HomeMy WebLinkAboutOrdinance No. 19325ORDINANCE No. 19325 AN ORDINANCE CONCERNING MOBILE HOME REGULATIONS; AMENDING SECTIONS 9.268, 9.384, 9.356, 9.$02, AND 9.806 OF THE EUGENE CODE, 1971; AND DECLARING AN EMERGENCY. THE CITY OF EUGENE ODES ORDAIN AS FOLLOWS: Section 1. Subsection fib} of Section 9.268 of the Eugene Code, 1971, is hereby amended by adding a subparagraph 4. thereto to read and provide: fib} Sub-districts of residential districts. 4, MH - Mobi 1 e home subdistrict. Thi s ~di stri ct may be established in order to allow mobile homes on individual lots outside mobile home parks and mobile home subdivisions sub- ject to the procedures and findings required for changes in district boundaries in this chapter, and, provided at the time of application the development site is: a . ~lacant, b. At least three acres, and c. Contiguous on at least half its boundary to parcels that average no more than two dwelling units per gross acre, which includes streets. Section 2. Section 9.384 of the Eugene Code, 1971, is hereby amended to read and provide: 9.384 Uses. The following reflects the uses permitted outright, condi- tionally, or subject to standards or other requirements of this code within the RA, R-1, R-2, R-3, and R-4 zoning districts: P .............. Section 9.502 of the Eugene Code, 1971, is hereby amended by renumbering the present Standards 16, 1~, 15, 19, 20, 21, 22, 23, 24, 25, .26, 27, and 2S to 17, 15, 19, Z0, 21, 22, 23, 24, 25, 26, 27, 28, and 29, and adding a new Standard 16 thereto, to read and provide; 9.386 S eci al Standards For Certain Uses In Residential Districts. (16} Mobile Homes Outside Mobile Home Parks and Mobile Home Sub- divisions: Must be an parcels zoned /MH Mobile Home and conform to the standards in section 9.806~f}. ~ 17} Multi -Family, In R-2, R-3, or R~-4 districts, site review i s required for ten or more units when: ~a} next to, fib} across an alley from, or ~c} directly across a local street from an existing single family dwelling. X18} Panhandle lots: Must conform to the standards ~in section Lion 9.095 of this chapter. X19} Sin le Family Accessory Units: ~a} The structure containing the accessory and main dwell- ing units must be detached from other dwellings. fib} Either the main or accessory unit must be owner-occupied. ~c} The structure containing the accessory and main dwelling units must have at least 1,500 square feet of floor area, exclud- ing garages and garage areas used for storage. ~d} The accessory dwelling unit must: 1. Be an efficiency unit with a maximum of 500 square feet of floor area, ar 2. Be a conventional unit with a living room, kitchen, and one other habitable room, such as a bedroom, with a maximum of 600 square feet of floor area, or 3. Occupy one ful 1 story of a mul ti -story structure, or 4, occupy a maximum of 40% of the October 25, 1982, total floor area of the main dwelling. fie} There must be at least three off-street parking spaces on the property to serve the accessory and main dwelling units. ~f} There must be no home occupation in the structure. fig} Unless all the people living in both the accessory and main dwelling units are related by blood, marriage, or adoption, Ordinance - 3 the total number of people living in the two units is a maximum of five. ~20~ Small Lot Provisions: ~a} Must be on individually recorded lots or parcels, ~b~ Minimum lot area per dwelling unit: 2,250 square feet. ~c} Minimum development site: 2,250 square feet. ~d} Minimum lot frontage: 30 feet. fie} Minimum average lot width: 30 feet. ~f} Minimum lot depth: 75 feet. ~g~ Maximum length to width ratio: 2.5 to 1, except 5.5 to with planning director approval if it would be consistent with: 1. Adequate provision of public facilities and ser- vices, as well as light, air, and open space. 2, Protection from flood, fire, and similar risks. ~h~ zero side yard setback option: Permitted. ~i} Height maximum: 25 feet in the R-2 District; 40 feet in the R~-3 District; 25 feet i n R-3 and R-4 districts within 50 feet of abutting, or across an alley from abutting, properties zoned RA, R-1, or R-2. (j} Front setback minimum: 10 feet, 15 feet for driveways. ~k~ Front yard landscaping: 50% minimum except may have an 15 foot deep and 20 foot wide driveway in which case the minimum i s the rest of the required setback area. ~1} Required outdoor living area: 10% of gross floor area. gym} Maximum lot coverage: 55 percent in R-2 and R-3 Dis- tricts, and 60 percent in the R-4 District. X21} Home occupations: Must conform to standards in section 9.496. X22} Hospitals i n R,-4 Districts: Prohibited i n the fol 1 owi ng area: Beginning at 13th Avenue and ~H~l~~yard Street, then south on Hi lyard Street to 18th Avenue, then east on 18th Avenue to Kincaid Street, then north on Kincaid Street to 13th Avenue, then west on 13th Avenue to Hilyard Street. X23} Mobile Home Parks: Must conform to standards and procedures in sections 9.510, 9.512, and 9.815. X24} Mobile Nome Subdivisions: Must conform to standards and procedures in sections 9.814 and 9.816, X25} Planned Unit Devela menu : Must conform to standards and procedures in sections 9.508 through 9.520. ~ 26 } Public and Semi -Public Bui 1 di n s ~a} Must be essential to the physical and economic welfare of the area such as fire stations, substations, and pump stations. fib} Must conform to section 9.554 special setback require- ments. X27} Schools, Private: ~a} Must be state licensed and provide general education programs as a primary activity fib} Must conform to section 9.554 special setback require- ments. (2S} Schools, Public: ~a~ Must dedicate and improve public streets and convey ar dedicate public utility easements as the City deems necessary. fib} Except for colleges and universities in the R-4 Dis- ordinance - 4 trict, site plan approval based on the criteria in section 9.68$ i s required. ~c} Must conform to section 9.554 special setback require- ments. X29} Stables, Commercial: Minimum development site of ten acres. Section 4. Section 9.8D2 of the Eugene Code, 1971, is amended to read and provide: 9.8D2 Mobi 1_e__Homes - Descr,i p Purpose. The regulations contained _ _ _ ton and ~_ in sections 9.8DZ to 9.518 are intended to provide a suitable living environment for residents of mobile homes and set forth development standards that will be compatible with adjacent land uses. Section 5. Subsection ~f) of Section 9.806 of the Eugene Code, 1971, is amended to read and provide: 9.8D6 Mobile Homes - Permitted Locations. Unless otherwise provided herein, upon compliance with applicable regulations and processes mobile homes for dwelling purposes only shall be permitted: ~f} Dutside mobile home parks or mobile home subdivisions, provided, however, a mobile home may not be used for sleeping or living purposes fora period of time in excess of 72 hours unless it conforms to the following standards: 1. Minimum lot size per mobile home: 4,500 square feet. ~. Roof materials; Composition shingle, woad shake, ar other non-~ref 1 ecti ve materials al 1 owed by the State Struc- tural Specialty Cade. 3. Roof pitch: A three foot rise for every twelve feet across. 4. Minimum size and dimensions: Double-wide, 24 by 40 feet; 960 square feet of floor area. 5. Wheels, axles, hitches, and travel lights must be removed. 6. The area under the mobile home must be excavated and a permanent foundation or retaining structure installed. The area around and under the mobile home must be adequately drained. The mobile home can be a maximum of 18 inches above the average surrounding grade. 7. Mobi 1 e home and accessory building foundations and structures must be of sufficient strength to support the re- quired live-loads and actual dead-loads imposed by the mobile home and any attached or supported structure based on accept- ed engineering standards. Foundations, tie-downs, and other supports must be able to withstand the specified horizontal, up-lift and overturning wind forces on the mobile home and ordinance - 5 any attached or supported structures based on accepted engi- neering design standards. $. The space between the mobile home and ground level must be completely enclosed with a permanent perimeter enclo~ sure, except as required for ventilation. It must be compat- ible with the mobile home's exterior siding. 9. Rain gutters in harmony with the roof and siding are required. 1a. The home must be new at the time of installation. 11. Siding must be non-reflective, and textured or wood- stained. 12. A minimum nine by twelve foot accessory storage building ar garage, with siding and design that matches the mobile home, must be placed on the lot. 13. Parking: The same as required for single family dwellings, two per unit. 14. Each home must possess an insignia showing that it was manufactured according to the National Manufactured Hous- ing Construction and Safety Standards Code. 15. Each home must comply with al 1 app1 i cabl e 1 ocal , state, and federal regulations in effect at the time of in- stallation. Section 5. That the matters contained herein concern the public wel- fare and safety, and in order to insure the orderly implementation and ad- ministration of these procedures, an emergency is hereby declared to exist, and this Ordinance shall become effective immediately upon its passage by the City Council and approval by the Mayor.
