ORDINANCE N0. 19615
AN ORDINANCE CONCERNING ANIMAL REGULATIONS; AMENDING
SECTIONS 4.330, 4.425, AND 4.445 OF THE EUGENE CODE,
1911; AND DECLARING AN EMERGENCY.
THE CITY OF EUGENE DOES ORDAIN AS FOLLOWS:
Section 1. The definition of "At large" set forth in Section 4.330 of
the Eugene Code, 1971, is hereby amended, and anew definition of "Field
training" added in alphabetical order therein, to provide:
4.330 Animal Control - Definitions. Far purposes of sections 4.330 to
4.490 of this chapter, the following words and phrases mean:
At lar e, A dog or other animal inside the corporate limits
of the city, off the premises of the owner, and not under complete
control by adequate leash. A dog in field training is excepted
herefrom unless the dog causes personal injury or property damage
off the premises of the owner.
Field trainin . A dog on exhibition in a dog show or a dog
in obedience or field training exercises which is out of general
automobile traffic and under the direct supervision of a handler
who has in his or her possession proof of obedience title or certi-
ficate of obedience far the animal in question.
Section Z. Subsection 4Z} of Section 4.425 of the Eugene Code, 1971,
is amended tv provide:
4.425 Dos at Lar a Prohibited.
~Z} A dog owner is deemed negligent per se for the actions of a
dog at large, or a dog undergoing field training, when the dog causes injury
to a person or property.
Section 3. Subsection ~1} of Section 4.445 of the Eugene Code, 1971, is
amended by adding anew subparagraph fig} thereto, to provide:

~1} In addition to the ether requirements of sections 4.330 to
4.490, the owner of a potentially dangerous dog shall comply with the follow-

ing additional regulations:
~g~ The owner of a potentially dangerous dog shall notify
the director of the transfer of ownership by sale, gift or other-
wise of the potentially dangerous dog and of the name and address
of the person to whom the potentially dangerous dvg was transferred.
Section 4. That the matters contained herein concern the public welfare
and safety and therefore, an emergency is hereby declared to exist, and this
Ordinance shall become effective immediately upon its passage by the City
Council and approval by the Mayor.
