AN ORDINANCE LEVYING ASSE5SMENTS FOR
sewer pump station on Walton lane, 1300 feet north of Honeywood Street, to
serve Sterling view Estates Phase II and contiguous property currently outside
City limits in the City of Eugene, Lane County, Oregon.
The City Counci 1 of the City of Eugene finds that
On the 25th day of April, 1988, as authorized in the Eu ene Code

7.1608} the City Engineer initiated the proposed local improvement consisting.
of sewer pump station on Walton Lane, 1300 feet north of Honeywood Street, to
serve Sterling view Estates Phase II and contiguous property currently outside
City limits. After due notice and a public hearing thereon before the hearing
official, and no remonstrances having been filed, the Cit Council authorized

the execution of a contract for the construction of the local improvement o.n
the 26th day of June, 1988.
The actual cost thereof is ascertained, and the initial amount to be
assessed in accordance with applicable provisions of the Eugene Code, 1911 has
been determined to be:

The City Counci 1 has _establ i shed the method of calculating 1 ocal
improvement assessments in Sections 7.170 and 1.175 of the Eugene Code, 1971.
A notice containing the information required by Section 1.185 of the
Eugene Cade, 1911 has been posted on a bulletin board at City Hall and given
by certified mail to the owners of the parcels of real property subject to the
assessment mare than ten days prior to the public hearing before the hearing
official. At the time and place specified therein, a hearings official heard

all evidence and argument presented, has fully considered the same, and no
remonstrances having been filed, has reported his or her adopted findings to
the City Cauncil. The Council has reviewed and considered the assessment
report of the City Engineer and Finance Officer and the hearings official's
findings and summary of the hearing, and based thereon,
THE CITY 4F EUGENE DOES ORDAIN AS FOLLOWS:
Section 1. The Summary of the hearing conducted by the hearings
official are hereby made apart of the Council's record in these proceedings,
and the hearings official's findings, including those regarding compliance
with Sections 7.160 to 7.190 of the Eugene Cade, 1911, attached as Exhibit A
hereto and incorporated herein by reference are adopted.
Section 2. That the actual cost of sewer pump station on Walton Lane,
1300 feet north of Haneywood Street, to serve Sterling view Estates Phase II
and contiguous property currently outside City limits, a local improvement in
the City of Eugene is the sum of $113,550.03 which is by this ordinance
.assessed against the parcels of property hereinafter described in the amaunts
set opposite, respectively.
Section 3. That the City Council does hereby determine and assess each
lot and part of lot being within the described local improvement district as
set forth on the assessment roll attached as Exhibit B hereto and incorporated
herein by reference.
Section 4. That the City Cauncil does hereby determine that each parcel
of land or lot hereinabove described is specially benefitted to the extent of
the initial assessment set forth. The Finance gfficer shall give notice of
the assessments to the owners of the assessed parcels advising them the
assessment may be paid in full, without interest, within ten days of the date

of adoption of this ordinance. assessments that remain unpaid after the ten
day period are declared to be liens upon the respective lots, parts of lots ar
parcels of land against which said several amounts are assessed, and may be
paid in up to twenty equal semi-annual installments, including principal and
interest at the rate set by the City Manager as provided in Section 2.422 thru
2.42 of the Eugene Code. The City Recorder is directed~to enter in the
docket of City Liens a statement in connection with each unpaid assessment
containing the following;
4.1 A description of each lot, part of lot ar acreage liable for
such improvement;
4.2 The name of the owner or reputed owner thereof, that the name
of the owner is unknown; and
4.3 The sum assessed upon said property, the amount and date from
which interest accrues, and the date of entering the same in the docket
of City Liens.
Section 5. Upon enactment of this ordinance, the City Finance
Officer shat 1 send notice of the assessments by first ci ass to the owners of
the assessed parcels containing the information required by Section 7.190 4f
the Eugene Code, 1911, and enclose therewith an application far paying the
assessment in installments according to the terms set forth in Section 4 of
this ordinance.

FINDINGS AND RECOMMENDATIONS
PROJECT: SEWER PUMP STATION ON WALTO~T LANE, 130a FEET NORTH aF
HONEYWOOD STREET, TO SERE STERLING vIEW ESTATES PHASE
II AND CONTINGUOUS PROPERTY CURRENTLY OUTSIDE CITY
LIMITS ~ CONTRACT 88--08 ~
BACKGROUND
This project was initiated by a petition from the developer for
an existing undeveloped subdivision. The properties petitioning
for the improvements will bear 27.4 percent of the improvement
costs. Since the initial petition five lots have been Bald, the
new property owners have been notified of the assessment hearing.
The developer will bear the cost of improvements for the other
properties within the subdivision.
Based on the petitions, the City Engineer initiated the project,
as provided for in the Eugene Code 7.10 ~ 8 ~ , on April Z5 , 1988
Property owners were notified of the pending award hearing 10
days prior to the hearing. The project was authorized for
construction by the City Council on June 27, 1988. The low bid
was submitted by EMK Contractor ; Inc . , for an amount of
$81,900.00.
PROJECT
The project includes sewer pump station and 2 1/2 cent levy
charges.
ASSESSMENT
Under City of Eugene assessment policy, most of the cost is
assessed to the abutting property owners, The costs. to be
assessed are shown below:
Pump Station $239.98 per lot
Levy charge (2 1/2¢> $150.01 per lot
Costs listed below are the Engineer's estimate and preliminary
costs quoted to the property owners at the award hearing
following bid opening,
Pump Station $550.00 per lot
Levy Charge (2 1/2¢> $195.00 per lot
~`INDING AND RECOMMENDATION
Costs are comparable to projects of similar size and are lower
than prelimiary costs quoted at the award hearing. Staff recom-
mends appropriation of the assessment distribution.

. A hearing was scheduled concerning the above matter for September
11, 1989, at 7:00 P,M, No persons indicated an interest in
attending the hearing and it was cancelled. The Hearings Officer
has received a Memorandum from the City Engineer, setting forth
the above information.
It is respectfully recommended by the Hearings Officer that the
City Council adopt an ordinance distributing the assessments as
set forth herein,
