THE CITY OF EUGENE DOES ORDAIN AS FOLLOWS: Section 1. Subsections ~2}, ~3}, and ~4} of Section 3.700 of the Eugene Code, 1971, are amended to provide: 3.700 Dawntown Develo meet District Tax - Lev . ~2} Except as provided in subsections ~3} and ~4} of this section and except for professionals, far those exempt under state law from municipal taxation, and for an owner Or occupant of property exempt from taxation under section 3.755 of this code, each person who engages in a business in the Downtown Development District during part or all of a quarter of a year sha11 pay to the city far that quarter a tax of $2.80 per $1,000 of the gross re- tail sales and receipts from the business during that quarter. A minimum tax of $10.00 shall be charged each quarter of a year for each business. ~3} Each person engaged in banking or a savings and loan associ- ation business in the Downtown Development District during part ar all of a quarter of a year, shall pay to the city for that quarter a tax of $2.80 per $1,000 of one and three-quarters percent x.0115} of the total demand deposits, and of $2.80 per $1,000 of five-tenths of one percent x.005} of the total time deposits. Total time and demand deposits of banks sha11 be the total daily average deposits during that quarter as reported on the Federal Reserve Call; and total time deposits of savings and loan associtions shall be the total daily average of ail savings deposits during that quarter. Whenever savings and loan associations receive demand-type deposits, the tax rate on those deposits shall be $2.84 per $1,000 of one and three-quarters percent x.0115} of the daily average of those deposits during that quarter. ~4} Each person engaged in a consumer finance business in the Downtown Development District during part or all of a quarter of a year shall pay to the city for that quarter a tax of $2.80 per $1,000 of five percent x.05} of the total principal balance Of direct loans outstanding at the end of that quarter, excluding finance charges. Section 2. Sectian 5,232 of the Eugene Code, 1971, is amended to pro- vide: 5,232 Prohibited Parkin in Dawntown Develo ment District. ~ 1 } The prohibitions on parking contained i n this section apply Ord i Hance - 1 in the Downtown Development District established by section 2.1543} of this code. ~2} This section applies to the following persons within that area enclosed and bordered by 4th Avenue, Patterson Street, 14th Avenue, and Jefferson Street: ~a} Those employed in the area. fib} Those who employ others in the area. ~c} Those who reside in the area. ~d} Those registered as guests at hotels or motels in the area. ~3} Except on Sunday or holiday or upon conditions and payment of charges or rates established in this chapter, no such person may, While in his ar her place of employment, while in his or her residence, or while in such a hotel or motel, parka motor vehicle between 7 a.m. and 6 p.m, on any day in an on-street or off-street parking place provided in the district by the city. Section 3. Subsection ~1} of Section 5.33 of the Eugene Code, 1971, is amended to provide: 5.233 Information far Control of Parkin in Downtown Develo ment District. ~1} Upon receiving a request from the city manager or the manager's designee: ~a} An employer of a person employed part-time or full-time in the district shall furnish the city with the full name of the employer and the employe. fib} A person self-employed part-time or full-time in the district shall furnish the city his or her full name. Section 4. Anew Section 5.276 is hereby added to the Eugene Code, 1911, to provide: 5.216 Authorit to Mark Vehicles. A police officer, parking control officer or community service specialist may mark motor vehicles that are parked, standing, or stopped to aid in the enforcement of parking regulations. Such mark shall be made by chalk upon the tires of the vehicle or by some other convenient method that will not injure ar damage the vehicle. Marks so placed shall not be interferred with, concealed, or obliterated yr erased,by any person other than a police officer, parking control officer, or community service specialist while the vehicle remains parked, standing or stopped at the place where the vehicle i s marked . Section 5. The City Recorder, at the request of, or with the concurrence of the City Attorney, i s authori red to administratively correct any reference Ordinance - 2 errors contained herein or in other provisions of the Eugene Code, 1911 to the provisions added, amended ar repealed herein. Section ~, That the matters cantained herein concern the public welfare and safety and therefore, an emergency is hereby declared to exist, and this Ordinance shall become effective immediately upon its passage by the City Council and approval by the Mayor.
