HomeMy WebLinkAboutOrdinance No. 19755ORDINANCE NO. ~~'~ SS AN ORDINANCE PROVIDING FOR WITHDRAWAL FROM THE RIVER ROAD WATER DISTRICT AND RIVER ROAD PARR AND RECREATION DISTRICT, THAT PART OF THE DISTRICTS ANNEXED To THE CITY OF EUGENE BY THE LANE COUNTY LOCAL GOVERNMENT BOUNDARY COMMISSION ON NOVEMBER 27, 1990 ~HOFFMAN, EC EU 90-33y, AND DECLARING AN EMERGENCY. The City Council of the City of Eugene by Resolution No. 4225 adopted January 28, 1991, proposed withdrawal from the River Road Water District and the River Road Park and Recreation District that part of the Districts annexed to the City on November 27, 1990 by Notice of the Lane County Lvcal Government Boundary Commission, as hereinafter described, The Resolution set March 4 , 1991, at 7 : 3 o p , m, , Pacific Time, in the Council Chambers, City Hall, in Eugene, Oregon, as the time and place for hearing objections to the withdrawal, and directed that notice of the time and place of the hearing be published once each week for two consecutive weeks prior to the hearing and be posted in four public places in the City for the same period. The Notice has been so published in the Register Guard and posted in four public places in the City of Eugene, Oregon. The City is willing to assume the liabilities and indebtednesses previously contracted by the Districts proportionate to the part of the Districts that have been annexed to the City upon the effective date of the withdrawal, The withdrawal of the annexed territory from the Districts is consistent with the fundamental principles and applicable policies of the Eugene-Springfield Metropolitan Area General Plan, and other adopted City policies, and it is in the best interest of the City that the territory be withdrawn. NOW, THEREFORE, THE CITY OF EUGENE DOES ORDAIN A3 FOLLOWS: Section 1. The territory in Lane County, Oregon, annexed to the City of Eugene on November 27, 1990, as bounded and described as follows; A parcel of land located in the River Road area of North Eugene, on the east side of Ordinance - 1 North Park Avenue between Hatton Avenue and Nantucket, Tax Lot 4200, Assessor's Map 17-04-14-3 4, and more particularly described on Exhibit A attached hereto and incorporated herein by reference. Hoffman, EC EU 90-33}, is hereby withdrawn from the River Road Water District and River Road Park and Recreation District, effective July 1, 1991. Section 2. The City Recorder is requested to forward a copy of this Ordinance to each of the above referred to Districts. Section 3. That the matters contained herein concern the public welfare and must be effective prior to March 31, 1991. Therefore, an emergency is hereby declared to exist, and this Ordinance shall become effective immediately upon its passage by the City Council and approval by the Mayor, retention by the Mayor for more than ten days, or readaption over a mayoral veto by two-thirds of all members of the City Council.
