HomeMy WebLinkAboutOrdinance No. 19635'I ORDINANCE NO. ~~~0 35~ AN ORDINANCE AMENDING THE EUGENE- SPRINGFIELD METROPOLIT~iN AREA GENERAL PLAN TEXT AND URBAN GROWTH BOUNDARY AND TAKING A STATE~TIDE LAND USE PLANNING GOAL 2 EXCEPTION TD GOALS 3 AND 14 The City Council of the City of Eugene finds as follows; 1. On February 2 5 , 19 8 7 the Eugene City Council initiated amendments to the Eugene-Springfield Metropolitan Area General Plan Metro Plank to consider inclusion of 200 acres of land in the Awbrey/Meadowview area within the urban growth boundary. 2. Since that time there have been numerous public hearings and work sessions on the proposed amendments by the planning commissions and governing bodies of the City of Eugene, City of Springfield, and Lane County. on March 9, 1985, the Eugene City Council voted to tentatively adopt the proposed amendments and to refer the amendments to the City of Springfield and Lane County for adoption. 3. on February 20, 1989, the Springfield City Council took tentative action to approve the amendments to the urban growth boundary and to initiate additional amendments to the text of the Metropolitan Plan relating to industrial lands. 4. on August 30, 1989 the Lane County Board of County Commissioners conducted a public hearing on Lane County ordinances Nos. PA 971 and PA 955 amending the Lane County Rural Comprehensive Plan and taking a Goal 2 exception to Goal 3 for a railroad spur crossing land designated for agricultural uses and adopting the proposed Metro Plan amendments. The Board of County Commissioners postponed action vn the ordinances until the Eugene City Council takes final action on the amendments to the Metro Plan. 5. The proposed amendments to the Metro Plan are set forth in Exhibit A to this ordinance. They include amending the urban growth boundary to include the land shown on the map in that exhibit, amendments to the Plan Diagram text relating to industrial lands at Metro Plan pages II-E-7 and II-E-B set forth therein, amendments to the Economy Element text at Metro Plan pages III-B-1 to III-B-6 as set forth therein, and a change to the Environmental Element text at Metro Plan pages III-C-B as set forth therein. 6. The procedures and criteria for amending the Metro Plan are set out at Eugene Cade, 1971, sections 9.10 to 9.136. The findings set forth in Exhibit B to this ordinance are adopted and incorporated herein as though fully set Ordinance - 1 forth. These findings are based on the evidentiary record summarized in an exhibit to the findings. 7. on the basis of those findings, the Council concludes that the proposed plan amendments are consistent with applicable Statewide Planning Goals and with the fundamental principles and applicable policies of the Metro Plan, and that circumstances have changed in a substantial unanticipated manner since adoption of the Metro Plan so as to austify the plan changes. The plan amendment criteria set out at Eugene Code, 1971, sec. 9.136 are satisfied. NOW, THEREF4RE~ THE CITY OF EUGENE DOES ORDAIN AS F4LLONS: Section 1. The findings set out above are adopted. On the basis of these findings, the diagram and textual amendments and Statewide Planning Goal 2 exceptions to Goals 3 and 14 set out in Exhibit A hereto are hereby adopted as amendments to the Eugene--Springfield Metropolitan Area General Plan. Section ~. These amendments to the Eugene_Springfield Metropolitan Area General Plan shall become effective upon adoption of ordinances approving identical changes to the Plan by, the governing bodies of Lane County and the City of Springfield. Annexation shat ~ occur prior to development. Upon annexation, the City of Eugene shall apply the appropriate industrial zoning specifying the mi ni mum parcel size and setting forth performance standards. This site was added to the industrial 1 and inventory to provi de a 1 arge X200+ acre ~ site for a speci ai heavy industrial park. The minimum parcel size for 1 ots i n the industrial park shat 1 be 40 acres. Prior to subdivision, i t shall be demonstrated that the comprehensive development plan ensures compati bi 1 i ty among planned uses within the park as wel 1 as with adjacent properties and that access to both the Southern Pac i f i c and Burlington ~sorthern rai 1 roads has been extended into the area or that a surety sufficient to secure such extension has been pasted with the city. The comprehensive devei opment plan shall include the 1 ayout of lots , rai 1 road right-of~-way, streets, uti 1 i ti es, and performance and site development standards. It shat 1 also consider the provisions of a "public team track." The comprehensive development plan shall be designed to protect and enhance the site far special heavy industrial users reQui ri ng a campus-i i ke setting and rai 1 access. Amend special Heavy Industrial Plan Diagram Desi gnati an on page I I-E-B to read as fvl l ows: This designation accor~modates industrial developments that need 1 arge parcels, particularly those with rai 1 access. Ai though a pri ma ry purpose of this designation i s to provide sites far heavy industries, any industry which meets the applicable siting criteria may make use of this designation. Three areas are designated Special Heavy Industrial ~t#~e text wi 11 state "two" areas i f the area north of Awbrey Lane i s not added ~. Listed below are the names of the three areas and applicable 1 and division standards, use 1 i mi tati ons, and annexation and servicing provi si ans. Matron Site (southeast Springfield) Sanitary sewer service i s not available to this area i n the short--term; therefore, industrial firms may be allowed to provide self-contained sewage disposal facilities subject to local , state and federal environmental standards, Annexation to the City shall be required as a condition of devel apment approval . Land divisions i n this area shat l be a minimum of 44 acres until annexati an to Springfield has been assured. while industrial park development will be encouraged on this site, opportunity far the siting of industries that require large lots, such as 24 acres or more, will be reserved through the conceptual development planning and site plan review processes. Enid/Awbrey Area (North Eugene) The minimum level of key urban services i s available or can be readily available to this area, Prior to annexation, land divisions i n thi s area shat l be a mi ni mum of ~0 acres. Upon annexation, the City of Eugene wi 11 apply the appropriate i ndustri a1 zoning and consider reducing the minimum lot size to 20 acres at that time. 3: Economy Element Text Amendments Amend finding #9, page III-B~2; to read as follows: 9. ~'~ Hi storical ly, heavy manufacturing industries, including primary metals, chemicals and paper, have been characterized by high level s of pollution or energy cvnsumpti on, Changes i n tech no] ogy and environmental regulations have lessened the environmental impacts of these industries. Heavy manufacturing industries provide benefits, such as rel ati ve]y high wage scales and the potential for generating secondary manufacturing activities. Amend Objective #5, page III-Bw4, to read as follows 5. Supply an adequate amount of land within the urban growth boundary to accommodate: ~ a ~ the diversifying manufacturing sector 4especi al ly l ow~pol l uti ng, energy efficient manufacturing uses ~; ~b ~ the expansion of the metropolitan area as a regi anal distribution, trade, and service center. Amend Policy #9, page I I I_g-5, to read as follows 9. Encourage the expansion of existing and the location of new manufacturing activities which are characterized by low levels of pollution and efficient energy use. Add a new policy X14, page III-~-5, to read as follows: l 0.
