An ordinance vacating the following described alley, to-
wit:
All that portion of the 14.00 foot wide alley in Block
10, of the Plat of Eugene City as recorded in Judgment
Docket A, Page 122, Lane County Oregon Plat Records,
lying North of a line between the Southeast corner of
Lot 3 of said Block and the Southwest corner of Lot 4
of said Block. ~AV 89-002 City of Eugene
RESERVING HEREIN an easement for public utility
purposes over, under, and across the above described
property, and the right tv enter thereon for purposes
of construction, reconstructive, repair and
maintenance. The easement herein reserved shall
include all land and space in the area above described,
situated and being below a horizontal plane at
elevation 438.00 feet, as determined from City of
Eugene Metro Bench Mark No. 318, elevation 421.80 feet,
a 1-1/8" brass cap embedded in the sidewalk at the
northwest corner of 8th Avenue and olive Street.
on the 20th day of September, 1989, the City Council of the
City of Eugene by Motion duly passed, called a public hearing to
be held at 7:3D p.m., Pacific Time on the 23rd day of Uctober,
1989, at the Council Chambers at City Hall, Eugene, Oregon, at
which time and place pretests and remonstrances could be heard as
to the proposed vacation of the above described alley.
Notice was duly and regularly given of the hearing and at
said time and place the Council heard all objections to the
proposed vacation.
All persons awning property abutting the alley to be vacated
have consented to the vacation and applied for the same.
THE CITY of EUGENE DQES ORDAIN AS FOLLOWS:
Section 1. The City Council of the City of Eugene finds
that due and regular notice of the hearing was published and
ordinance - 1
posted as by law required and no valid objections have been made
at the hearing or filed. The consent of the owners of the
abutting property has been duly and regularly filed in the
proceedings and the public interest will not be prejudiced by the
vacation of the alley.
Section 2. The hearing was held an the 23rd day of
October, 1959 at 7:30 p.m., Pacific Time, at the Council
Chambers, City Hall, Eugene, Lane County, Oregon, and all matters
necessary to be done in the premises have been duly and regularly
completed.
Section 3. The hereinabove described alley is hereby
vacated, and the alley so vacated shall revert pursuant to the
statutes of the State of Oregon.
Section 4. The City Recorder is hereby directed to file a
certified copy of this ordinance with the Recorder of Lane
County, Oregon, together with a map or plat of said property, and
a certified copy of this Ordinance shall be filed with the Lane
County Assessor and another certified copy shall be filed with
the Lane County Surveyor.
