HomeMy WebLinkAboutOrdinance No. 19637ORDINANCE N0. ~y ~3~ AN ORDINANCE LEVYING ASSESSMENTS FOR sanitary sewers in Woodruff Street from Enid Road to 600 feet north in the City of Eugene, Lane County, Oregon. The City Council of the City of Eugene finds that: Dn the 5th day of January, 1989, as authorized in the Eugene Code 7.160~8~ the City Engineer initiated the proposed local improvement consisting of sanitary sewers in Woodruff Street from Enid Road to 600 feet north. ' After due notice and a public hearing thereon before the hearing official, and no remonstrances having been filed, the City Council authorized the execution of a contract for the construction of the local imprOVement on the 21th.day of February, 1989. The actual cost thereof is ascertained, and the initial amount to~be assessed in accordance with applicable provisions of the Eugene Code, 1971 has been determined to be: Items 1 to 24 from Page 1 of PW ordinance} The City Council has established the method of calculating local improvement assessments in Sections 1.110 and 7.175 of the Eugene Code, 1971. A notice containing the information required by Section 7.185 of the Eugene Cade, 1911 has been pasted on a bulletin board at City Hall and given by certified mail to the owners of the parcels of real property subject to the assessment more than ten days prior to the public hearing before the hearing official. At the time and place specified therein, a hearings official heard all evidence and argument presented, has fully considered the same, and no remonstrances having been filed, has reported his or her adopted findings to QRDINANCE - 2 the City Council. The Council has reviewed and considered the assessment report of the City Engineer and Finance Officer and the hearings official's findings and summary of the hearing, and based thereon, THE CITE` OF EUGENE DOES ORDAIN AS FOLLOWS: Section ~. The Summary of the hearing conducted by the hearings official are hereby made apart of the Council's record in these proceedings, and the hearings official's findings, including those regarding compliance with Sections 1.1fi0 to 7.190 of the Eugene Cade, 197I,~ attached as Exhibit A hereto and incorporated herein by reference are adopted. Section 2. That the actual cyst of sanitary sewer construction in Woodruff Street from Enid Road to 600 feet north, a local improvement in the City of Eugene is the sum of $50,102.07 which is by this ordinance assessed against the parcels of property hereinafter described in the amounts set opposite, respectively. Section 3. That the City Council does hereby determine and assess each lot and part of lot being within the described local improvement district as set forth on the assessment roll attached as Exhibit B hereto and incorporated herein by reference. Section 4. That the City Council does hereby determine that each parcel of land ar lot hereinabove described is specially benefitted to the extent of the initial assessment set forth. The Finance Officer shall give notice of the assessments to the owners of the assessed parcels advising them the assessment may be paid in full, without interest, within ten days of the date of adoption of this ordinance. Assessments that remain unpaid after the ten day period are declared to be liens upon the respective lots, parts of lots or parcels of land against which said several amounts are assessed, and may be ORDINANCE - 3 paid in up to twenty equal semi-annual installments, including princi al and p interest at the rate yet by the City Mana er as rovided in Sec ' 9 p ton 2.022 thru 2.024 of the Eugene Code. The City Recorder is directed to enter in the Jacket of City Liens a statement in connection with each un ' paid assessment containing the following: 4.1 A description of each lot, part of lot or acreage liable for such improvement; 4.Z The name of the owner or reputed owner thereof that the n ame of the owner is unknown; and 4.3 The sum assessed upon said property,~the amount and date from which interest accrues, and the date of enterin the same in the dock 9 et of City Liens. Section 5. Upon enactment of this ordinance, the City Finance officer shall send notice of the assessments by first class tv the owners of the assessed parcels containing the information required by Section 7.190 of the Eugene Code, 1971, and enclose therewith an a lication for a in pp p y g the assessment in installments according to the terms set forth in Section 4 of this ordinance. BACKGROUND This project was initiated by a petition and annexations of pro- perties within the area of Woodruff Street from Enid Road to 600 feet North. Based on the ?7 percent ..petition, and recent annexa- tions to the City of Eugene the project was initiated by order of the City Engineer and dated January 5, 1989, as provided for in the Eugene Code 7.160t5~, Property owners were notified of the pending award hearing 10 days prior to the hearing. The project was authorized for construction by the City Council on February 2?, 1989. The low bid was submitted by Eugene Sane & Gravel, Inc., for an amount of $15,135.00. PROJECT The project includes 489 lin, ft, of ~" PVC sanitary sewer pipe and two manholes, and service lines. ASSESSMENT Under City of Eugene assessment policy, most of the cost is assessed to the abutting property awners. The costs to be assessed are shown below: Lateral sewer Sanitary sewer Trunk levy $ 0.127/sq. ft. $ 834.56/each $ 0.025/sq. ft. Costs listed below are the Engineer's estimate and preliminary costs quoted to the property owners at the award hearing following bid opening. Lateral sewer $ 0.13/sq, ft. Sanitary sewer $ 835.00/each Trunk levy $ 0.025/sq, ft. FINDING AND RECOMMENDATION Costs are comparable to projects of similar size and are lower than preliminary costs quoted at the award hearing. Staff recom- mends appropriation of the assessment distribution. -~ 1- ~. ~ A hearing was scheduled concerning the above matter for September 11, 1989, at 7:Op P.M. No persons indicated an interest in attending the hearing and it was cancelled. The Hearings officer has received a Memorandum from the City Engineer, setting forth the above information.
