HomeMy WebLinkAboutOrdinance No. 19317ORDINANCE NO. 19317 AN ORDINANCE CONCERNING THE COMMUNITY DEVELOPMENT COMMITTEE: REPEALING ORDINANCES N0. 19239 and 19272; ADDING SECTIONS 2.10,5, 2.147, 2.109, and 2.111 t0 THE EUGENE CODE, 1911; AMENDING SECTIONS 2.413 AND 2.1105 OF THAT CODE: AND DECLARING AN EMERGENCY. The City Counci 1 of the City of Eugene finds that: On Apri] 11, 1984, the then-existing Community Development Committee and Jai nt Housing Committee were abol i she.d and an Interim Community Development Committee established by the council pursuant to the provisions of Ordinance No. 19239. The membership of that committee was subsequently changed by Ordinance No. 19212 adopted on August 13, 1984. The interim Cammuni ty Deve1 opment Committee was established for a peri od of one year. One of its duties was to formulate recommendations for the counci 1's consideration with respect to a permanent committee to perform the same or similar functions. The most significant area of activity for the committee involves the City's annual Community Devei opment B1 ock Grant. The Interim Community Devel ailment Committee conducted public hearings on October 24, 1984, and December 13, 1984, to discuss and evaluate the committee's draft recommendations regarding the structure of a permanent committee. Recommendations were also requested and received from a vari ety of 1 ocal interest groups, including the Planning Commission, Downtown Commission, Human Rights Minority Commission, Human Rights Di sabi ed Commission, and Human Rights Presidents Council, all of which supported the committee's recom- mendation. The Interim Community Development Committee has recommended that the counci 1 establ i sh a permanent Community Development Committee and that its primary ~p~urpose be to provide the council with broad policy guidance and ORDINANCE-1 eval uati an of the City's Community Development Block Grant and related programs. Based on the above findings, i t appears in the public interest that the Interim Community Development Committee's recommendation be accepted and a permanent Community Development Committee established. NOW, THEREFORE, THE CITY 4F EUGENE DOES ORDAIN AS FOLLOWS: Section 1. Ordinances No. 19239 and 19272 are hereby repealed, and the Interim Community Development Committee established therein dissolved. Section 2. Section 3. Sections 2.105, 2,141, 2.109, and 2.111 are hereby added to the Eugene Code, 1911, to read and provide as follows: 2.105 Community Devel o ment Committee--Established. A communi ty deve1 op- ment committee i s established as an advisory body to the counci 1 to provide broad guidance and evaluation of the Cammuni ty Development Black Grant and related programs. 2.147 Community Devel o ment Committee--Duties. The duties of the committee s a Inc ude, but not a ~m~te to: ~a~ Developing recommendations for Community Development Block Grant three-year plans, including program goals and funding strategi es; ~b } Reviewing the annual Community Development Block Grant app] i cati ons, including reviewing specific requests for capital projects in conjunction with the Capital improvement Program ~CIP~, adjusting goals when needed, and approving major reprogrammings of funds to respond to changes i n priorities; ~ c ~ Soliciting community involvement i n the community level op- ment process. ORDINANCE--2 ~d} Providing community development policy and project review services as needed; ~e } Imp1 ementi ng the city's housing program through development grant review and comment; ~ f } Providing evaluations of the Community Development Block Grant Program; and fig} Such other duties as the council may from time to time request the committee to undertake, x,109 Community Development Committee--Membership ~ 1 ~ The comma ttee shad l cansi st of: ~a} One member of the City Council; fib} One member of the Planning Commission; ~ c} One member of the Downtown Commi ssi an; ~d} One citizen residing wi thi n a nei ghborhood eligible for Community Development Block Grant funds; fie} One citizen wi th a demonstrated knowledge of the needs and programs of low-income residents; ~ f } One at-large representative with expertise related to housing issues; fig} One representative from the business community; ~ h} One member from the Private Industry Council ; ~i } One citizen who i s a tenant or tenant advocate with a demonstrated fami 1 i ari ty with 1 ocal hausi ng issues; ~j} One member from the Eugene Minority Commission, or a citizen who has actively demonstrated interest and expertise i n the fie] d of minority relations and anti -di scri mi nati an causes; and ~ k } One member from the Eugene Commission an the Rights of the Disabled, or a ci ti zen who has actively demonstrated interest and expertise i n fields related to the special needs and concerns of disabled citizens, to be nominated by the mayor and appointed by the counci 1, ~~ } Committee representatives from the City Council , P1 anni ng Commission, and Downtown Commission shall serve until replaced by the council. All other members shat 1 serve for a term of three years, except for initial members, three of whom shat 1 have terms that expire i n 1988, three i n 1987, and two in 1986, ~3 } Vacancies on the committee shall be filled i n the same manner as original appointments. A position becomes vacant upon; ~a } The death ar resignation of the incumbent. ~ b } Removal of an incumbent by the counci 1 for misconduct or non-performance of duty; 4 c} Fai i ure of the counci 1 to reappoint an incumbent at the expiration of hislher term; or ~d} The incumbent ceasing to be qualified far initial appointment, 2.111 Community Devel o ment Committee--Meeti n s, Internal Organization, ~1} The committee shal 1 meet quarterly, and at such other times as the committee shall deem necessary, ~2} The committee may make and alter rules for its conduct and procedure, providing they are consistent with state law and applicable pro- vi si ons of the city charter, ordinances and policies, and are approved by the council prior to implementation, ORDINANCE--3 Section 4. Subsection ~d} of Section 2.11D5 of the Eugene Code, 1971, is hereby amended to read and provide: Z.11o5 ~d~ Committee means the community development committee. Section 5. Any references in the Eugene Code, 1971, or other adopted City ordinances, resolutions, or pot i ci ces to the Interim Community Devel op- ment Committee shat 1 be deemed a reference to the Community Development Committee established herein unless the context i n which i t i s used clearly indicates otherwise, and the City Recorder i s authorized to admi ni strati ve1y amend the references upon concurrences of the City Attorney's office. Section 6. That the matters contained herein concern the publ i c wel - fare, and i n order to ensure the orderly transition from the Interim Community Deve1 opment Committee to the committee established herein, an emergency i s declared to exist, and this ordinance shall become effective immediately upon its passage by the City Counci 1 and approval by the Mayor.
