HomeMy WebLinkAboutOrdinance No. 19309oRDINANcE No. X9309 AN ORDINANCE ORDERING A SPECIAL CITY ELECTION TO BE CONDUCTED BY THE LANE COUNTY ELECTION DEPARTMENT ON MARCH 26, 1985 FOR THE PURPOSE OF REFERRING TO THE LEGAL ELECTORS OF THE CITY OF EUGENE AN ORDINANCE TO ALLOW THE CITY TD ENTER INTO AGREEMENTS TO FACILITATE A STREET WIDENING AND LANDSCAPING PROJECT; PROVIDING FOR ALL ACTS NECESSARY FOR THE CARRYING ON OF SAID ELECTION; AND DECLARING AN EMERGENCY. THE CITY OF EUGENE DOES ORDAIN AS FOLLOWS: Section 1. The City Council does hereby order an election to be held in the City of Eugene, Oregon concurrently with the special election on Tuesday, ~~arch 2~, 1955, at which time there shall be submitted to the electors of the City for their approval or rejection, the following Ordinance, to-wit: Measure No. 51 SUBMITTED TO THE VOTERS BY THE CITY COUNCIL Authorizes City Agreements to Facilitate bth/7th Avenues Widening and Landscaping. Shall City of Eugene enter into cooperative agreements with the State to facilitate widening parts of 6th and 7th Avenues? The State proposes to widen, reconstruct and landscape 6th and 7th Avenues between Garfield and High Streets. The widening will require the removal of some historic street trees. The City Charter requires voter approval before the City enters into cooperative agreements with the State to facilitate such street widenings. This Leasure refers to the voters an Ordinance authorizing the City Manager to enter into such cooperative agreements within the next five years. AN ORDINANCE CONCERNING THE RECONSTRUCTION, WIDENING AND LANDSCAPING OF 5TH AND 7TH AVENUES AND AUTHORIZING EXECUTION OF AGREEMENTS THEREFOR. 1 - Ordinance THE CITY OF EUGENE DOES ORDAIN AS FOLLOWS: Section 1. The S tote of Oregon has funded and proposes to reconstruct and widen 6th and 7th Avenues between Garfield and High Streets, These streets form a part of Gregon Highway 99, At least twenty-six trees that are defined as "historic street trees" by the City Charter will be removed if the streets are widened, New street trees will be planted and other landscaping will be done as part of the construc- tion project. Section 2. Preliminary plans and specifications and statements of the impact of this project have been made available to the public at City Hall, A map and description of the project will be published once a week far four consecutive weeks prior to the election of March 26, 1985 in the Eugene Register Guard, a newspaper of general circulation within the City of Eugene, Section 3. The City Manager is authorized to enter into agreements with the State of ~regan and others at any time prior to March 26, 1998 to facilitate this construction project, Any such agreement with the State shall require an allocation of part of the project funds to the maintenance of the City's historic street trees. Section 4. These matters concern the peace, health and safety of the c i t i ~ ens of E ugene and an emergency is hereby declared to exist. This Ordinance shall became effective immediately upon its approval by the voters of the city. Section 2. The proposed Measure shall be placed upon the official ballot by the City Recorder, There shall be furnished to the County Clerk for Lane County certified copies of the ballot title for the Measure, The City Attorney shall prepare and the City Recorder shall furnish the ballot title far the Measure and direct that the County Clerk for Lane County place the Measure upon the ballot to be used at the special city election to be held on March 26, 1985, to be voted upon by the electors of the City. 2 - Ordinance Section 3. The necessary poll books, ballot boxes, tally sheets and other such supplies for each precinct as are necessary for the carrying on of the election shall be f urnished by th e County Clerk for Lane County, and the supplies shall be delivered to the Election Board. Section 4. The City Council hereby orders that the election shall be held concurrently with the special election on March 26, 1985 and hereby designates as the polling places for the election in the City of Eugene the polling places established and designated for the special election, and the City Council does hereby appoint the Clerks appointed to serve at that special election to serve in each of the polling places f ar the C i ty election. Section 5. The polls shall be open in each of the voting precincts at 8:40 o'clock a.m,, Pacific Standard Time, and shall be kept open until 5:00 0' clack p.m. , Pacific Standard Time, on election day. Section 6. The Clerk acting as chairperson of the Election Board in the special election shall be chairperson of the same Board of which he or she is a member in the City election, and the ballots shall be counted and tabulated and the results certified as provided by law. Section 7. The City Recorder is directed to give not less than ten days notice of the election by publication of one notice thereof in the Eugene Register Guard, a newspaper published in the City and of general circulation therein. The City Recorder 3 - Ordinance is further directed to publish in the Eugene Register uuard a map and description of the proposed street widening project at least once a week far four ~ 4 } consecutive weeks prior to the election. The City Recorder is further directed to make available to the public at City Hall preliminary plans and speci- f icatians and statements of impact far the proposed street widening project. Section 8. The matters contained herein concern the peace, heal th ~ and safety of the citizens of Eugene, and in order to comply with the directives contained herein an emergency is hereby declared to exist ~ and this ordinance shall become effective immediately upon its passage by the City Council and approval by the r~ayor.
