HomeMy WebLinkAboutOrdinance No. 19636ORDINANCE NO. 19635 AN ORDINANCE CONCERNING THE TREE COMMISSION; AMENDING SECTION 2.013 OF THE EUGENE CODE, 1911; ADDING NEW SECTIONS 2.245, 2.247, 2.249, AND 2.251 TO THAT CODE; AND DECLARING AN EMERGENCY. THE CITY OF EUGENE DOES ORDAIN AS FOLLOWS: Section 1. The table of Boards, Commissions and Committees set forth in Subsection ~1~ of Section 2.013 of the Eugene Code, 1971, is amended b y adding the following in alphabetical order therein; 2.013 Cit Council - Boards, Commissions and Committees. ~1~ The following are the presently constituted boards and commissions and committees of the city with the number of members and names of the appointive authority indicated thereafter, to ether with the term and the out g hor~ty far such board, commission ar committee: Tree Commission No, of Members: 1 Joint Parks Committee re resentative p 1 Planning Commission representative 1 Neighborhood Organization officer 1 EWEB representative 5 Citizens Appointment Process: Nominated by the Mayor, a ointed b Pp y the Council Term: 2 years -Joint Parks Committee member Planning Commission member, EWEB mem- ber, and Neighborhood Organization member 3 years* - Citizen members Authority: EC 2.249 *One citizen member shall be appointed far an initial term of one ear two shall be a oin y pp' fted for ~n~t~al terms of two years, and two shall be appointed for initial terms of three years. Section 2. Sections 2.245, 2.247, 2.249, and 2.251 are hereby added to the Eugene Cade, 1971, to provide: 2.245 Tree Commission -Created. The tree commission is established to serve as an advisory body to the executive director of PARCS and to city staff with respect to operational matters, and to the cit council on of i c i es y ,p relating to the city's program for preservation, enhancement and maintenance of Eugene's urban forest. Ordinance - 1 2.247 Tree Commission - Duties. The duties of the tree commissian in mak- ing and submitting its recommendations with respect to the city's program far preservation, enhancement and maintenance of the city's urban forest shall include, but not be limited to: ~a} Providing assistance in the development of the Urban Forestry Master Plan, and after its adoption, assistance in periodic reviews and updates of the plan. fib} Reviewing the city's annual arboricultural budget. ,~c} Reviewing plans and policies developed pursuant to other provisions of this code that contain elements of or affect matters related to urban forestry and arboricultural concerns. ~d} Assisting parks, recreation and cultural services in educating and raising the public's awareness regarding the value and s~gn~f~cance of a healthy and diversified urban forest. 2.249 Tree commissian - Membershi , Term of Office, ~~} The tree commission shall consist of nine members, nominated by the mayor and appointed by the council, and composed of: ~a} One representative from the joint parks committee; fib} one representative from the planning commission; ~c} One neighborhood organization officer; ~d} One representative from the Eugene Water & Electric Board; and fie} Five citizens. . ~2} All members shall be selected an the basis of their prior interest ~n the city's urban forest. The five citizen members shall be representative of the following areas of expertise: landscape architecture, nurseryman or horticultural specialist, forester, arboriculture service, developer and/or real estate profession, and other related fields from the tree management profession. ~3} The members from the joint parks committee, planning commis- sion, EWEB and neighborhood group shall serve for a two year term. The ini- tial terms fvr citizen members sha]1 be staggered, with one member a ointed ,PP for a one year term, two appointed for two year terms, and two appointed for three year terms. The assignment of these initial terms shall be determined by alphabetical order. Thereafter, each citizen member shall serve for a term of three years from the date of his ar her appointment. ~4} Vacancies in office shall be filled in the same manner as original appointments, far the unexpired term of the predecessor member. A vacancy shall occur upon: ~a} The death of a member; ~ b} Termination of a member's term; ~c} Removal of a member by an affirmative vote of the council; ar ~d} Voluntary resignation of a member. 2.25 Tree Commission -Officers, Meetin s, Rules and Procedures. ~1} The officers of the tree commission shall consist of a chair and a vice-chair, elected by the members of the commission. The chair sha]1 preside over meetings of the commission and shall have the right to vote. The vice-chair shall perform the duties of the chair in the absence or dis- Ordinance - 2 ability of the chair. The officers shall serve for terms of two years. ~~} The tree commission shall hold meetings at least once a month, and at other times as may be necessary to properly perform its duties. ~3} The commissian may adopt a plan of internal organization and rules of procedure for the conduct of its business, consistent with state law, the charter, code, ordinances and resolutions of the city which sha11 be submitted to the council and become effective upon council approval thereof. Meetings and other activities of the commission, its officers and committees shall conform to the rules, state statutes, charter provisions, code, ordinances and resolutions of the city. ~4~ Five members of the commission shall constitute a quorum. Section 3.
