AN ORDINANCE CONCERNING PATRON USER FEES; AMENDING
SECTIONS 3.810 AND 3.812 OF THE EUGENE CODE, 1971;
AND DECLARING AN EMERGENCY.
THE CITY OF EUGENE DOES ORDAIN AS FOLLOWS:
Section 1. The caption preceding Section 3.810, and Sections 3.810 and
3.812 of the Eugene Code, 1971, are amended to provide:
Patron User Fee
3.$14 Patron User Fee.
~1} For purposes of sections 3.810 and 3.812, the following words
and phrases mean:
Admission fee. The dollar amount charged directly or in-
directly, whether ar not received, for entry to an event.
Event. A performance, presentation, demonstration, exhibi-
tion, or meeting at the Hult Center for the Performing Arts or
Cuthbert Amphitheatre to which the public is invited.
Person. As defined in subsection fie} of section 3.770 of
this chapter.
Barter. The exchange of an admission fee for a commodity or
service.
~2} For the privilege of attending an event there is hereby added
to the admission fee for each attendee a patran user fee in an amount as
established by the city manager pursuant to the provisions of section 2.020
of this code. The patron user fee shall be:
~a} collected at the time the admission fee is paid,
fib} in addition to the admission fee, and
~c} separately stated on any receipt for the admission fee.
~3} Any admission established by the city manager or the manager's
designee to be a complimentary admission or to be used for the purpose of
bartering, shall not be subject to the patran user fee.
3.812 Patron User Fee - Administration and Collection.
~1} Collection of admission fees and patran user fees far all
events shal l be under the di recti an and control of the city manager. The
city manager may contract with persons to col ] ect admission fees and patron
user fees. The city manager may adopt rules and regulations on the charging,
administration, collection and payment of patron user fees.
~2} Except to the extent such disclasure is required by law, no
official or employee of the city may disclose any information regarding the
business of a person required to pay or collect the patran user fee prescribed
i n section 3.810. Nothing i n this subsection shal l prevent:
~a} The disclasure ta, ar the examination of records and

equipment by a city official, employee, or agent for the sole
purpose of administering, collecting, or auditing the patron user
fee;
fib} The disclosure of general statistics regarding taxes
collected or business done in the city; yr
~c~ The disclosure of information necessary to enforce the
provisions of sections 3.810 and 3.812.
Section 2. Until a different fee is established by the City Manager
pursuant to the provisions of Section 2.020 of the Eugene Code, 1911, the
Patron User Fee required to be paid under Section 3.810 of the Eugene Code,
1971 shall be $0.50 for events contracted for prior to November 1, 1989 or
occurring prior to December 31, 1989. The Patron User Fee for events occur-
ring after December 31, 1989 which were not contracted for prior to November
1, 1989, shall be $1.00.
Section 3. The City Recorder, at the request of or with the concurrence
of the City Attorney, is authorized to administratively correct any reference
errors contained herein or in other provisions of the Eugene Code, 1911, to
the provisions amended or repealed herein.
Section 4. That the matters contained herein concern the public welfare,
and therefore, an emergency is hereby dec]ared to exist, and this Ordinance
shall become effective immediately upon its passage by the City Council and
approval by the Mayor.
