AN ORDINANCE CONCERNING NUISANCE ABATEMENT AND
ADDING SECTION 6.115 TO THE EUGENE CODE, 1971.
THE CITY OF EUGENE DOES ORDAIN AS FOLLOWS:
Section 1. Anew Section fi.115 is hereby added to the Eugene Cade, 1911,
to provide:

g_ ` g„ Abatement, A person whose interest i n real
property i s ar may be affected by a publ i c nuisance ar a nui sauce
affecting the public, as defined i n this code, may, i n addition to other
remedies provided by 1 aw, institute ,abatement proceedings to abate or remove
the unlawful thing, substance, condition, activity ar use. To maintain such
an action, the person must shave:
~a} The,city manager, or the manager's designee, has issued
a written nonce of v~olat~on;
fib} The city manager, ar the manager's designee, has made a
written determination that, in the exercise of the manager's dis-
cret i on, the city daes not then intend to initiate abatement pro W
ceedings.
