HomeMy WebLinkAboutOrdinance No. 19310ORDINANCE No. ~93~0 AN ORDINANCE ORDERING A SPECIAL CITY ELECTION To BE CONDUCTED BY THE LANE COUNTY ELECTION DEPARTMENT ON MARCH ~6, 19$5 FOR THS PURPOSE OF REFERRING TO THE LEGAL ELECTORS OF THE CITY OF EUGENE A MEASURE AUTHORIZING $192,353 TAX ON OWNERSHIP OF REAL PROPERTY IN DOWNTOWN DEVELOPMENT DISTRICT; ADOPTING POLLING PLACES AND PROVIDING FOR ALL ACTS NECESSARY FOR THE CARRYING ON OF SAID ELECTION; AND DECLARING AN EMERGENCY. THE CITY OF EUGENE DOES ORDAIN AS FOLLOWS: Section 1. The City Council does hereby order an election to be held in the City of Eugene, aregon concurrently with the special election on Tuesday, March 26, 1985, at which time there shall be submitted to the electors of the City for their approval or rejection, the following Measure, to-wit: MEASURE SUBMITTED TO THE VOTERS BY THE CITY COUNCIL Measure No. 5~ Shall City of Eugene tax owners of property in Downtown Development District $192,353 for 1985-86 parking program? THE CITY OF EUGENE DOES ORDAIN AS FOLLOWS: BE IT ENACTED BY THE ELECTORS OF THE CITY OF EUGENE, OREGON; Section 1. Measure authorizes tax of $192, 353 outside Constitutional 6 percent limitation on ownership of real property in Downtown Development District only and not elsewhere in City far operating expenses of District July 1, 1985 to June 30, 1986. If Measure is approved, operating budget of District to be financed by taxation on ownership of real property in District for Tax Year 1985-86 will be $2,353 more than the operating budget so financed in preceding year. Section Z. If voters approve this Measure, the 1 -Ordinance Downtown Commission will be able to continue to provide FR E parking for patrons of the Downtown area. The cost for providing this service is paid partly by taxation on property owners within the Downtown Development District boundaries and is not supported by taxes outside these boundaries. If this Measure is approved, all of the tax will be financed by District taxpayers without any partial payment by the State. Section 3. This Measure shall become effective July , . Section Z. The proposed Measure shall be placed upon the official ballot by the City Recorder. There shall be furnished to the County Clerk for Lane County certified copies of the ballot title for the Measure, The City Attorney shall prepare and the City Recorder shall furnish the ballot title for the Measure and direct that the County Clerk for Lane County place the Measure upon the ballot to be used at the special city election to be held on March ~~, 1985, to be voted upon by the electors of the City. Section 3 . The necessary poll books ~ ballot boxes ~ tally sheets and other such supplies for each precinct as are necessary for the carrying on of the election shall be f urnished by the County Clerk far Lane County, and the supplies shall be delivered to the Election Board. Section 4. The City Council hereby orders that the election shall be held concurrently with the special election on March 2G, 1985 and hereby designates as the palling places for the election in the C ity of Eugene the polling places established and designated for the special election, and the City Council does hereby appoint the Clerks appointed to serve at that special 2 ~ Ordinance election to serve in each of the polling places for the City election. Section 5. The polls shall be open in each of the voting precincts at 5:00 o'clock a.m., Pacific Standard Time, and shall be kept open until 8:00 0' clack p.m. , Pacific Standard Time, on electian day. Section b. The Clerk acting as chairperson of the Election Board in the special election shall be chairperson of the same Board of which he or she is a member in the City electian, and the ballots shall be counted and tabulated and the results certified as provided by law. Section 7. The City Recorder is directed to give not less than ten days notice of the election by publication of one notice thereof in the Eugene Register Guard, a newspaper published in the City and of general circulation therein. Section 8. The matters contained herein concern the peace, health, and safety of the citizens of Eugene, and in order to comply with the directives contained herein, an emergency is hereby declared to exist, and this Ordinance shall become effective immediately upon its passage by the C i ty Council and approval by the Mayor .
