That the matters contained herein affect the publ i c welfare
and safety and therefore, an emergency is hereby declared to exist, and this
Ordinance shat 1 became effective immediately upon its passage by the City Counci 1
and approval by the Mayor, retention by the Mayor for more than 10 days, or
readoption over mayoral veto by two thirds of all members of the council.
