HomeMy WebLinkAboutOrdinance No. 19756ORDINANCE N0, 19756 AN ORDINANCE CONCERNING THE UNIFORM FIRE CODE; REPEAL- ING SECTION 5.190 OF THE EUGENE CODE, 1971; AMENDING SECTION 5.001 OF THAT CODE; AMENDING AND RENUMBERING SECTION 8.200 OF THAT CODE; RENUMBERING SECTION 8.205 of THAT CODE; AND DECLARING AN EMERGENCY.. THE CITY OF EUGENE DOES ORDAIN AS FOLLOWS: Section 1. The definitions far Fire Chief and Fire Code ar Fire Pre- vention Code set forth in Section 8,001 of the Eugene Code, 1971, are amended to provide: $.001 Definitions. For the purposes of this chapter the following words and phrases, except where the context clearly indicates a different meaning, shall mean: Chief. The city manager, or his/her designee. Fire Cade or Fire Prevention Cade. The regulations adopted by section 8.100. Section 2. The caption preceding Section $.190 of the Eugene Cade, 1911,. is hereby amended, Section 8.190 of that Code is repealed, and Section 8.200 is renumbered 8.100, with Subsections X41}, X42}, and X43} thereof re- numbered X43}, X44} and X45} respectively, and Subsections ~1} through ~4p} thereof renumbered and/ar amended to provide: Uniform Fire Code 8.100 Uniform Fire Code. ~1} The city hereby adopts as its uniform fire code, the State of Oregon 1989 Edition Uniform Fire Code, subject to the additions, deletions, and modifications set forth in this section. ~2} Appendix II-E and Appendix vI-A of the Uniform Fire Code are not adapted. The Appendices II-E and vI-A set forth immediately following this section 8.100 of the Eugene Code, 1971, are hereby adopted. ~3} Subsection 1 of Appendix I-D of the Uniform Fire Code is amended by amending subparagraph ~c} to provide: ~c} S_cope. Buildings shal 1 meet al 1 applicable state and 1 oval codes far fire and life safety and the following standards . CDNNECTORS. Fire department connectors for automatic sprinkler systems shall be located within 5D feet of the nearest hydrant. ~5} Subsections 1.1D2~a} and fib} of the Uniform Fire Code are amended to read: Section 1.102 ~ a _ General . It i s the intent of this code to presc~r~be regulations~consistunt with nationally recognized goad practice for the safeguarding to a reasonable degree of life and property from the hazards of fire, panic and explosion arising fram the storage, handling and use of hazardous substances, mater- ials and devices, and from conditions hazardous to life or property in the use or occupancy of buildings or premises. Section 1.102 b Nationall Reco nixed Standards, where na applicable standards or requirements are set out in this code, or contained within other statutes, codes, ordinances or administra- tive rules adopted by the city, compliance with applicable standards of the National Fire Protection Association or other nationally recognized fire-safety standards as are approved by the chief shall be deemed as prima facie evidence of compliance with the intent of this code. Nothing herein shall derogate fram the power of the city to determine compliance with codes or standards for those activities or installations within its jurisdiction or responsibil- ity. ~6} 5ubsections 1.103~a} and ~d} of the Uniform Fire Code are amended to read: Section 1.,1„a3 a Ge,., ,,..._ ,,, ,~, neral . The pravi si ons of this code steal l supplement any and all laws relating to fire safety and shat l apply to all persons without restriction, unless specifically exempted. Section 1 103~d} The provisions in the following appendices are adopted as part of this code: 1. Appendix I-A, 2. Appendix I-B, 3. Appendix I-D, as amended by Subsection 8.1003} of the Eugene Code, 1971, 4. Appendix II-B, 5. Appendix III-A, 6. Appendix III-B, as amended by Subsection 8.1004} of the Eugene Code, 1911 7. Appendix III-C, as adopted by the State of Oregon ~7} Sections 2.101 to 2.303 of the Uniform Fire Code are deleted. ~8} Article 3 of the Uniform Fire Code is deleted. ~9} Sections 4.101 and 4.102 of the Uniform Fire Code are deleted, ~ 10} Section 4.103 of the Uniform Fire Code i s amended to read; Section 4.103 A lication fvr Permit. All applications for a per- mit required by this code or the administrative code shall be made as pro- vided in the administrative code. X11} Sections 4.104, 4.105, 4.106, and 4.107 of the Uniform Fire Code are deleted . Ordinance - 2 X12} The first sentence of Section 4.148 of the Uniform Fire Cade is amended to read: Sec. 4.108. When required by code or administrative rule, the permit shall be obtained prior to engaging in the following activities: X13} Subsection 9.101~a} of the Uniform Fire Code is amended to read: Section 9.101 a Amendments. Whenever a reference is made to any portion of this code or any other applicable law or ordinance, the reference applies to all amendments and additions now or here- after made. ~ 14} Section 9.103 of the Uniform Fire Code i s amended by adding a definition for "Administrative Code" in alphabetical order therein: ADMINISTRATIVE CODE means the code adopted by section 8.444 of the Eugene Code, 1911. X15} Section 9.104 of the Uniform Fire Code is amended by amending the definition of "Bureau of Fire Prevention" to read: BUREAU OF FIRE PREVENTION is the Department of Public Safety of the city. X16} 5ection 9.105 of the Uniform Fire Cade is amended by amending the definition of "Chief or Chief of the Fire Department," and adding in alphabetical order therein a definition for "Combustible Goods or Merchan- dise" to read: Chief or Chief of the Fire De artment is the city manager or his or her designee. Combustible Goods or Merchandise sha11 include items made of wood, paper ar rubber; those containing flammable liquids; those packed with quantities of excelsior, moss ar paper; other goods or merchandise of equivalent or greater combustibility and other readily ignitable ar free burning material. X11} 5ection 9.148 of the Uniform Fire Code is amended by amend- ing the definitions of Fire department and Fireworks included therein to read: Fire de artment is the Department of Public Safety for the City of Eugene. Fireworks means any combustible or explosive camposi t i vn or substance, or any combination of such compositions or substances, or any other article which was prepared for the purpose of provid- ~ng a visible or audible effect by combustion, explosion, deflag- rati on or detonation, and includes blank cartridges or toy cannons i n which explosives are used, bai 1 Dons wh ~ ch require fire under- neath to propel the same, firecrackers, torpedoes, skyrockets, Raman candles, bombs, rockets, colored fires, mines, serpents ar any other article of like construction or any article containing any explosive or inflammable compound, or any tablets or other de- v i ce containing any explosive substances or i of 1 ammabl a compound; but does not include: 1. Tay pistol paper caps, toy pistols, toy canes, toy guns, or other devices in which paper caps containing .25 grains or less of explosive compound are used. 2. Snakes or s i mi 1 ar smoke-producing material cantai n i ng not more than 144 grains of combustible substances when there is no visible flame during discharge. 3. Model rackets and model racket motors designed for Ordinance - 3 the purpose of propelling recoverable aero models. 4. Cone fountains containing not more than 50 grams of pyrotechnic composition, cylindrical fountains containing not mare than 75 grams of pyrotechnic composition, Flitter spark- lers containing not more than 100 grams of pyrotechnic com- position, Ground spinners containing not more than 60 grams of pyrotechnic composition, illuminating torches containing not more than loo grams of pyrotechnic composition, wheels containing not more than six driver units or tubes, and con- taining not more than 60 grams of pyrotechnic composition or any combination item which contains two or more of the above effects. 5. Sparklers containing .25 grains or less of explosive compound and having combustible material not more than ten inches in length nor mare than 1/4 inch in diameter. ~ 18} Section 9.115 of the Uniform Fire Code i s amended by chang- ing the definition of Mechanical Code included therein t0 read: Mechanical Code is the State of Oregon Mechanical Specialty Code and Mechanical Fire and life Safety Regulations adopted by section 8,060 of the Eugene Code, 1911. X19} Section 9.117 of the Uniform Fire Code is amended by adding in alphabetical order therein: Group SR Occupancies shall be: Division 1. A~building or part thereof that is used for the 1 odgi ng and boarding of more than five residents whose evacuation capability is classified as Impractical and,wha receive personal care services, Division 2. A building or part thereof that is used far the lodging and boarding of more than five residents whose evacuation capability is classified as Slow and who receive personal care services. Division 3. A building or part thereof that is used for the lodging and boarding of more than five residents whose evacuation capability is classified as Prompt and who receive personal care services, Each Division of Group SR Occupancies can include one or more of the following foci] ity classifications: Small Residential Board and Care Smal 1 Residential Beard and Care i n Apartment Bui 1 di ngs Large Residential Board and Care NOTE: For an explanation of "evacuation capability" and "personal care", see the definitions in Section 1302 of the 1990 Structural Specialty Code. X20} Section 9.118 of the Uniform Fire Code is amended by chang- ing the definition of Plumbing Code included therein: Pl umbi_ ng Code i s the State of Oregon Plumbing Specialty Code as adopted by section 8.070 of the Eugene Cade, 1911. X21} Section 9.121 of the Uniform Fire Code is amended to add in alphabetical order therein: State Fire Cade means the State of Oregon 1989 Fire Code Edi - tion, effective January 1, 1991. • X22} Section 9.122 of the Uniform Fire Code is amended to add in alphabetical order therein: Ordinance - 4 arget or a,.._ ,q,,,.n effects are a categorization of effects which may occur, including examples of signs and symptoms. Examples of chemi- cal s which have been found to cause such effects are included i n 29 CFR 1910.1200 and listed in Appendix vI-A of this code. Target organ, ,t,oxin is a chemical that produces damage target organ effects} to specific body organs or systems. X23} Section 10.302 of the Uniform Fire Cade is amended by adding a new subparagraph ~d} thereto, to read: ~d} Testin . Sprinkler systems shall be tested annually. Testing shall include a full flaw test and drainage of the entire system. A certificate showing that the test and all ather require- ments have been met shall be submitted to the chief no later than 30 days following the date of the test. X24} Section 10.305 of the Uniform Fire Code is amended by amend- i ng subparagraph td} thereof to read: ~d} Standards. Fire-extinguishing systems shal] comply with U.B.C. Standards Nos. 38-1 and 38-2. To the extent U.B.C. Standards Nos. 38-1 and 38-2 do not provide standards, NFPA Standard No. 13, 1986 Edition, shall apply. EXCEPTION: Automatic sprinkler systems may be connected to the domestic water supply main when approved by the chief, provided the domestic water supply is of adequate pressure, capacity and sizing for the combined domestic and sprinkler requirements. In such case, the sprinkler system connection shall be made between the public water main or meter and the bui 1 di ng shutoff vai ve, and there shal 1 not be intervening valves or connections. The fire department connection may be omitted when approved by the chief. X25} Section 10.306 of the Uniform Fire Code is amended to read: Section 10.306. Automatic Fire Extin uishin S stems - where Re- uired. The bui 1 di ng code sections applicable to automatic fire exti ngui sh- i ng systems shat 1 govern, except standard automatic fire extinguishing sys- tems shall be installed and maintained in an existing or new building which has no access to a publ i c street except by way of a pedestri an mal 1 ar to which access by fire fighting equipment i s restricted by one or mare struc- tures or amenities in a public street or right-of-way. In the event the access restrictions are constructed after the bui 1 di ng has been erected, this requirement shall not apply for a period of one year after the comple- tion of those restrictions. X26} Section 10.309 of the Uniform Fire Code is amended by adding a new subparagraph ~f} thereto, to read: ~f} Combination Stand i e 5 stem. ~1} Size. Combination standpipe systems shall be not 1 ess than four inches i n diameter i n bui 1 di ngs i n which the highest autl et i s 1 ess than l5 feet from the fire department connection and shat i be not 1 ess than six inches i n diameter where the highest outlet is 15 feet or mare above that connec- tion. ~2} Construction and Testin . Fittings and connections shall be of sufficient strength to withstand 300 pounds of water pressure per square inch when ready for service. All combination standpipes shall be tested hydrostatically to with- stand such pressure for two hours, but in no case sha]1 the Ordinance - 5 pressure be less than 50 pounds per square inch above the maximum working pressure. ~3} Riser shut-off valve and drain. Each individual riser shall be equipped with an OS and Y valve at its base and an approved valve for draining. ~4} Fire de artment connections. Ail four-inch combina- tion standpipes shall be equipped with two-way fire department connections. Ali six-inch combination standpipes shall be equipped with four-way fire department connections. Combina- tion standpipe systems with three or more standpipes shall be provided with at least four-way fire department inlet connec- t ions . Each fire department connection shat 1 be 1 ocated on a street front not less than 18 inches nor more than four feet above grade and shall be equipped with an approved straight- way check valve and substantial plugs or caps. Al 1 fire de- partment connections shall be inspected against mechanical injury and be visible and accessible. The number of fire department connections shall be the number that the fire de- partment finds necessary for adequate fire protection. ~5} Outlets. Every standpipe shall be equipped with a 2-1/2" outlet with adapters for 1-1/2 inch hose not less than two feet nor more than four feet above the floor level at each story. All standpipes shall be equipped with a three-way 2-1/2 inch outlet above the roof line when the roof has a pitch of less than four inches in 12. Roof outlets are not required for roofs with a pitch greater than four inches in 12. All outlets shall be installed so that a 12 inch wrench may be used in connecting the hose, with a wrench clearance on all sides of the outlet. A standpipe located in a smoke- proof enclosure shall have an out1 et i n a vestibule or balcony. A1] such outlets shall be provided with 100 feet of 1-1/2 inch, approved-fabric hose that is equipped with an adjustable low-pressure spray nozzle that is approved by the fire depart- ment. An approved hose and nozzle shal 1 be instal 1 ed i n a hose cabinet, and a dripcock or drain connection likewise approved shal 1 be 1 ocated between the standpipe outlet and the hose. Roof outlets and outlets i n bui 1 di ngs or portions of buildings equipped with a complete automatic fire extinguish- ing system may not be provided with hoses. In areas subject tv freezing, wet standpipe systems shal 1 be protected from freezing. ~6} Sins. An approved, durable sign with raised letters at least one inch high shall be permanently attached to all fire department connections and test connections and shat 1 read: "Combination standpipe and test connection." ~~7} Section 11.101 of the Uniform Fire Code is amended to read: Section 11.101 -Outdoor Burnin and Fire Hazards, ~a} Except as subsection fib} of this section allows, no person may kindle, maintain, or allow to be kindled or maintained On premises under his control, an outdoor fire. ~ b} The following outdoor fires are permissible: 1. Fires used for cooking only. 2. Recreation fires in fire pits in officially Ordinance - 6 approved campsites, 3. Fires set and maintained for training public fire protection personnel in fire fighting. 4. Fires set and maintained by written permission of the chief to remove or alleviate afire hazard. ~cj No person may accumulate or allow to accumulate on pre- mises under his or her control materials that the chief deems to constitute afire hazard. The chief or his or her representative shall notify such a person of the hazard. Within 72 hours after receiving the notice the person shall remove the hazard. X28} Section II.1D2 through I1.II6 pertaining to incinerators and open burning are deleted from the Uniform Fire Code. X29} Section I1.2o1 of the Uniform Fire Code is amended to add: fie} Storage of Tires. Tires may not be stored without a permit. a permit may beissued if the applicant shows the follow- ing conditions can be met: 1. Piles of tires will be located nD closer than 2D feet from any property line or structure; 2. Tire stacks are within a liquid-tight dike suffi- cient to contain flammable liquids produced by burning tires and any run-off from fire streams. 3. The affected run-off will not overflow into a water- way. 4. all weeds, vines or other growth within ZO feet of the outside of the diked area are removed. EXCEPTION: Tires may be stored on a business ar residential site without a permit only if condition 1. above is met and the following two conditions are met; I. No more than 25 tires are stored in one pile on a site; 2. No more than three piles of tires spaced no less than 2D feet apart are permitted on a site; X30} Section 14.106 of the Uniform Fire Code is amended by amend- ing subparagraph ~a} thereof to read: ~a} Maintenance and Testi n . All fire alarm systems shal l be maintained and tested as set forth i n this article on an annual basis , A cert i f i cote showing that the fire alarm system was tested shall be submitted to the chief no later than 30 days fallowing the date of testing. X31} Section 25.111 of the Uniform Fire Code is amended to read: Section 25.II7 - Standb Firewatch. whenever, in the opinion of the chief, it is essential for public safety in any public assembly or any other place where people congregate, due to the number of persons, or the nature of the performance, exhibition, display, contest or activity, the owner, agent ar lessee shall employ one or more qualified persons as re- quired and approved by the chief, to be on duty at such place. Such indi- viduals shall comply with any order of the chief when so employed and shall be in uniform and remain on duty during the times such places are open to the public, or when such activity is being conducted. Before each perform- ance or the start of such activity, such individuals shall inspect the required fire appliances provided to see that they are i n proper place and in good working order, and shall keep diligent watch for fires during the time such place ~s open to the public or such activity is being conducted ordinance - 7 and take prompt measures for extinguishment of fires that may occur. Such individuals shall not be required or permitted, while on duty, to perform any other duties than those herein specified, Such individuals shat 1 control and monitor the occupancy load to insure compliance with the posted occupancy limit. X32} Section 63.101 of the Uniform Fire Cade is amended to read: Section 63.101. ,Scope. This article applies only to those refrig- erat~on units or systems de,.,~,~.~._.~.,. ' scribed herein which require a permit. X33} Section 11.106 of the Uniform Fire Code is amended to read: Section 11.106 General Requirements. Notwithstanding any provi- -----Y ~ ~ ,~ .,~,.,~..,~._.,._r... si on to the cantrar the storage of explosives and blasting agents i n quan- tities exceeding 100 pounds is prohibited within the city, except for tempor- ary storage at the site of approved blasting operations where such amount does not exceed one days's supply for use in current operations. X34} Section 11.107 of the Uniform Fire Code is amended to read: Section 77.101. State to Issue Permits. Any person desiring cer- tificates of possession ar registration of explosives as prescribed by ORS 480.230 shall comply with Sections 11.106 through 11.108 of the State Fire Code, i n addition to obtaining any permits required by this code or the ad- ministrative code. X35} Section 77.108 of the Uniform Fire Code is deleted. X36} Section 78.102 of the Uniform Fire Code is amended to read: Section 18.102 - Permits. ~a} In addition to any other permit required by law, a permit shall be required to sell, use, possess or explode fireworks intended far a supervised public display and far the retail sale of fireworks. fib} A public display permit shall not be valid for mare than ten days from the date of issuance and shall only authorize one fireworks display during the period. Permits for retail sales of fireworks shall be valid only for the period of June 23 to July 6 of the year i n which they are issued. EXCEPTIONS: No permit i s required for the fallowing uses of fireworks: 1. Sales to, use, possession or expl osi an by rai 1 road, boat, motor vehicle or other transportation agencies, for signal , warning, or i 11 umi nati on purposes i n connection with such businesses. 2. Sales to, use, possession or explosion of blank cartridges far licensed shows or theatres ar far signal or ceremonial purposes in athletic or sporting events. 3. Sales of blank cartridges for use, possession or explosion by the armed forces or any organization of war vet- erans or other organization authorized by law to parade in publ i c a col or guard armed with firearms. 4. Sale, use and possession of any items excluded from the definition of fireworks in section 9.108. 5. Sale, use and passessi on of sparklers . 6. Sale, use and possession of snakes and other similar smoke-praduci ng material that produces no visible flame during discharge, no after-smoldering, and insufficient heat to ig- ni to readi 1y combustible materials upon which the devices or materi a] s are placed. Ordinance - 8 X37} Section 78.103 of the Uniform Fire Cade is amended to read: Section 78.103 - Fireworks - Liabilit Insurance. Persons apply- ing for permits pursuant to,section 7S.10~~a} shall supply the Fire Preven- t~ on Bureau w~ th proof of 1 ~ ab~ 1 i ty insurance or other farm of indemnity i n an amount not less than $500,000 conditioned far payment of all damages which may be caused either to a person or property by reason of the authari zed display or sale and arising from any acts of the applicant, his or her agents, employees or subcontractors. X38} Section 78.105 of the Uniform Fire Cade is amended to read: Section 78.105 -Manufacture Prohibited. The manufacture of fire- works within the jurisdiction of the city is prohibited. X39} 5ectivn 18.106 of the Uniform Fire Code is amended to read: Secti an 18. _,,,,,_,_ ' , ,e i zure . ~ rewor s 5,,,,,._ - ~a} The chief may seize and remove, ar.~ cause to be seized and removed, at the expense of the owner, all stocks of fireworks svl d, offered or exposed for sale, stared, possessed, or held i n violation of this article. ~ b} The chief may destroy fireworks when i t has been deter- mi ned that destruction i s necessary for the preservation of publ i c safety or health. X40} Section 18.101 of the Uniform Fire Code is added to read: Section 78.107 - Stands and Retail Dis la s. A person may engage in retail sales of fireworks from an approved outdoor stand ar from an approved indoor retail sale display. ~a} A raved Dutdoor Stands. Such stands shat l be ] ocated a minimum of ten feet from combustible buildings, combustible bui]d- ing wall openings in non-combustible buildings, and spaces where vehicles are allowed to park. The location, arrangement and operation of the stand shall be in compliance with all rules and regulations adopted by the chief, ~~b} A roved Indoor Retail Sale Dis la s. Approved indoor retail sale displays shall not be located in a manner such that during,a fire emergency, they would hinder and/ar block any exit, ~ ncl ud ~ ng a requ ~ red checkstand exit . Flammable and combust i bl e liquids shall be kept in sealed, tight containers at least 24 feet from fireworks display and sale areas. Individuals responsib]e far retail sales shall regularly monitor and oversee operations to en- sure that the fireworks display, sales and storage areas are order- ly and maintained. Fire extinguishers shall be provided in numbers and locations throughout the retail sales site as required by NFPA Standard 10. Indoor sales shall not be permitted i n al cohol i c drinking establishments, single ar multi-family residential struc- tures or motorhomes. The location, arrangement, and operation of the approved indoor retai 1 sale display shat 1 be i n compliance with all rules and regulations adopted by the chief . X41} Section 19.103 of the Uniform Fire Code is amended to read: Section 19.103. Pl an A royal Above Ground Tanks . Tank instal 1 a- tions far the storage of flammable or combustible liquids above ground in special enclosures ar approved vaults ~ n excess of 1, 000 gallons require prior plan approval by the chief. Applications for such plan approval shall be made in accordance with the administrative code, and shall be accompanied by two copies of the construction plans, ~ ncl udi ng a plot plan shawi ng the 1 ocati on of any buildings or structures, and/or tanks, with relationship to the pre- ordinance - 9 miser and the pertinent distances, piping and valves, tank capacities, diking, details of design and construction, fire protection, along with any other information requested by the chief. X42} Section 79.503 of the Uniform Fire Code is amended to read: Section 79.503. Above Ground Stara a of Class 1 and Class 2 Li uids in Areas Other Than Those Zoned I-1 I-2 and I-3. ~a} Notwithstanding any other provision, if storage of Class 1 and C1 ass 2 liquids is otherwise permitted in areas zoned other than I -1, I -2, and I -3, no such storage wi 11 be a] 1 owed unless such storage is placed in afire containment structure and a permit has been issued by the chief, An applicant far a permit must submit a plan far the above ground storage facility and any other information the chief may require. The proposed storage facility must be: 1. Located at least 30 feet from other structures and property lines; 2. Located at least 15 feet from the point that the sub- stance will be disbursed; 3. Placed in a structure having the following character- istics: A. Made of reinforced concrete at least six inches thick, with the only opening for inspection being through the top, B. wal 1 s must be one foot higher than the highest point on the tank, C. The structure should be marked "No Smoking" in red letters at least six inches high on a white back- ground X1/4 inch stroke}, D. The building shall have NFPA Standard l04 labels on at least four exterior sides of the building. fib} No more than 6,OO0 gallons shall be stored in any single structure and no more than 18,000 gallons shall be stored on any one piece of property. Section.3. Section 8.205 of the Eugene Code, I91I, is renumbered to Section 8.105. Section 4. The City Recorder, at the request of; or with the concurrence of the City Attorney, i s authorized to administratively correct any reference errors contained herein, or in other provisions of the Eugene Code, I911, to the provisions added, amended, or repealed herein. Section 5. Notwithstanding Section 6 of this Ordinance, the effective date of Appendix I-A and Appendix I-B of the Uniform Fire Cade remains October Ordinance - Io 14, 1981. Section 6. That the matters contained herein concern the public health, welfare and safety and therefore, an emergency is hereby declared to exist, and this Ordinance shall become effectively immediately upon its passage by the City Council and approval by the Mayor, retention by the Mayor for more than ten days, ar readapted over a mayoral veto by two-thirds of all members of the City Council.
